The court in Voronezh terminated administrative proceedings for coordinated rallies

On February 8, the Central District Court of Voronezh terminated administrative proceedings against activist Alexander Boldyrev, against whom the police filed two protocols for violating the rules for holding rallies (part 1 of article 20.2 of the Code of Administrative Offenses) by the organizer - against the war in Syria and for the abolition of direct elections of the mayor. This was reported to OVD-Info by Vladislav Khodakovsky.

The court found that the rallies were coordinated, the photocopies of the photographs attached by the police to the case had no dates, the filming location was not established, and the protocols were drawn up with errors, therefore there is no evidence of Boldyrev's guilty actions. Remarkably, in the ruling, the court also referred to Article 31 of the Constitution of the Russian Federation (“Citizens of the Russian Federation have the right to assemble peacefully without weapons, to hold meetings, rallies and demonstrations, processions and picketing”), Article 11 of the Convention for the Protection of Human Rights and Fundamental Freedoms (freedom assemblies and associations) and precedent decisions of the ECtHR.
