Bolotnik Buchenkov was transferred under house arrest

The Moscow City Court translated the person involved in the swamp business Dmitry Buchenkov from the pre -trial detention center under house arrest. This was announced at his FB page by the lawyer of the accused Ilya Novikov.

House arrest was scheduled for a period until May 6. As the New Gazeta reports , Bushenkov will serve him in his apartment in the city of Aprilovka, Naro-Fominsky district of the Moscow Region.

The decision was made when considering the request of the investigator of the Investigative Committee of Dmitry Gorelov on the extension of the Politzke period of the term of maintenance in the metropolitan pre-trial detention center "Vodnik". The hearings took two meetings. On February 27, as reported by journalist Dmitry Borko, Novikov said a discharge to Judge Sergey Gruzdev on the grounds that he had previously extended the arrest, and the arguments presented by the investigation in favor of the further maintenance of Politzec in the pre -trial detention center remained the same.

The judge rejected and postponed the hearing, referring to the fact that Novikov, recently entered the case, had not yet familiarized himself with the materials. At the same time, the lawyer himself indicated that he had already studied the case completely.

Meanwhile, the meeting on Thursday was held by another judge. As it turned out, the replacement was made according to the resolution of the chairman of the court Olga Egorova. Novikov explained the replacement that he studied at the Russian Academy of Justice on the same course with Gruzdev, "and according to the concepts of the judicial system, this is already a compromising relationship."

What the new judge motivated the decision to mitigate the marsh of the preventive measure, the media has not yet been specified.

Meanwhile, the escorts, despite the court ruling, did not free Buchenkov. According to Novikov, they demanded from the investigator Gorelov a receipt that he was taking the accused under guard. Gorelov refused to give such a receipt. As a result, Novikov himself gave it, and the investigator set the resolution "I do not mind." However, the escorts also stated that they needed the text of the resolution with a round seal. Meanwhile, the judge who made the decision went to the meeting, and in his absence they refuse to put the seal. “Before the end of the court’s work, an hour, then the released Buchenkov can take the night back to the pre -trial detention center,” the lawyer noted. Another lawyer of Politzek, Svetlana Sidorkina, sent a telegram to the Vodnik pre -trial detention center with a complaint about the inaction of the escort.

The 38-year-old associate professor of political science and a participant in the anarchist movement Buchenkov was concluded in a pre-trial detention center since December 2015. He is charged with standard for marsh part part 1 of article 318 (the use of non -hazardous violence to a representative of the authorities) and part 2 of Article 212 of the Criminal Code (participation in riots). According to the plot of the case, on May 6, 2012, Bushenkov attacked the police in Bolotnaya Square and turned street toilets. Meanwhile, in reality, Buchenkov was not at all in Bolotnaya on May 6 - he only returned to Moscow from Nizhny Novgorod on the evening of that day. In the photo, the case file does not depict Bushenkov, but another person, which was confirmed by a portrait examination , which was carried out by the order of lawyer Sidorkina by the end of January 2016. The personality of a person in the photo is unknown; In the Bolotnik support group, he is called a visor.

Meanwhile, the TFR stubbornly ignores both the results of this examination and the testimony of the stay of the accused in Nizhny Novgorod.

The swamp himself does not plead guilty.

Novikov undertook to defend Buchenkov on February 16 of this year, already at the end of the investigation - at the stage of familiarization of protection with materials. He explained his interest in the case precisely the obvious Alibi of the accused. “Those positions about the legality of the police, the rights to the rally, etc., which managed to develop on past sets (previous processes of swamps. - Ed.) And who now win in the ECHR, will have to be left,” the lawyer wrote. “Since we are talking about Alibi, it means that only about Alibi. On February 21, Novikov announced a reward of 250 thousand rubles for reliable information about the visor. He promised to keep the informant’s name secretly.

The anarchist blogger Alexander Grigoryev, who recently served for the arson of the district administration in Orsk, the Orenburg region, condemned the initiative of Novikov, writing in a commentary on his message: "This is not a defense system. To pull out one, but to plant the other." The anarchist community will turn away from Buchenkov, warned a former political zyt. The lawyer objected: "This is not a decision, but mine."
