An ordinary Chechen Soviet family: Father Ainda Shamayev - a driver in the Tashkalinsky technological transport department, mother, Dasha Shamaeva - a housewife. None of the Sechen War none of the Shamaevs participated in the first or the Second Chechen war, but they held all the 1990s in Chechnya: the first war in their native village of Shatu, which is 50 km from Grozny, the second-in the center of the Chechen capital. “They lived in the basement, shells flew over us, the glory of Allah, none of us were starving, but we had to go for a few kilometers for water and flour,” recalls Adlan Shamaev. The father was discovered in the liver cirrhosis, he was lying in the hospital for a long time, but when in 1999 the city began to bomb again, he had to take him home, his condition worsened, and he quickly died at the 52nd year of his life. Dasha was left alone with four sons to feed the family, worked on the market - she traded perfumes.

According to the Shamaevs, none of them was fond of radical currents in Islam, registered in the organs, which did not save them from the attention of the special services. On July 25, 2008, 23-year-old Alvi Shamaev returned home from the construction site, where he worked, an unknown person called him and offered to meet-about the shabashka. Alvi came to the appointed place, but instead of a potential employer, two men approached him, twisted him and stuffed him into the trunk of a passenger car.

In the direction of the movement of Alvi, he realized that he was being taken to the territorial branch of the police (volume) of the 36th section. “There they put on my head a bag or T -shirt and immediately lowered it into the basement, in a raw, dirty room with a large iron door,” Alvi says. “They knelt down to the wall and began to beat me, brought the old telephone, they tried the wires, tortured electricity, they handed over their hands with handcuffs, put it into Scorpio pants, threatened to crush it with a boot - all this way. According to Alvi, he was first asked about some materials stolen at a construction site, then about acquaintance with people unknown to him, after they began to force him to admit the undermining of the not territory of Chechnya. He was recorded in the accomplices, an unfamiliar 19-year-old Ibrahim Zelimkhanov, who was also tortured: “He was burned with a light finger to the bone in front of my eyes,” Alvi says.

The young people refused to recognize in the blow, then the operatives drew up a protocol on the seizure of a pistol: under the torture of Zelimkhanov “confessed” that the gun belonged to him, but that he received it from Shamaev, there were no fingerprints on the pistol, only the testimony of the accused.

Shamaev’s relatives all this time searched for him, even came to the 36th section, but Alvi learned about the whereabouts of Alvi only on July 30, when the operape, headed by the investigator Zhamalayi Dzakaev, came to the searches of Shamaev’s apartment. “They didn’t find anything,” says Alvi Zarem Shamayev’s wife. “Everyone went out into the corridor, and the investigator said that he had to check again, went into the kitchen without witnesses, and a minute later he screams:“ Understood, go here. ”They start witnesses, and under the sink he finds a black folded bag with two grenades, an electric detonator, and we have only understood from our neighbors, they say, we just say. What they looked, there was nothing, why are you doing this?

On the same day, Shamayev and Zelimkhanov were transported to the IVS of the Staropromyslovsky District Department of Internal Affairs, where they began to torture, beat them, threatened to shoot his knee. According to Alvi Shamayev, the then head of the criminal police, Ruslan Gelaev, was engaged in this personally. For two weeks, the lawyer did not allow Alvi: “They couldn’t show me, I was bruised, but I still told the lawyer everything, but they began to torture me even more, they said why you laid out everything? Through the lawyer we achieved medical examination, but the doctors did not see bruises, nor abrasions, no burns from wires on the fingers.”

The transaction with the investigation

During the month of active interrogations, Shamaev and Zelimkhanov admitted everything: “I had to sign the grenades that they threw, I had to sign this gun, undermining some UAZ or an armored personnel carrier, some other shooting and attempt on some kind of district police officer,” says Alvi. There was no evidence on any point, as a result, only the storage of weapons and aiding by illegal armed formations remained in the case. According to Alvi, his lawyer assured that she could have achieved a complete excuse, but advised me to take at least something, otherwise the investigators "would be very evil and they would not be so simply lag." On October 23, 2008, the court sentenced Shamayev and Zelimkhanov to 2.5 years in the colony.

