In the Kemerovo State University, a scandal broke out. The university did not explain the contract with one of the teachers for a long time without explanation. Neither her appeal to the rector, nor a complaint of students, helped. In response, the senior teacher of the Institute of Philology, Foreign Languages and Media Communications, the candidate of sciences Nina Oblyunas filed a lawsuit. She says: “The story of my dismissal is not unique. The only difference is that I am the only one who talked about it aloud. ” Optimization, reorganization and enlargement go in universities throughout the country. So teachers inevitably turn out to be superfluous.

Lecturer at the Institute of Philology, Foreign Languages and Media Communications KemSU Nina Oblyunas filed a lawsuit on February 17. On March 9, the first meeting was scheduled for her case. She demands from the university to recognize her dismissal illegal, restore at work, return all hours of training load 2016-2017. And compensate for the days of forced absenteeism, as well as moral damage in the amount of 200 thousand rubles.
Nina Oblyunas is one of the few teachers who declared violation of their rights aloud and decided to fight what he considers illegal. And the story of her dismissal began in the fall of 2016.

“As a teacher, in connection with the end of the contract, I must go through the competition,” says Nina. - I had an employment contract until January 27, 2017. The competition for my place was announced in the summer of 2016, I appropriately submitted the necessary documents. ” The first stage of the competition - voting at the department - took place on November 24. “My candidacy was recommended for further passage on the competition, that is, they put forward to the Academic Council of our Institute of Philology, Foreign Languages and Media Communctions.”
At a meeting of the Academic Council of the Institute on December 27, Nina Oblyunas was not elected. The next day, the teacher wrote a statement addressed to the institute, demanding to cancel the decision, since a huge number of errors were made in the election procedure. The rector agreed with a statement.
In addition, at this stage it turned out that my documents were incorrectly executed: everything was clinging to the list of publications and a report on the work done. When I prepared a new one (in five years, and not three years), the scientific secretary of the Academic Council Kemgu refused to sign it. Although, as it turned out later, only my signature should be on this list, ”she says.And on January 18, a re-advice of the institute was held, where by a majority vote, Oblyunas was elected.
“But with one unexpected detail for which I was not ready: the Council issued a decision to recommend a contract with me until August 31, 2017. Despite the fact that the scientific council of the institute cannot at all recommend that the employer needs the term for which I need to choose - about this in the text of the Regulation on the procedure for replacing the positions of teachers related to the faculty, there is not a word, ”she says.
Nina refused to sign such an agreement. And in writing she explained her position to the employer by the fact that she did not receive notifications from the university about changing the terms of the contract two months before the expiration of the contract, which is provided for by Article 332 of the Labor Code, therefore she believed that the new employment contract, like the previous one, would be concluded for a period of three years. In addition, the “industry agreement on organizations under the jurisdiction of the Ministry of Education and Science of the Russian Federation, for 2015-2017” states that “if the scientific and pedagogical worker has successfully passed the competition, but in the future could not agree on an acceptable specific term of the employment contract, the employment contract with such a person is concluded for an indefinite term.”
The university considered: they are right, and the teacher, if he believes that her rights are violated, can go to court and the labor inspectorate.
At the same time, says Oblyunas, on January 26, a schedule for a new semester appeared on the site with its last name, and on February 2 it was changed: the teacher’s name disappeared from it. The second employment contract was also terminated with her, under which Oblunas is engaged in students of one of the schools. With the same wording: due to the expiration of the validity period.
“Although this period has not expired. Labor relations with the employer end only on May 31, ”she explains.
Students stood up for the teacher. They did not just write words of support in social networks and came to visit the teacher. Students tried to influence the situation. On February 8, they wrote a statement addressed to the rector with a request to return her classes in the schedule.

“On February 10, their meeting with the rector took place. Students said that the rector said: if the set does not take place next year, I may not have enough load, so I was obliged to sign the proposed employment contract, ”the teacher says.
Nina Oblyunas believes that the Labor Code guarantees her a certain minimum of rights, and the rector is not entitled to transfer the risks of her activities to her. “I think that this is largely due to my personal position: I have been standing across my throat for a long time,” she explains.
Nina Oblyunas at the institute is known as a defender of students' rights. In 2015, she wrote a statement to the city prosecutor’s office with a request to figure out whether the students were legitimately removed from her couples to listen to the budget message of the Governor of the Kemerovo Region Aman Tuleev.
“The prosecutor's office supported me. The law prohibits the conduct of campaigning at the territory of the educational institution. There are certain educational rules. Students were removed from a couple by force. In fact, they thwarted me, ”she explains her position.
A year later, in December 2016, students wrote a complaint to the rector of varnish work during classes by Nina Obelunas. “I signed this statement to them in confirmation that this fact had a place to be, and advised if they want to get an answer, take it to the reception of the rector, where they should register it,” the teacher says.

What happened at the meeting, Oblunas knows from the words of the students: “They were brought to the idea that I was to blame for the smell: I did not transfer students to another audience, and even forced to write a statement (or wrote it in general). Although I do not understand why the university’s leadership did not organize the transfer of steam, since it was aware that they would have repairs. The children were told that all the guilty persons would be a warning, and for Nina Vladimirovna, if she applies repressive measures to students, there is an article on which it can be dismissed. ”
And such an opportunity was found, says Oblyunas. Now she does not work at the university, she is waiting for an answer from the labor inspectorate and consideration of her case in court.
At the university itself, they did not comment on the situation, noting that "the dismissal and structure of the employee is his personal file." “Where a person works, where he is satisfied and why he leaves - all this is personal data. The law is forbidden to disclose this data, so you can find out all the information from Oblunas itself, after the decision of the labor inspectorate that she turned to, ”said Lolit Ionova, head of the personnel department.
The fact that the university needs to dismiss employees is another side. The roadmap in the field of education, adopted in 2014, provides for a reduction in the number of teachers. By 2018, there should be 12 students per teacher, while in 2013 there were 10.2 students. And the number of students in the country's universities in the same five years will decrease from 5.6 million to 4.1 million people.
The Institute of Philology, Foreign Languages and Media Communications appeared in KemSU since this school year. He was formed by the association of two faculties: philology and journalism and the faculty of Romano-German philology.
“This year there will be 10 budget places in journalism, 13 on philology. Although four years ago, philologists had 40 budget places. For journalism, we calmly recruit a group of students of 20-25 people. But there is a different situation on philology. It is even more difficult for them to gain students on extra -budget, ”says Oblyunas.
In a situation of reducing the contingent, the reduction of teaching rates is inevitable.
If you need to officially reduce the faculty, then you need to do this according to the procedure provided for by law: with mandatory notification in two months and subsequent compensation. For the university, these are serious costs, ”says Nina Oblyunas.According to TV2, similar stories with the dismissal of teachers take place in Tomsk universities.
According to Tomskstat, only from 2010 to 2015 the number of university students from 81.9 thousand decreased to 63.5 thousand people. And the release of students decreased from 17.6 thousand to 13.8 thousand people.
Another circumstance is superimposed on the reduction of the contingent. According to the May decrees of the President, signed in 2012, by 2018 the average salary of university teachers and researchers should be twice as much as the average salary in the region. According to official statistics, for 9 months of 2016, the salary of Tomsk teachers developed at the level of 61.5 thousand rubles. At the level of average salary in the region - 35.3 thousand rubles. Often to achieve the necessary indicators, universities reduce some teachers and increase the load on others.
