They are going to forbid police officers with access to Gostine. What is wrong with this idea?

On Monday, March 13, the government commission approved the bill on the restriction on traveling abroad for some Russian police officers. The document was submitted to the State Duma of the previous convocation, in the summer of 2015, a deputy from the LDPR Dmitry Nosov (it was subsequently excluded from the party for passion for the “personal PR”). The bill implied restrictions on traveling for police in some positions, "for which admission to information constituting state secrets is provided." Despite the approval of the bill by the commission, the government indicated a number of flaws, and the legal department of the State Duma generally called a new ban on an excess. "Medusa" says that this document is not so.

1. This is an excess ban

The bill duplicates the current provisions of the law on the procedure for entry and departure from Russia. This law is already providing for a restriction on exit for citizens who have received admission to information of special importance or a top secret information classified as state secret.

Moreover, the order of the Ministry of Internal Affairs adopted in 2010 describes in detail the procedure for the admission of police officers to GOSTain. When applying for admission, a police officer must give a receipt or conclude an employment contract in which there is a clause on a possible ban on traveling abroad.

2. In it they forgot about the law on the police

The bill does not imply amendments to the law on the police - although, in theory, it should. In the current law, there is no prohibition of traveling abroad for police officers who took some specific positions.

3. It is not clear who he will affect

The bill does not indicate specific positions in the system of the Ministry of Internal Affairs, to which restrictions are extended. The author of the bill wanted to grant the department to allow this uncertainty to the department - but the Ministry of the Interior asked to remove this duty from him.

In addition, it is not clear whether a new ban on police officers who did not apply for admission to GOSTYAN, but took up positions, implying such access.

4. It is not known where to ban the ride

It is not clear in which cases the police will be forbidden to travel abroad. A new ban drawn up by the bill is optional. The government is going to ask the Foreign Ministry to compile a list of countries “which is not recommended to visit employees of the internal affairs bodies”, however, in the bill the role of the foreign policy department is not prescribed at all.

What are the chances that the bill will be accepted?

This is unknown. The document has a very strange story. In November 2015, shortly after the conclusion of the legal department of the State Duma on duplication of existing norms, deputy Dmitry Nosov withdrew his bill. After that, the document is usually removed from the consideration “in connection with the review by the subject of the right of legislative initiative”, but this did not happen. In October 2016, the State Duma of a new convocation, for which the speaker Vyacheslav Volodin was going to achieve the right to “ reset ” all the previous initiatives, overshadowed the responsible for the bill-they again became the Duma Committee on Security and Combating Corruption. And in March 2017, the government decided to support the bill, despite the recall of the initiative at the end of 2015. Now the Duma committee must collect all the reviews and prepare the document for consideration in the first reading.
