
The Kiev District Court of Simferopol, controlled by Russia, extended the arrest of the Ukrainian saboteur Redvan Suleimanov until February 28. This was announced on his FB page, journalist Anton Naumluk.
Since Politsek’s lawyer Emil Kurbedinovwas arrested on January 26 for 10 days according to the fabricated CPE to the demonstration of extremist symbols, the hearing on Friday was held with the participation of the defender for their intended purpose.
Other details of the proceedings are unknown. Meanwhile, in connection with the message of Naumlyuk, questions arise. First of all, the FSB petition for the extension of Suleimanov arrest was already considered in the Kiev district court on January 25, but then it was rejected . On what basis was the hearing were held again, it is incomprehensible. Naumlyuk suggested that the Supreme Court of the annexed Crimea per day after refusing to extend the arrest could consider the appeal of the investigation or prosecutor’s office to this decision, cancel it and return the materials for a new consideration to the first instance.
Moreover, it is not clear why Suleimanov generally extended the arrest. As far as it is known, Politzeku is charged with part 2 of Article 207 of the Russian Criminal Code (knowingly false message about the terrorist attack with causing major damage), which provides for up to five years of the colony. Thus, he is accused of a crime of medium severity. According to Part 2 of Article 109 of the Russian Code of Criminal Procedure (terms of detention), which are imputed by such crimes, in no case can be in jail for more than six months. Meanwhile, six months since the detention of Suleimanov expire on January 30 - before that the deadline was before the New Year and extended his arrest .
The only possible explanation of the decision made is that on Friday another document was considered - not the application of the investigation, already rejected on the 25th, but the request of the prosecutor’s office, filed in the manner of part 8.1 of Article 109 of the Russian Code of Criminal Procedure. This norm, included in the Code in 2012, allows the extension of the arrest for up to 30 days over the maximum six months, if the investigation is preparing a case for transfer to court.
Suleimanov is 27 years old. According to his parents, he was a Ukrainian military and served in the unit in the village of Perevalnaya Simferopolsky district of Crimea, and after the annexation of the peninsula refused to take the Russian oath, went to the continent and settled in Zaporozhye. This was confirmed by Kurbedinov. According to the lawyer, his client "did not give up for more than 20 days in one of the besieged Ukrainian military units in Crimea in 2014."
After the annexation of Crimea, Suleimanov lived in Zaporozhye, but periodically came to the peninsula to visit his parents. On July 30, he was detained at the Simferopol airport, and on August 12, the FSB extended his testimony with recognition in involvement in the preparation of terrorist attacks.
According to Suleimanov, he, on the instructions of the GUR of Ukraine, was looking for places for sabotage and left false messages about mining to follow the actions of the Russian security forces. It was reported that he called the police and included an entry with a threat to blow up the airport and the Central bus station of Simferopol, as well as objects in other cities.
Moreover, he did not mention interaction with the "group of Evgeny Panov - Andrei Zakhteya."
Soon, however, it turned out that Suleimanov called his place of residence a non -existent address - Zaporozhye, Cosmic Street, 168. The last number of the house on the even side of Cosmic Street - 132nd.
On August 25, it became known that Suleimanov had received 15 days in administrative before the arrest in the criminal case - about petty hooliganism (Article 20.1 of the Russian Administrative Code). It was claimed that the FSB detained the Crimean Tatar only after the departure of this period. It is known that in early August we acted in the same way with Panov and Zakhte: they were also placed under administrative arrest at first, and then they were detained in a criminal case.
After the arrest of Suleimanov, the security forces searched the house of his parents, and the owners themselves interrogated. In August, it was reported that Politzeku was charged with aiding participants in illegal armed formation and assistance to saboteurs. Meanwhile, relatives said that initially Suleimanov was charged with part 1 of Article 207 (knowingly false report about the terrorist attack), whose sanction is up to three years of colony, and then the accusation was tightened, adding a qualifying attribute “causing major damage”.
In December, it became known that the damage allegedly caused by Suleimanov in Russia, including the FSB, is estimated in the amount of over 4 million rubles.
Cases under Part 1 of Article 207 of the Code in accordance with Articles 150 (forms of preliminary investigation) and 151 of the Russian Code of Criminal Procedure (defense) are in the production of the police, and the investigation is carried out in the form of inquiry. Meanwhile, cases under Part 2 of Article 207 already imply a investigation, and both the police and the "bodies that revealed these crimes" can investigate them. It can be assumed that the re -qualification of the case was required precisely to transfer it to the production of the FSB.
It was also reported that the investigation continued to “tie” Suleimanov to the “group of Panov -Zakhteya”. However, the Crimean Tatar did not become a defendant in this case - it was obvious, so he was not in October to Lefortovo, unlike two other "saboteurs", but remained in the Simferopol SIZO -1.
In August, the media wrote that nine people were detained in the case of Ukrainian saboteurs. All of them were not named by name. Only four names are known. In addition to Suleimanov, Panov and Zakhteya, this is a trucker from Kharkov Vladimir Zasich. What is charged with him and where he is located is unknown.
