
The TFR for the third time presented the nationalist Dmitry Demushkin’s final accusation of the extremism case. This was reported by RAPSI with reference to Mikhail Tikhonov, a politician lawyer.
In the near future, Demushkin and his defense will begin familiarization with the case file.
The case against Demushkin became known in December 2015 . Policy faces up to four years in the colony under part 1 of Article 282 of the Criminal Code (excitement of hatred or enmity).
Initially, Demushkin, according to various sources, was charged with seven or eight episodes, but by the spring of this year there was only one left in the case - the publishing by a politician in his VKontakte photographs from the “Russian march - 2014”, depicting a banner with the inscription “Russia of Russia”.
The accused himself noted that the text of the stretch was agreed with the police and there were no problems with this banner on the march itself. In addition, in August 2015, the Demushkin’s VK page was removed in connection with the decision of the Nagatinsky District Court of Moscow, which arrested a policy for 15 days under Article 20.3 of the Code of Administrative Offenses (public demonstration of prohibited paraphernalia).
In the spring, Demushkin’s business entered the Nagatinsky district court. The hearings on the merits opened on May 6 . The prosecutor in the debate requested two years of real term for the defendant. However, on June 14, Judge Eleanor Vanin returned the case file to the prosecutor’s office , referring to the inability to establish the guilt of the defendant.
The investigation was resumed. On October 28, Demushkin was re -charged . However, the prosecutor's office refused to approve the indictment and returned the case to the investigation department.
On December 5, the Investigative Committee added an additional episode - the publication by a politician in Vkontakte a certain “photography with a child”. A new, third in a row, examination was scheduled. Lawyer Oleg Kolesnikov, who, together with Tikhonov, representing Demushkin's interests, expected that she would take two months. However, it took only three weeks to complete the investigation of the Investigative Committee.
Kolesnikov regarded the inclusion of the new episode as "an attempt to fix the collapsing business." In addition, he noted, in the presence of not one, and two episodes in the court will have more formal grounds to sentenced Demushkin to the real term. “In one picture, this is not serious, and in two pictures - two compositions,” the lawyer explained.
Demushkin has been under the recognizance not to leave for almost a year. However, on October 21, he was detained immediately after he submitted a notification to the Russian City Hall about the Russian march, and on the same day the Presnensky district court of the capital sent the accused under house arrest . The decision was adopted at the request of the investigator of the Investigative Committee, which declared that the politician repeatedly violated the subscription.
On December 19, Demushkin’s house arrest was extended for another two months - until February 21, 2017.
