The Prosecutor General's Office gave a negative response to the article about repeated violations at rallies

Experts from the Far Eastern Federal University (FEFU) and the Prosecutor General's Office sent negative reviews to the Constitutional Court regarding Article 212.1 of the Criminal Code regarding repeated violations at rallies. Kommersant is about this.

reports The review was requested by the Constitutional Court, which on January 24 will consider the complaint of Ildar Dadin, the first person convicted in Russia for repeated violations of the rules for holding public events. The article provides for punishment of up to five years in prison.

Deputy Prosecutor General Vladimir Malinovsky, in his response, agrees with Dadin’s position that a repeated violation of the law on rallies cannot in itself “be considered as a circumstance that increases the degree of danger of such actions to the level characteristic of crimes” and called for changing the legislation to eliminate uncertainty.

The Far Eastern Federal University noted that the article of the Criminal Code violates the principle “no one should be punished twice for the same crime.” They emphasized that according to the sanctions, the article for repeated violations at rallies corresponds to certain types of murder, which is disproportionate to the public danger. Both reviews also criticize the footnote to the article, which states that a repeated violation is considered if the accused has previously been brought to administrative responsibility more than twice within 180 days.
