
The European Court of Human Rights ordered Russia until February 27 to give an answer on a complaint to the defense of Ildar Danin to illegally retain him in the Altai colony. This was stated by one of the lawyers of the political prisoner Ksenia Kostomina, TASS reports .
“We just received an answer from the ECHR that our complaint was accepted, and that the court ordered Russia to give an answer on this complaint no later than the future Monday, that is, February 27,” Kostromina said. According to her, the lawyers sent a telegram to the Prosecutor General’s Office, the FSIN, as well as the ECHR for urgent consideration, in which they ask to deal with the situation, and "why Ildar still has not been released from the colony."
Meanwhile, the chairman of the Public Supervisory Commission for the Altai Territory Alexei Belous, who visited the IK-5, said that Dadina would be released only after receiving the official text of the decision of the Supreme Court. “Because there was an explanation of the Deputy Chairman of the Supreme Court, which states that due to the fact that there was a fake of decisions of the aircraft, the Federal Penitentiary Service should be guided in his actions only by official documents submitted by the Feldyger or special service,” Belous explained. The head of the PMC noted that according to available information, the document was sent from Moscow on February 22. However, there is no information where the paper is currently located.
Belous, referring to Dadin himself, said that the political prisoner was alone in the video between the Supreme Court. The FSIN employees "went to meet him" and left the premises, so they did not hear the solutions of the aircraft. As Belous suggested, this happened because Dadin himself did not expect the abolition of the sentence.
According to the members of the PMC, Dadin feels good. He recovered nine kilograms and is waiting for liberation. About IK-5 Dadin speaks well. According to him, the FSIN employees relate to the prisoners "with understanding."
Earlier, Deputy Director of the Federal Penitentiary Service Valery Maksimenko said that Dadina will be released immediately after receiving the document of the aircraft . On February 22, the Supreme Court decided to cancel the verdict to Politsyk , to release him from the colony and recognize the right to rehabilitation for him. According to the prosecutor Leonid Korzhinek, two administrative decisions imputed by Dadin did not enter into legal force at the time of the initiation of a criminal case, so it was impossible to start a matter. At the same time, Korzhinek emphasized that the Constitutional Court recognized the article under which Dadin was convicted, which did not contradict the Constitution.
The Prosecutor General’s Office also canceled the decision to refuse to institute criminal proceedings on the fact of torture Dadin in the colony. The case file is aimed at additional verification.
On February 10, the Constitutional Court published a decision with a request to revise the decisions in the Dadin case. The Constitutional Court indicated that the verdict to deprivation of liberty under the article imputed by Dadin is possible only if the actions that are incriminated to the accused, "entailed the loss of a peaceful public event, causing significant harm to constitutionally protected values." In this regard, the court ordered the State Duma to make appropriate adjustments to Article 212.1.
