
Judge of the Maykop City Court of Adygea Vitaly Galagan sentenced the activist of the International Movement "Patriots of Circassia" Adnan Huade by 1 year 8 months of restriction of freedom for a fabricated accusation of attempts to bribe a traffic cop. This was reported by the "Caucasian Knot" with reference to the lawyer Iland Abregov, who, together with his colleague Yuri Ashinov, defended the activist.
Given the time spent in jail and under house arrest, Huade remains to leave four months of the appointed deadline. At this time, he is forbidden to leave Maykop.
Galagan declared the activist guilty under Part 3 of Article 30 - Part 1 of Article 291.2 of the Criminal Code (attempt on petty bribery). Initially, part 3 of article 30 - part 3 of Article 291 of the Criminal Code (attempted giving bribes to the official for obviously illegal inaction) were charged, but in the debate of the parties that passed on December 28 , the prosecutor Mikhail Ivanenko asked to re -qualify the accusation for less serious. For the defendant, Ivanenko demanded two years of restriction of freedom.
Huada himself did not admit guilt. According to Natpress, on January 16, speaking with the last word, the defendant said that he was persecuted for his socio-political activity.
The activist called the main area of his activity the struggle for the recognition of the Circassian genocide committed by Russia in the 18th-19th centuries. This struggle, Huade emphasized, does not provoke a national rash, since the restoration of justice cannot cause enmity of other peoples, in particular Russians. In addition, he added the defendant, he conducts his activities within the framework of the law.
Huade also again pointed to inconsistencies in the case, noted by him in the debate of the parties. In addition, he demanded to initiate criminal cases against the traffic police inspectors Ali Borsov and Murat Nakhushev, whom he accused of provocations of giving a bribe.
In the debate, the activist said: "I consider what happened to me from beginning to end a provocation, a staging organized by special services."
Hearing on the merits continued on September 6, 2016. Huade, a repatriate from Turkey, talked with other participants in the process through a translator.
The verdict to the activist will be appealed. As the lawyer Abregov noted, there are a lot of procedural violations ignored by Judge Galagan.
The chairman of the Kabardino-Balkarian human rights center Valery Khatazhukov, commenting on the “Caucasian Knot” verdict, noticed: “If we talk about modern judicial practice in such cases, then Huade could get a real term.” In the appointment of a relatively mild punishment, the human rights activist suggested, "the fact that representatives of the public throughout the Northern Caucasus and the Circassians residence played in his (HUADE. - ed.) .
Huade was detained in Maykope in the evening of May 5, 2016. It was reported that he was suspected of trying to give the inspector Borsov a bribe of 10 thousand rubles, so that he would not draw up an administrative protocol on the ride without rights. On May 11, the Ministry of Internal Affairs in Adygea reported that on the basis of this protocol, the activist was given 15 days of administrative arrest.
“We do not know all the circumstances of the matter, but for some reason they detained him at home, and not on the road,” said Ali Bgane, a member of the Council of the Maykop city Adyge Hase (Circassian parliament). It was also reported that not only police officers, but also FSB operatives participated in the detention of the activist.
Meanwhile, on May 18, the Huade family received a notification of the Adyghe head of the Investigative Committee that the 16th day against an activist opened a case of bribery. On the same day, the chairman of the Maykop Adyge Hase Zaurbiy Chundishko, as well as Bgane and another member of the Council - the editor -in -chief of Natpress Aslan Shazzo - on May 18 sent the then head of the region Aslan Tkhakushinov in defense of the HUADE. Social activists said that the persecution of their colleagues is due exclusively by his civil activity, and asked to protect his rights.
Earlier, the Coordinating Council of Circassian activists made a similar appeal, uniting representatives of the national public from Russia, Germany, Israel, Jordan, Turkey and the USA. They also demanded to immediately stop the pursuit of Huade.
On May 21, the Movement "Patriots of Circassia" organized a rally from the Russian General Consulate in Istanbul demanding to close the case against Huade. Over 100 people took part in the action.
Meanwhile, after the departure of 15 days of arrest, that is, around May 20, the HUADE was sent to the Adygea pre-trial detention center in the Tlyustenhabl region of the Tekezhsky district. There he spent about four months. On September 16, the College of the Supreme Court of the region, having examined the appeal of the extension of the term of detention, transferred him to house arrest. Two months later, on November 11, Judge Galagan refused prosecutor Ivanenko in extending Huade's house arrest and freed the defendant on a recognizance not to leave.
In addition to the recognition of the Circassian genocide, the activist achieves state assistance to the relocation of Circassians from Syria.
On December 13, 2013, Huade, like about 10 Circassian and Abazin activists from Adygea, Karachay-Cherkessia and Kabardino-Balkaria, was detained and delivered to Krasnodar on behalf of the regional headquarters of the Investigative Committee. Searches were searches at home. The authorities explained their actions by the search for a certain Mojahidean by the name of Chernyshov. On the evening of December 14, activists were released.
On May 25, 2015, the houses at Huade and in the store owned by him were searches with the seizure of electronics and commercial documents. On December 17, 2015, the Maykop City Court was arrested by Huade, his daughter Danu and the saleswoman of the store Said Borsov for 15 days after the conflict with the FSB. Three days earlier, December 14, the FSB, the police and the Rospotrebnador appeared at the HUADE store with a check. The next day they came again - but already without documents. Huade with her daughter, as stated in administrative protocols, tried to escort them. As a result of the brawl, glass broke in the window. What the saleswoman Borsov was accused was not specified.