In January 2011, Shamaev freed himself, found a job, but already in the fall, the special services came to him: “I was with my family in the zoo, they called me, they told me to drive up to one restaurant in the center of Grozny,” says Alvi. “And there it was impossible to ask for what reason: if they called, I had to go. There was the head of the search department named Hussein, Ramzan from the name of Husein. The Staropromyslovsky District Department of Internal Affairs, which tortured me in 2008, is a certain Muslim from the new special bands of the Terek. They took the passport from Shamayev, gave him a car and a mobile phone and asked to go to a certain Magomed Yidigov, with whom he was sitting in the zone - to find out what he lives. Alvi agreed. In the fall of 2012, Alvi Dali was the second task: in any way to convey to Yidigov the weapon: “They say to me:-Put on a pity, say that after the release you were tortured, beat your brother that your brother was detained, that you want to take revenge. Tell me that you have a weapon, make him just picked up,” recalls Alvi Shamayev. - I took this car, a full trunk of weapons: machine guns, hand grenade launchers, pistols, cartridges. "But Shamaev could not substitute Yidigov:" He was removed half of the stomach before landing, he was thin, exhausted, completely sick. "Shamaev admitted why he arrived, and the operatives said that the weapons could not be transferred.

A few days later, Alvi left his parents a mobile phone issued by the police, said goodbye to his family and left first from Chechnya, and then from Russia - illegally crossed the border for 2500 euros. "It was a person who is engaged in the transportation of people. I had no documents, only a driver’s license. We drove in a passenger car, moved at night. They drove along the mountains, then there was some big checkpoint." Five days after leaving Chechnya, Shamaev was in German Karlsruhe. In his homeland he was put on the federal wanted list.

In a refugee camp, Alvi met a certain Temirlan, who recognized him from a video with a scorpion in his pants. Police officers began to come to the Shamayev family, to call his wife for interrogations, to threaten that the children would be taken away. “I made certificates about this Temirlan and found out that he himself was a former employee, and maybe he still works, and his brother serves in Kadyrov’s guard,” says Alvi, who decided to take his family at the same time. Zarem Shamayeva began to draw up a passport for herself and for four children, however, when on March 5, 2013 she went to pick them up, at the exit from the UFMS in the 6th microdistrict of the Terrible, she fell under the raid: she was taken away by her passports: “At that time there was a large stream of refugees from Chechnya, everyone made foreign passports, visas, and they simply took away so that people did not leave,” explains Alvi. As a result, Shamayev had to sell an apartment in Grozny to take Zarem and children in the same illegally - 2500 euros per soul.

Morality with a gun

When Alvi had already freed himself, but had not yet left for Germany, his younger brother Albert, who worked as a manager in the Grozny Investigative Committee, came to the security forces. A certain Chechen girl worked with him, who, according to Albert, had an affair with the deputy head of the 1st department of the Investigative Department of the SK in Chechnya Andrei Karlyevov. According to Albert, a colleague behaved unworthy, he threatened to tell her parents about her connection. “She complained to her lover, and after a while Albert is taken away after work, put them in the car and taken away in an unknown direction. They beat him all night, torture, but he doesn’t tell anyone about it. It was at the end of 2011,” recalls Alvi Shamaev. Without saying a word to the relatives, Albert decides to take revenge on Karlyeova, takes out a gun and on January 14, 2012, together with his friend Rasul Gapuraev, sheshes the head of the deputy chief, as a result of which he easily wounds his driver. The next day he disappears, relatives begin to look for him, turn to the police, and then to the UK. “In the UK, they took a statement from me, broke it, threw it away and say:“ You will go with us. ”“ What reason? ”“ We will come, find out, ”says Alvi Shamaev.“ They took my phone, passport from me and took the police department in the Staropromyslovsky district, I again got on the ramzan who tried me in 2008. I put me in some room. They began to insult, demand that I signed the fact that I was awarded to Albert, the organizer of the attempt, that I gave him a weapon.

Shamaev and Gapuraev was detained in the Kaluga region at the end of May. The Shamaevs went to Kaluga, but it was not possible to get a date, only a month later his mother was able to meet with him. According to Dasha Shamaeva, Albert told her that the Chechen security officials came to the Kaluga pre -trial detention center, who beat him, threatening that if the girl’s name or the cause of the conflict with Karlyov will become famous, "they would rape him and kill his brothers." He, however, was not going to call the girl’s name, so that her life was not dangerous.

Alberte is transferred to Chechnya, where the investigation begins. The attempt on an employee of the UK is added to the illegal armed gang and attack on one of the checkpoint in Grozny in December 2011, and in addition to Shamayev and Gapuraev, three other people appear, with whom, according to Shamaev, he was not familiar. In terms of organizing the group and the attack on the checkpoint, the evidence base is again built only on the confessions of the accused, as well as in the words of a certain witness Gamargaev, who suddenly appeared in the case almost a year after the attack, but did not appear at all: he was supposedly next to the checkpoint during the attack and remembered the number of the car from which they fired at the post.

