On January 17, Alibek Delimkhanov, the head of the alleged killer Zaura Dadaev, who was an operating officer, testified in the Moscow District Military Court on January 17. In May 2015, Delimkhanov was promoted by appointing the deputy commander of the 46th Separate Emergency Brigade of the Internal Troops named after Akhmat Kadyrov. It is known about him that he is the hero of Russia, wears the title of Colonel of the Russian Guard and is his own brother of the State Duma deputy Adam Delimkhanov, known for his proximity to Ramzan Kadyrov. Apparently, it was he who was instructed to puff for all senior Chechen officials and security forces, whom representatives of the victims would like to see during interrogation. But someone refused to call the court, and the most important “witness”, which is discussed at every meeting-the deputy commander of the battalion “North” Ruslan Geremeyev-is still “not found”.
Delimkhanov, dressed in the form with awards, entering the courtroom, greeted the defendants in Chechen. He was positive and almost glowed, standing behind the rostrum of the witness.
However, in two hours of interrogation, it turned out that a person who served in the North battalion for 9 years, and then in the operational appointment brigade and is currently a listener of courses in the General Staff in Moscow, does not know about how weapons are being shot before dismissal of military personnel, nor about how the dismissal itself, or orders made in his battalion at the time of his same command.
To the first question of the judge with whom he was familiar from the defendants sitting on the bench, Delimkhanov pointed to Zaura Dadaev as his former subordinate.
The lawyers of the Nemtsov family with Delimkhanov had more than 40 questions. They were asked by Vadim Prokhorov. Amnesia in a witness began to manifest itself from the very first minutes.
Did Delimkhanov sign any business trips to Moscow? "I don't remember."
Did the North battalion participate in the detention of Beslan Shavanov in Grozny (another defendant in the “Nemtsov case”, who was killed during the detention, served in the battalion for 10 years)? “Perhaps if we ( battalion . - Ed. ) We were in the city.”
- Did Zaur Dadaev go to Moscow on business trips? - asked Prokhorov.
- I personally are not.
“Allow me to present material evidence then,” and Prokhorov showed the travel certificate of Dadaev with the signature of the military unit, where the commander was Delimkhanov.
Prokhorov showed Delimkhanov an extract of January 20, 2015: “To be assigned to the deceased ... Dadaeva Zaura Sharipovich.”
- Where is my signature? - Delimkhanov asked the lawyer with a challenge.
“The document was certified by Mr. Yunaev ( acting chief of staff of the regiment, subordinate to Delimkhanov . - Ed. ),” Prokhorov said.
Another document is from February 28: “To believe the arrivals ... Dadaeva Zaura Sharipovich.” It has a signature of Yunaev, but Alibek Delimkhanov is also indicated in the document.
- Tell me, why did Dadaev actually returned to Grozny on March 1, and the document ( about dismissal . - Ed. ) Dated February 28?
“All questions to the commander of the district,” Delimkhanov answers dryly.
- When and under what circumstances was a decision on Dadaev’s dismissal?
- This decision is made by the commander of the district.
- Do you all military personnel quit in one day? Or does the dismissal process take a longer time?
- All questions to the commander of the district ...
- That is, in the framework of your specifics of work in the military unit, you do not know this?
- All questions ...
- To whom? To Zolotov?! - Prokhorov could not stand it.
The witness was silent.
How was weapons shot in the battalion before dismissal? This is fundamentally important, since Dadaev explains the results of the examination, which revealed traces of powder gases on his hands, because he shot his weapon on his own. The answer of the ex-commander surprised everyone: "I do not know."
- How is weapons are completed upon dismissal? - continued the lawyer. Delimkhanov replied that they were handed over to weapons, but he did not remember the details.
As for his kinship with Ruslan Geremeyev, deputy commander of the North battalion (originally suspected of involvement in the murder, but “not“ not found ”), Delimkhanov confirmed that this is his relative, but“ very distant ”.
- Who and when was he fired?
- I don’t remember the exact date ... I, at my own request or not, I don’t know.
“Do you know where he is now?”
- Not at all.
