The Constitutional Court will decide whether it is possible to detain single picketers

The Constitutional Court, following a complaint from citizen Vladimir Sergienko, will decide whether police officers can detain a participant in a solitary picket in order to protect the activist himself. Similar provisions are contained in the federal law "On Police". This is reported by "Echo of Moscow" with reference to the official website of the Constitutional Court.

The complainant asks to recognize the provisions of the law, the interpretation of which allows the police to detain a participant in an agreed public event only on the basis of preventing an attack on him, as unconstitutional.

In 2015, Sergienko held a one-man picket in Belgorod, during which he was detained and taken to the police station, where he stayed for about an hour. Sergienko appealed to the court, but he was denied the recognition of the termination of the solo picket as illegal.

The court proceeded from the fact that Sergienko

was taken to the police department in order to prevent a conflict, the threat of which was real, based on the slogan, the meaning of which is dissatisfaction on the part of the plaintiff with the actions of the authorities.
