
The Primorsky Kraisud again could not form a jury collegium for the third process of coastal partisans. This was reported at the FB page "Primorsky partisans.info".
More than enough candidates for jury - 35 people came to the meeting on Wednesday. However, nine of them immediately took self. Subsequently, several more candidates abandoned participation in the process. Thus, as a result of the assessors, the college did not get to form the main and reserve compositions of the college.
The next meeting is scheduled for April 12. Then the third attempt to form a collegium of jury in the current process will be adopted.
The process began on February 16. Judge Yevgeny Gavrilov refused the prosecutors to arrest the previously acquitted defendants Vadim Kovtun and Alexei Nikitin. The accusation achieved that both defendants be sent to a pre -trial detention center for six months. However, Gavrilov limited himself to taking from Vadim Kovtun and Nikitin a notorious subscription.
The proceedings will be carried out only one episode of the case. This is the murder of four drug dealers - Dmitry Makarenko, Vladimir Ponomarenko, Alexei Solovyov and Viktor Naumenko - committed in September 2009 in the Kirovsky district of Primorye. The Supreme Court first abolished the accusatory, and then an acquittal of this episode. The verdict on other episodes entered into force.
There are five people in the dock. In addition to Vadim Kovtun and Nikitin, this is Alexander Kovtun (younger brother Vadim), Vladimir Ilyutikov and Maxim Kirillov. The last three are in jail, since they used to receive the deadlines for other episodes. The sixth person involved in the case of the Primorsky partisans - Roman Savchenko - the murder of drug addicts was not charged. The proceedings against him have been completed, and since the fall of 2015 it has been contained in LIU -1 in Barnaul - the FSINA hospital for alcoholics, drug addicts and convicts with tuberculosis and AIDS.
The first verdict in the case of the partisans was issued on April 28, 2014 , the Judgment of the Primorsky Kraisud Dmitry Grishchenko on the basis of the jury verdict. Kovtun Jr., Ilyutikov and Nikitin were sentenced to life sentences, Savchenko - to 25 years of strict regime, Kirillov - to 22 years, and Kovtun Sr. - by 8 years 2 months of a strict regime.
However, on May 21, 2015, the Supreme Court canceled the sentences regarding the episode of the murder of drug addicts and sent this episode for a new consideration. Accordingly, the deadlines were reduced: Kovtunu -Jr. - up to 25 years of strict regime, Ilyutikov and Savchenko - up to 24 years old, Kirillov - up to 19 years. The dates of Kovtuna-Sr. and Nikitin, who were not charged with other episodes, did not appoint the Armed Forces.
On July 20, 2016, the jury, following the results of a second consideration of the episode , issued an acquittal verdict to all the defendants. The assessors with seven votes against five found the crime event unproven. Immediately after the announcement of the verdict, Kovtun Sr. and Nikitin were released. On July 28, Judge Marina Karakuyan announced the acquittal to the defendants.
However, the prosecutor Andrei Kambolin, who supported the charge both in the first and second processes, appealed the sentence to the Supreme Court , referring to a number of procedural violations. Meanwhile, the seizure by the judge Karakuyan from the case of the confession of the defendants was completely legal, since the investigation received these testimonies with a violation of the Code of Criminal Procedure. Regarding the inclusion in the college of citizens who, by law, could not be jury, the lawyers of the defendants noted that they participated in the process at the direction of Camboline himself. This was explained by the defenders, the usual trick of the prosecutor's office, used in case the verdict is required.
Despite the objections of the defense, on December 26, 2016 , the acquittal of the defendants in the case was canceled .
