
In Crimea, FSB officers detained Ukrainian activist Vladimir Balukh. This was reported by the Crimean human rights group with reference to the wife of the activist.
On Thursday morning, the FSB officers conducted searches in the houses of Baluha and his mother in the village of Serebryanka of the Razdolnensky district of Crimea. After a four -hour search, the security forces said that in the attic of the activist’s house they discovered 90 rounds and several TNT checkers. The activist was detained.
Relatives suggest that ammunition was thrown by the FSB officers during the search.
According to human rights activists, Baluh is located in the Razdolnensky IVS. In the near future, a court must be held to choose a preventive measure in relation to the activist.
On November 29, in the morning, the farmer Baluh attached a sign on the wall of his house "Wulitz heroes of heavenly, 18" . On the same day after lunch, the chairman of the village council controlled by Russia Vitaly Stepanyuk appeared to him and demanded that this sign be removed. “Stepanyuk said that I placed the sign illegally,” the activist explained. “He hinted at my future communication with the police.”
In December 2013, in the first weeks of the Revolution of Dignity, Baluh hid the flag of Ukraine over his house. The flag sang on the roof for almost a year and a half. The activist did not recognize the annexation of Crimea and did not apply for Russian citizenship, retaining the Ukrainian one.
April 30, 2015 in the houses of Baluha and his mother were searches. The police said they suspect an activist of stealing a gearbox from the tractor. During the search, the Ukrainian flank was disrupted. No accusations were brought to the Baluh. In the future, the activist hung a new flag over the house.
On November 14, 2015, the security forces reappeared the Baluha with a search. The reason was the statement of a witness, according to which the activist supposedly keeps a stolen car in the house. The search was authorized by the judge of the Russian Razdolnensky District Court Alexander Abelyashev. Police operatives G. Yashchenko, K. Kudrya, A. Fedotov, G. Dubrovchenko, K. Mitchenkov, as well as Lieutenant Yevgeny Baranov, searched the activist’s house. They acted with the support of riot police.
After Balukh was indignant at the unceremoniousness of the visitors, the two masks began to wring his hands, and when they did not succeed, they began to beat him on the head and kidneys.
There was no stolen machine. However, the police fabricated the protocol on part 1 of Article 19.3 of the Russian Administrative Code (disobedience to the legal request of the policeman), on the basis of which Judge Ablyashev arrested the Baluha for 10 days. As the activist himself explained, this was done so that he would not record the beatings caused by the police from the doctors. Being under arrest, Balukh repeatedly demanded medical assistance and each time received a refusal.
Then, a criminal case was opened against the activist, inviting him article 319 of the Russian Criminal Code (insulting a representative of the authorities). It was claimed that during the search he insulted one of the operatives - Lieutenant Baranov. As evidence in the case, Ablyashev’s decree on the administrative arrest of the Baluh appeared.
The activist himself did not exclude that in response to beatings he could swift the security forces, but refused to find himself guilty of this. "It turns out that when you are detained, treated on the kidneys and put your foot on your head, should you be expressed exclusively by Dostoevsky's language?" he ironized.
On February 5, the chairman of the Razdolnensky District Court Tatyana Polkalo declared Baluha guilty and sentenced him to 320 hours of compulsory work. The activist appealed to the Russian Supreme Court of Crimea, indicating in the complaint that the verdict was passed with the aim of its political persecution for the openly demonstrated loyalty to Ukraine.
Judge Anatoly Osochenko satisfied the complaint, canceling the decision of the burial and sending the case for a new consideration. It was not excluded, however, that he did not take into account the activist’s arguments, but the arguments of the appeal representation considered by the Russian prosecutor of the Razdolnensky district Dmitry Shmelev.
However, on June 10, the judge of the Razdolnensky District Court, Maria Bedritskaya, sentenced the Baluha the same sentence as before.
As noted in the Crimean human rights group, Russia violated a number of norms of the European Convention in relation to the Baluha. These are Articles 5 (the right to freedom and personal integrity), 6 (the right to a fair trial), 7 (punishment exclusively on the basis of the law), 8 (the right to respect private and family life), 10 (freedom of expression) and 13 (the right to an effective means of legal protection).
