
The ex-director of the Moscow library of Ukrainian literature Natalya Sharina, against whom the case of extremism and embezzlement filed a complaint about unreasonable criminal prosecution and house arrest conditions. This was reported by Interfax with reference to the lawyer of the accused Ivan Pavlov and the lawyer Alexander Poppy, who participated in the preparation of the complaint.
Russia is accused of violating several articles of the European Convention at once. What specific norms are meant, the agency does not specify. Definitely from the publication we can only conclude that one of these norms is Article 8 of the Convention (the right to respect private and family life).
Violation of Article 8 was expressed, in particular, in the complete ban on the ball of walks, which operated for almost a year, before the start of the trial. “Lack of walks is poorly affected by my client’s health,” Pavlov remarked. “Even on New Year's Eve, the investigator did not allow her to go outside. But even in jail, prisoners were allowed walks and correspondence.”
On October 28, 2015 , searches were held in the library of Ukrainian literature and in Sharina’s apartment . The only prohibited publication, which, according to the Investigative Committee, was seized in the library, was the book of Dmitry Korchinsky, Vyne in Tagnpі ("War in the crowd", 1999), which was recognized as extremist in March 2013. At the same time, the library employees argued that there were no this book in the funds - it was precisely by law enforcement officers to be thrown into the library.
Visiters did not find any other forbidden literature. Books about Stepan Bandera, OUN and UPA were withdrawn, although none of these books are listed in the list of extremist materials. The investigators also seized the Barvinov children's journal, stating that it depicts the flag of the Right Sector.
Paragraph 2 of Article 282 of the Criminal Code (excitement of hatred or enmity using an official position) was charged with the ball, which in the editorial office in force at that time provided for up to five years of the colony. The Tagansky district court of Moscow sent the librarian under house arrest.
The investigation was conducted by the department of the capital's head of the Investigative Committee for the investigation of especially important cases. On April 5, 2016, Sharina was charged with another charge - in part 4 of Article 160 of the Criminal Code (embezzlement on an especially large scale), the sanction of which is up to 10 years of the colony. The department said that in 2011-2013, when the ball was persecuted in the previous case, she spent on her protection the funds intended for the payment of salaries to the library lawyers.
Pavlov regarded this accusation as absurd. In 2013, he remarked, this case against the ball was closed behind the lack of corpus delicti, and the library lawyers did not have a lawyer status and therefore could not protect the ball on their own - it was the lawyer who paid for the accused, whose services she paid from her own funds. The excitement of a new case, Pavlov concluded, was required in order to continue to extend the rising period of house arrest: on charges of extremism, she could not appoint this preventive measure for more than six months, while the accusation of embezzlement allows.
On May 26, it became known that Evgeny Tarasov, the factory department of the RAS Language Institute, conducting an examination in the Sharina case, saw signs of extremism in almost all the analyzed publications, including the Barvin magazine.
The Moscow prosecutor's office approved the indictment only the second time . At the same time, the shortcomings of which the document was returned to the TFR after the first familiarization with the case, the investigation was essentially not eliminated.
On October 21, 2016, the judge of the Meshchansky District Court of Moscow Elena Gudoshnikova held preliminary hearings in the case of Sharina. The proceedings on the merits lasted from November 2 . The accusation in the process is supported by the prosecutor of Balandin.
Sharina insists on her innocence. “I understand the accusation of article 160, but I don’t admit the blame,” she remarked Gudoshnikova after the Balandin announced the indictment. “And under Article 282 it is not clear at all, what actions I performed specifically.”
