
The European Court of Human Rights satisfied the seven complaints of the leader of the Party of Progress Alexei Navalny of detention, fines and administrative arrests from 2011 to 2014, deciding to pay a policy of 63.7 thousand euros of compensation. According to the court’s website, 50 thousand euros Navalny were awarded as compensation for non -pecuniary damage, about a thousand euros for material damage, almost 12.7 thousand euros for legal costs.
The first complaint was filed on May 14, 2012 and concerned the events of May 9 of the same year, when Navalny and several dozen people were in the square on Barrikadnaya as part of a meeting with the State Duma deputy Dmitry Gudkov. Neither the applicant nor other citizens overlap the roadway, they did not make noise, did not interfere with the passage of other citizens, they did not have banners and sound amplifying equipment. After the detention, the court found Navalny guilty of "disobedience to the legal order of a police officer, imposing a sentence of 15 days of administrative arrest.
The second complaint was filed on May 28, 2012 and concerned the events of March 5, when a rally was held in the center of Moscow, on Pushkinskaya Square, a rally against falsification in the presidential election under the slogan "For Honest Elections". Then several dozen people were detained, including Navalny.
Two complaints filed on November 30, 2012 concerned the events of May 8. Navalny on this day was detained about six in the morning with other people in the center of Moscow. The police, for no explanation of the reasons, increased politics to the car carrier, and then delivered him to the police station. On the same day, about 23 hours of Navalny were again detained.

On February 24, 2014, Navalny came to the Zamoskvoretsky district court of the city of Moscow to support the pursued in the swamp business. Navalny could not go to the court building, so he stayed on the street, but was detained without warning, taken to the police station and search. Then he was taken to court, after which he was released.
In the evening of the same day, Navalny took part in the spontaneous assembly, which occurred after the announcement of the conviction. He was detained on Tverskaya Street when he stood peacefully on the sidewalk, talking with a journalist. Subsequently, Navalny was sentenced to 7 days of arrest .
The ECHR recognized all the applicant’s complaints justified, having established that in seven cases, the rights of Navalny to freedom of assembly and to personal integrity were violated, in six cases - the right to a fair court. The court found that the detention and arrest of Navalny had a “discouraging effect” for him and other participants in the protest rallies, keeping them from participation in opposition policy.
In this regard, the SU decided that the question of the presence of violations of Article 14 (discrimination) and Article 18 of the Convention (Political Personal) does not need to be studied, since violations of articles 5 (arbitrary arrest) and 11 (freedom of assembly) have already been established.
Judges Lopez Herra, Keller and Pastor Vilanov made a special opinion, indicating that the violation of Article 18 of the Convention was of independent significance, and Navalny presented convincing evidence of Article 18 of the Convention prohibiting political persecution.
Judge Keller also indicated in his special opinion that in similar cases the court awarded compensation for non -pecuniary damage of 25,000 euros per episode of the violation, and in Navalny awarded only 50,000 for seven episodes. According to the judge, compensation for non -pecuniary damage to Navalny could be more than three times more.
"The false, corrupt and hypocritical judicial system of the Russian Federation is sunk," Navalny answered the court decision. "Russia, in fact, should not reform the judicial system, but create it. What is now - an abomination based on telephone and bribes. No one can achieve justice in these" courts. "No reform will not go until there are no vessels," the politician summed up.
