
The Human Rights Group "Agora" filed a complaint about the sentence in the second case of the Tver Blogger Andrei Bubeev, who was serving a term of 2 years 3 months for publication on VKontakte. This was reported by "Kommersant" with reference to the lawyer "Agora" Damir Gainutdinov.
The publication does not specify in violation of which articles of the European Convention, human rights activists accuse Russia. As you can conclude based on the text of the note, we are talking about Article 10 (freedom of expression) and, possibly, 5 (the right to freedom and personal integrity).
Blogger’s publications, Gainutdinov noted, "were based on criticizing the foreign policy of the Russian Federation in relation to an independent state of Ukraine, which is quite acceptable for citizens." The lawyer emphasized that neither the FSB who conducted the investigation, neither the prosecutor’s office, nor the court brought a single argument testifying to the "urgent public need" to limit Bubeev’s right to expression of his opinion.
The note "Kommersant" is also first reported that the Tver "cyberjyne" was involved in the pursuit of Bubeev, acting under the auspices of the safe Internet league. The leader of the Tver Cyberdrine, Grigory Pashchenko, told the publication: "We watched Bubeev for a long time. We believe that he was really involved in extremist activities - simply not all information is disclosed publicly."
Previously, it was only known that the denunciation, after which the first case was discovered against Bubeev in early 2015, was filed by a certain supporter of Russian aggression in Ukraine, with whom the blogger entered into a social network.
The first Babeev case was investigated in part 1 of Article 282 (excitement of hatred or enmity) and part 1 of Article 222 of the Criminal Code (illegal storage of ammunition). Blogger was charged with reposts on a personal VK page of a number of publications. Among them were the video “Tanks and armored vehicles of the Russian Federation, a large column of a fascist aggressor on the border with Ukraine. 01/20/2015”, a photo of a cemetery with the text about mass burials of militants in eastern Ukraine, a note by the blogger Andrei Shipilov about anti -Ukrainian moods in Russia, and a knife instructions. Bubeev did not accompany his reposts with any comments.
In addition, the blogger was charged with the storage of 56 combat cartridges prohibited for civil circulation. As the accused later explained, he found cartridges in an abandoned military unit and took with him, as they approached his hunting carbine.
On May 24, 2015, Bubeev was detained. He was sent to the Tver SIZO-1. In the investigation in the first case, the Politzek fully pleaded guilty and went to the pre -trial agreement. On August 28, 2015, the judge of the Zavolzhsky district court of Tver Stanislav Strusovsky sentenced the blogger to the year of the colony-settlement.
The objects in respect of which Bubeev aroused hatred and enmity in the verdict Russian, as well as social groups such as “citizens of the Russian Federation” as a whole, “citizens of the Russian Federation supporting the President of the Russian Federation”, “law enforcement officers” and “Russians experiencing patriotic feelings”.
The second case against Bubeev was brought up almost immediately after the first sentence. Then the Politzeck was placed in the special block of the pre -trial detention center, where he spent almost a year - he was returned to the general corps only shortly before the stage to the colony.
The second case was qualified under part 2 of article 280 (public calls for extremism via the Internet) and part 2 of Article 280.1 of the Criminal Code (public calls for separatism via the Internet). Extremism Bubeev was charged with the publication of the poster of Antona Myrzin (Paperdaemon Changnostic) "Squeeze Russia!" , and calls for separatism - for the repost of the article by Boris Stomakhin "Crimea - this is Ukraine!" (In the current publication of Kommersant, this article is called the "text of an unknown author").
This time the blogger did not admit guilt, saying that he was persecuted for beliefs. The defense of the political prisoner was engaged in the lawyer of Agora Svetlana Sidorkina.
The verdict in the second case of Bubeev was issued on May 5, 2016 , the judge of the Zavolzhsky district court Alexei Rodionov . The total term - 2 years 3 months of the colony -settlement - was appointed taking into account the previously issued sentence in the first case. As an additional punishment, Rodionov imposed on a blogger a ban on using the Internet within a year after release.
On July 20, the Tver Regional Court confirmed the verdict to Politzeku .
In August 2016, Bubeev was taken to a section of the Liu-3 colony-settlement in the Bologovsky district of the Tver region . LIU -3 is a hospital for convicts suffering from tuberculosis. Bubeev, as far as is known, is healthy, but there are no separate colonies-settlements in the Tver region.
However, in December, the Bologovsky City Court, on the proposal of the Liu-3 administration , tightened the sentence to Bubeev , replacing him with a colony-settlement with a general regime colony. As it turned out, in almost a year, spent by Bubeev in the special block of the Tver pre -trial detention center, at least 62 violations were charged with far -fetched reasons. After arriving in Liu-3, Bubeev, as far as is known, was not subjected to any penalties, but then he was put in a schizo. Sending to the schizo, taking into account the penalties imposed on the political prisoner in Tver, and gave the colony administration a reason to declare him malicious violator of the regime and demand the tightening of the verdict to Bubeev.
A few days before the New Year, Bubeev was sent to IK-4 in Torzhka .
