All five - Alexander Bagaev, Denis Devyatov, Denis Sheshukov, Sergei Mezhutkov and Valentin Kolpakov - were tried under points “a” and “b” of Part 3 of Article 286 of the Criminal Code (exceeding official authority with the use of violence and weapons).
Initially, in November 2015, the Shadrinsky District Court found all five guilty and sentenced each to four years in prison. Three months later, the Kurgan Regional Court overturned this sentence.
In November 2016, the same Shadrinsky district court issued an acquittal; the state prosecution unsuccessfully tried to appeal it: the court decided that there were contradictions in the victim’s testimony, and there was not enough evidence to find the police guilty.
“The victim claimed that his delivery to the internal affairs department and detention was illegal; a special means was used against him - handcuffs, physical violence and the threat of violence,” recalls the regional court.
As Znak.com wrote , the defense linked the initiation of a criminal case to the fact that the police had previously participated in criminal cases against members of a local criminal group called the Nikitin Brothers.
