The UN International Court must refuse Kyiv in a request to establish interim measures. This was stated by the representative of Russia Roman Kolodkin at a hearing in the lawsuit of Ukraine on violations of the Convention on the fight against the financing of terrorism and the Convention on the elimination of all forms of racial discrimination, TASS reports .
According to Kolodkin, the court has "two different cases that Ukraine artificially combined in order to blame the population of the DPR and LPR of terrorism, and Russia is of supporting terrorism and the persecution of ethnic minorities." At the same time, according to him, in relation to both cases, Ukraine could not prove the need to establish interim measures. In addition, the representative said, in both cases the court does not have the necessary jurisdiction, and in the situation itself there is neither the risk of irreparable damage or urgent necessity, which is a necessary condition for establishing interim measures.
On Thursday, the hearing on the claim ended. Now the court will begin to discuss the case. The court decision will be announced during the open meeting, the date of which will be announced additionally.
On the eve of the head of the Ukrainian delegation, the deputy minister of foreign affairs, Elena Mirror called on the UN court during the consideration of the claim to introduce a number of urgent measures against the aggressor state. "We demand immediate measures to protect and save thousands, and possibly millions of innocent lives, as well as the extremely necessary protection of Ukrainians in the East and in the occupied Crimea," she said.
Among such measures, the deputy head of the Ministry of Foreign Affairs called the demand for Russia to refrain from any acts of racial discrimination of people, groups or institutions in the territories temporarily controlled by it, including Crimea. In particular, Russia should not stop introducing political and cultural prohibitions against Crimean Tatars and ethnic Ukrainians on the peninsula.
A lawsuit with the charge of Russia of terrorism and national discrimination , Ukraine filed a lawsuit of the UN on January 16 . The violation of the Moscow International Convention on the fight against the financing of terrorism, then said in the Ukrainian Foreign Ministry, consists in providing "weapons and other types of assistance" to the militants of the DPR and the LPR. “To the most tragic terrorist attacks of Russian puppets,” the department noted, “should include a blow to the MALAYSIA AIRLINES flight Aircraft, the shelling of residential areas of Mariupol and Kramatorsk, the destruction of a civil passenger bus near Volnovhai and a deadly explosion during a peaceful assembly in Kharkov.”
Violation of the Convention on the liquidation of all forms of racial discrimination, the Foreign Ministry of Ukraine said, consists in a campaign against non -Russian communities in the annexed Crimea, in particular against communities of Ukrainians and Crimean Tatars. "Starting with the illegal" referendum "carried out in an atmosphere of intimidation, the Russian occupation power pursues a policy of cultural destruction of these communities," Kyiv noted. “The ban on the activities of the Medzhlis of the Crimean Tatar people, the waves of disappearance, murders, arbitrariness, detentions, attempts to stop the broadcasting of the media, as well as the restriction on the teaching of Ukrainian and Crimean Tatar languages” were mentioned.
Preliminary hearings on a lawsuit opened on Monday . They solve the issue of applying interim measures to prevent further violations of human rights in Moscow. Ukraine insists that the court obliges Russia to immediately terminate the material and other support of the militants conducting terror against the civilian population, and put pressure on terrorists to terminate such shares. In addition, Kyiv asks that Moscow be entrusted with discrimination in the Crimea, in particular to cancel the ban on the Medzhlis of the Crimean Tatar people and to investigate the disappearance of the Crimean Tatars.
According to the assumption of the press secretary of the Ukrainian Foreign Ministry, Maryana Betsu, the decision on the issue of interim measures will take one or two months. At the same time, there is a risk that Russia will refuse to fulfill the court decision, despite the fact that it is mandatory. In this case, Kyiv will have to contact the UN with a request to control compliance with the decision.