At the trial, Shamaev assures that he did not take part in the attack on the checkpoint, he was not in any gang, and the head of the UK fired "on emotions" due to his personal conflict, but was not going to kill him. He even asks to call for an interrogation a colleague, which he considers the cause of the conflict, but the court refuses him and on July 31, 2013 says to 14 years of strict regime for all the articles indicated in the charges.

In prison without legs

He was suspended by his legs and beaten for several days, after which he lost his vision for a month, for a month he could not walk

On the verdict of the misadventures of Shamaev did not end. In December 2013, he was transferred to Irkutsk, where, according to him, the Chechen security officials again visited him. “In pre -trial detention center No. 1 of Irkutsk, he was hung by his legs and beat him for several days, after which he lost his eyesight for a month, could not walk for a month,” says Albert Adlan Shamayev’s elder brother. “All this time they kept him in a solitary confinement and they didn’t let anyone in, the lawyer was carried out by the paper allegedly signed, that he did not want to communicate with a lawyer or with human rights activists or with his human rights activists or with relatives ".

In May, Shamaev enters IK-19, where his health deteriorates sharply. He complains that his leg and hand are numb, that it is difficult for him to walk, that, although his eyesight returned, but not completely. In August 2015, he was removed by the inguinal hernia, and, fearing that they can put him to sleep, Shamaev insists that the operation is undergoing local anesthesia. Since January 2016, he cannot go, but the prison doctors do not see serious pathologies, moreover, they transferred the shamaev regime to the EPCT regime ( a single room of the chamber type-with more rigid conditions of detention.-approx. ), And then to a schizo ( penalty area.-approx.) . In single cameras, the bed is not worth it, as in common huts, but fasten for a day to the wall, so, according to Nadezhda Skomarovskaya, who visited his lawyer, Shamaev is forced to sit on a stone floor and cannot use the toilet without exertiveness. “He has legs to the knees of purple color. According to her, not trusting the prison doctors, Shamaev repeatedly asked to examine him in a civilian hospital, but he never received permission for this. The situation is aggravated by the fact that in November 2016, protesting against refusing to date with relatives, Shamaev announces a hunger strike, which ends in a coma.

Albert Shamaev and his parents say: health problems began a long time ago. According to the certificates presented by the Shamayevs (at the disposal of the RS), as a child, Albert was diagnosed with cerebral palsy and epilepsy with rare paroxysmisms, he was recognized as disabled childhood, but after reaching the age of 18 he did not confirm the disability: “He had no growth until 14 years old, he walked as if the arm and head were constantly ill,” says his mother Dush - for several years we went to the hospitals, then he began to grow up, that he was disabled at the school, and asked not to do disabilities, he said that he could neither work. However, certificates of childhood diseases were not borrowed to the case, and they are methodically refused to disability to Albert’s disability, they refuse to provide chairs.

Radio Liberty got acquainted with the medical card of Albert Shamaev and with the conclusion of the consultation of doctors of the Federal Penitentiary Service of the Federal Penitentiary Service in Angarsk. The patient underwent a fairly wide examination with MRI, electroencephalogram, computed tomography of all spine departments, inspection of a neurologist and neurosurgeon. The diagnosis is osteochondrosis, protrusion, hernia of the intervertebral discs, as well as stenosis, which can cause impaired sensitivity and restriction of movements in the lower extremities. The doctors did not find congenital disorders that could confirm cerebral palsy or epilepsy, but the prison psychiatrists diagnosed their diagnosis: "demonstrative-step-by-step behavior. Simulation of a paralytic disease."

At first glance, there is nothing terrible in the results of research, but, according to Olga Gnezdilova, the legal director of the NPO “Legal Initiative”, which is going to file a complaint to the ECHR on behalf of Shamayev, the colony sent an incomplete set of documents, moreover, half of them are not read: “We would like to send the results for an independent examination, but we can’t do it, we did not know, for example, if those were given to him by those those who were given to him by those The medicines that are registered there because there is no card of the issuance of drugs, - explains Gnezdilova.

As a result of the endless complaints of Albert himself, human rights activists and lawyer, in December, Shamaev conducted another medical and social examination, which once again diagnosed "demonstrative and flushing behavior." Based on this conclusion, the prison psychiatrist invited him to undergo a new inpatient examination, however, again in the Federal Penitentiary Service of the Federal Penitentiary Service. Today, Albert Shamaeva is only 28 years old, he should go out at 39, the question is - will he live?
