
Judge of the Krasnogvardeisky District Court of St. Petersburg Svetlana Karlova sentenced the 35-year-old senior operative of the city OP-26 Captain Andrei Artemyev by 1 year 9 months of the general regime for the murder of him in her official office of the local resident Dmitry Demidov. This was reported to the "Franes" by the lawyer of "Agora" Vitaly Cherkasov, representing the interests of the mother of the deceased.
Artemyev was accused under Part 1 of Article 105 (murder) and paragraphs "A", "B" Part 3 of Article 286 of the Criminal Code (abuse of authority using violence and weapons). In the debate of the parties that passed on December 7, the prosecutor requested 12 years of strict regime for the defendant.
However, Karlova re-qualified the charges under the 105th article on part 1 of Article 109 (causing death by negligence), and under Article 286 fully acquitted Artemyev.
“We categorically disagree with such a sentence and after its study we will definitely appeal it,” Cherkasov assured.
Artemyev himself, in his testimony at the trial, stated that, taking a gun from the holster, he involuntarily twisted the shutter, after which a shot occurred. He also said that after the death of Demidov he did not touch anything in the office, but immediately went down to the duty unit and announced the incident.
“At the same time,” Cherkasov remarked, “he did not want to explain who changed the location of the murdered body, as well as objects in the office: cognac bottles, a pistol, holster store, why the gun was smeared with blood, who left the blood drops in the corridor and toilet. He referred to shock and confusion.”
Meanwhile, the lawyer continued, Artemyev knows how to handle service weapons, since he used to serve in the Airborne Forces in Chechnya, and after the device in the structure of the Ministry of Internal Affairs was undergoing service and combat training.
Cherkasov also emphasized that Artemyev did not explain why he twisted the shutter of the pistol in a situation when a calm conversation was held between him and Demidov, during which he treated the latter with cognac. "
The lawyer added that in the debate he asked Karlov to make a private definition to the leadership of the Central Internal Affairs Directorate in St. Petersburg. Earlier, Cherkasov explained, the investigator made a warning about incomplete official compliance with the appearance of drunk in the service, and the psychologist warned Artemyev’s superiors that he was at risk as an alcoholic.
However, the judge did not issue such a definition.
37-year-old Demidov died on November 11, 2015 from a shot in a mouth from Makarov’s table pistol owned by Artemyev. The incident occurred when Demidov and Artemyev were alone in the police officer’s office. Initially, it was stated that the Petersburger grabbed the gun at the operative. This refuted the original version of Artemyev, according to which he left the gun on the table, and when he turned away, Demidov shot himself. In addition, it was confirmed that the body of the murdered was moved.
Finally, the third conclusion of a second examination denied the version that Artemyev expressed already at the trial - that when he took out a gun from a holster, the fuse caught on it and moved. As it turned out, all the details of the pistol were working and spontaneously the fuse could not change its position.