- As you received orders from the head of Chechnya, as the commander of the North battalion? - continued the lawyer.
- This does not apply to the subject of proof. The question is being removed, ”the judge suppressed the conversations about Kadyrov.
It is time for prosecutors.
- Tell me, is the procedure for serving weapons regulated by law? -Maria Semenenko was interested, still trying to find out this fundamental detail.
- That's for sure. The headquarters of the regiment is engaged in the receipt. Everything is spelled out in the charter.
- Does the soldier himself shoot the weapon?
- I'm not ready to answer this question.
- Do you know such cases?
- No.
The defenders of the defendants really wanted to stop interrogation as quickly as possible that it was striking, but could not do without their questions. Bakhaev’s lawyer - Zaurbek Sadakhanov - was interested in whether Delimkhanov knew who, where, when and under what circumstances he committed the murder of Nemtsov. "Not at all." The lawyer Tsakaev recalled that Ramzan Kadyrov called Dadaev the “patriot of Russia” and believed that he did not commit a murder.
- What do you think about this? He asked the witness.
- I agree with this statement.
Finally, Judge Yuri Zhitnikov himself asked Delimkhanov to talk about the procedure for serving service weapons.
- Well, there is a separate room, and there is a shooting in the presence of the head of the weapon service, in accordance with the order ...
The prosecutor Semenenko recalled that the prosecution sent a request addressed to the head of the Russian Federation Zolotov, where she asked to clarify the procedure for the delivery of weapons upon dismissal of a soldier. They decided to study the paper without jury. When they were returned to the hall, the prosecutor Semenenko reminded them that Dadaev returned to Grozny on March 1, 2015 to dismiss from the service. And he told the investigation that the traces of gunpowder remained precisely because of the independent shooting of a service weapon.
The response from the Russian Guard was signed by Viktor Zolotov Viktor Sergei Erygin and contradicted what was said. According to the document, upon dismissal, the service weapon is handed over to the warehouse, and the employee is issued to the invoice under the personal signature in the book of issuing weapons. From the warehouse, the weapon is written off by the military unit on duty. In the case of assignment of the machine gun by the employees, the division commander is engaged in writing off. Then the weapon should be assigned to another military. He shoots him. The document for the secondaryment of the employee is issued by the headquarters if there is a document on the delivery of weapons.
Lieutenant of the internal service Zaur Dadaev, said in the answer, was fired on February 28, 2015 from the service of his own free will. Since March 1, Dadaev was excluded from the lists of a military unit. The weapon assigned to it is a 9-mm pistol No. 1331im and cartridges (“five stores, 100 pieces”) were rented on January 27, 2015 at the artillery weapons warehouse of the military unit). On the same day, the gun was given to Major Abdulkadirov. The AK-47 assault rifle, assigned to Dadaev, was written off by the commander of the unit on March 2, 2015. The machine was fixed for another serviceman.
The weapon handed over to Dadaev was shot in a planned manner during 2015-the 9-mm pistol was shot on September 20, 2015; Kalashnikova automatic - October 4, 2015. The soldier himself, according to the response of the Russian Guard, has no right to shoot a weapon.
Semenenko asked Delimkhanova if he confirms all these provisions.
- I will neither confirm nor deny. I'm not familiar with.
- You can see the documents.
- Why?
The prosecutor was surprised, but did not insist and read out a fragment of the response from the Russian Guard about the Dadev report of February 28, 2015, which said that Delimkhanov held a conversation with Dadaev (the witness in court that he did not conduct), after which the commission was supported by the dismissal petition. By the way, it was Saturday. From January 27, 2015 to February 27, 2015, Dadaev was granted a vacation with a trip to Malgobek.
“Well, we remember where Dadaev turned out to be ...” the state prosecutor commented and turned to the witness:
- It is indicated that on December 23, 2014 you had a conversation with Dadaev.
“I don’t remember,” Delimkhanov answered and asked him to leave. But Semenenko had the last question:
-Have you ever been an eyewitness to shoot any serviceman with his own service weapons?
- Not ready to answer.
On that he was released.
