The judge of the Murmansk Regional Court Anton Venediktov acquitted the huntsmen of Viktor Mikhailovsky, who in August last year shot citizens of Vladimir Tyapin and Alexander Matsnev, one of whom was operating and the other as a backward police. This was reported on Monday by "TV-21". Venediktov pointed out that the defendant had no corpus delicti in the actions of the defendant.
51-year-old Mikhailovsky was charged with paragraph "A" of part 2 of Article 105 of the Criminal Code (murder of two persons). In the debate of the parties, the prosecutor Sergei Stepovi asked for the defendant 17 years of strict regime with a two -year restriction of freedom after serving the deadline. He also demanded to recover 3 million rubles from Mikhailovsky in favor of the families of each of the dead as compensation for non -pecuniary damage.
The defendant himself did not plead guilty. He insisted that he did not exceed the limits of acceptable self -defense.
The regional prosecutor's office intends to appeal the acquittal to the Supreme Court.
On August 25, 2015, Mikhailovsky traveled around the hunting grounds of the Krechet club in the area of the Shovna River. He took his 7-year-old son with him. On the road in the forest, the huntsman stopped a car for checking the documents in which 45-year-old Tapin and Maznev, who came to each other, were rode. Both of them were drunk.
One of the hunters, having left the car, refused to present documents, saying: "You must know me by person." To repay the conflict, Mikhailovsky decided to leave. “But with me,” he said, “this could not be done, because the second pulled out of my child’s car, threw it into the bushes. The child screamed, hysterical. They actually took him hostage.”
The huntsman got out of the car. Then the drunks told him: "Come here, hero, we will kill you."
Mikhailovsky, acting according to the Law on Weapons, warned the hunters that he would shoot. When this did not work, he shot from his carbine into the air. After that, one of the drunk took a shot towards the huntsman. He answered, aiming the hunter in the shoulder, but he got into the chest and killed the drunk on the spot.
The second hunter, holding the gun, began to approach the huntsman. Mikhailovsky shot twice into the air and persuaded to stop, but this did not work. When the distance between the drunk and the ranger decreased to two meters, Mikhailovsky fired to defeat. The second attacker was also killed on the spot.
On August 28, 2015, Mikhailovsky was detained. During the trial, which began this fall, the huntsman was already under the subscription about the lower room. As it can be assumed, he spent a year in jail and was released in connection with the expiration of the deadline for detention on imputed charges.
Judge Venediktov canceled the action of the subscription taken from Mikhailovsky.
