On December 22, the Supreme Court of Crimea considered the appeals of two more participants in the motor rally on the Day of Remembrance of the victims of the deportation of Crimean Tatars, Alim Muslyadinov and Ablyakim Ablyakimov, accused of holding an uncoordinated public event.
Lenora Dulber wrote about this on her Facebook page.
During the consideration of the complaint, the court decided to reclassify the actions of Muslyadinov and Ablyakimov from part 2 of article 20.2 of the Code of Administrative Offenses to part 5 of the same article - that is, from organizing an uncoordinated public event to participating in it, reducing the fine by half - from 20 to 10 thousand rubles.
A week ago, the Crimean court made a similar decision regarding two more participants in the run, Enver Chavush and Seitmamut Seytumerov.
During today's meeting, Muslyadinov and Ablyakimov noted that they did not take part in mass events, they were detained because Crimean Tatar flags were installed on their cars, which were moving to the place of mourning events as part of a convoy.
“Naturally, there could not have been any rally while the convoy of cars was moving,” Alexander Popkov, the lawyer for Muslyadinov and Ablyakimov, said.
The lawyer said in court that the hanging of flags in itself cannot serve as a sign of a mass event and demonstrate the presence of some goals or ideas.
“Just like hanging the flags of victory or the flags of the airborne troops,” the lawyer summed up.
On May 18, 2016, activists from Sudak drove along the route with Crimean Tatar flags framed in black ribbons. Ablyakim Ablyakimov, Enver Chavush, Seytmamut Seytumerov and Alim Muslyadinov were detained, and protocols were drawn up on them for violating the procedure for holding public events. In June, the Sudak City Court closed the case due to the lack of corpus delicti. However, the police appealed this decision, and at the end of August the cases were reopened. On October 27, a court in Crimea found four rally participants guilty of holding an uncoordinated public event (under Article 20.2 of the Code of Administrative Offenses) and fined each of them 20,000 rubles.
