
In the news from the North Caucasus, the phrase "blood feud" periodically sounds. Either in connection with the conflict of Kadyrov with Yamadaev, then with loud accidents or raids of militants on police officers. How is this possible in the 21st century?
The fact that blood feud still exists in the North Caucasus republics is not denied by no one - neither politics, nor sociologists, nor law enforcement agencies. But the exact statistics of murders committed because of blood feud will not work. It is almost impossible to lead it - neither the accused, nor relatives of the victims in real motives are recognized as the court and do not like the investigation. This does not cancel the fact that, as a rule, all participants in the case know everyone.
According to the senior researcher at the Center for Civilization and Religious Studies of the Russian Academy of Sciences, Neplyasheva, today most cases of blood feud are in Chechnya and Ingushetia. A little less - in some areas of Dagestan. According to the researcher of the customs of Ingushetia, McCa Albogachieva (heads the department of the Caucasus of the Museum of Anthropology and Ethnography named after Peter the Great RAS), at present about 2% of all murders in the republic are committed for this reason.
Civilization penetrates at traditional societies at different speeds and changes archaic traditions. Therefore, blood feud is more common in the villages. “Even today, in my family village, it is not uncommon that the victims use blood feud as satsis,” says Asma Musaeva, associate professor of the department of state-legal disciplines of the Dagestan State Institute of National Economy.
Today, blood feud is announced mainly for intentional murder and only if it is known who is a killer. Historically, the reason for blood revenge could also be an insult to honor and dignity, slander, kidnapping of a girl, theft and property disputes. In the role of the Avenger, close relatives of the victim are - father, brother, son, nephew. Revenge is also declared close relatives of the perpetrator.
There is no clear ritual of announcing blood feud. Relatives of the murdered (as a rule, the elder of the clan, accompanied by several more men) come to the house of the killers and they say that from that moment blood is on them. As a rule, this is not a surprise for anyone. Men of both births communicate separately, women and children do not hear the conversation. Then they leave. No response killings immediately happen, as well as public advertising the conflict. Another thing is that in small villages the information spreads quickly, and usually everyone will quickly find out which families become bloodsmen.
Both the authorities and the clergy are actively trying to eradicate blood feud. In Chechnya and Ingushetia, conciliatory commissions operate. They exist in every area and consist of religious elders and respected community members. There are central conciliatory commissions under the heads of the republics. In Ingushetia, for example, such a commission consists of 12 religious figures. They work for free and voluntarily, they are not chosen or prescribed. The religion department may offer to join the commission worthy, in her opinion, to the candidate, and they, as a rule, do not refuse. “In 2016, we managed to reconcile six families whose enmity lasted many years,” says Ali Kotikov, the head of the religion department under the head of the Republic of Ingushetia. “And more than 40 families who declared blood feud as a result of an accident.” It was the incidents on the roads today that became the most common cause of blood feud in Ingushetia.

The mechanism of blood feud does not cancel criminal punishment. According to the 105 article of the Criminal Code, the committing of a murder on the motive of national, racial, religious hatred or enmity or blood feud is an aggravating circumstance. At the same time, even after the killer served the due time and was released, he is still pursued by the victim's relatives, if the reconciliation did not occur. Zaid Abdubulatov recalls: “In the Dagestan village, a young man died in a fight. The culprit was sentenced to a long time. Having served the due date, he recently returned to the village. In the Criminal Code of the USSR there was article 231, which punished for evasion from reconciliation up to two years in prison. In each district of the Dagestan and Chechen-Ingush Autonomous Republics, commissions on the reconciliation of bloodsmen, which included not only elders, but also the head of district committees, acted quite effectively.
Clear rules to whom, how and to what extent to take revenge, today no longer exists. “It is unlikely that it is legitimate to talk about the modern custom of blood feud, no one established new rules. We have the rudiments of the past that were deformed by modern rules and norms of behavior, ”explains Zaid Abdugatov.
This pre -state custom, known to the primitive peoples of the whole world and existing on the principle of “eye for an eye”, was used by the Sumerians, and is also registered in the Old Testament. He appeared to equalize a crime and punishment, damage and compensation. In a broader sense, he expressed the concept of justice and balance, when any action entails equal opposition.
I needed blood feud in its original form to maintain order. “The person understood that if he kills someone or does something bad, then the relatives of the murdered person will pursue him until the killer’s blood spils. This was an effective restraining factor that prevented the crime, ”explains Asma Musaeva. In addition, members of the same kind understood that in conditions of circular bail, if one committed a crime, then everything would be at risk. This forced them not only to take care of themselves, but also to look after relatives so that they would not do bad.
Blood revenge is not a consequence of a state of affect and not a sign of hot mountain blood, rather the opposite - a reaction to such hot blood. This is a well -thought -out action that obeys the mass of the rules. The order and rules of revenge is regulated by the custom - adat. Each nation had the adats differed, and there was no uniform revenge of revenge for all. And within the framework of one people, customs could vary. “Even the Kumyks (one of the Dagestan nationalities) was different,” says Zaid Abdugatov. - There is a rather difficult situation. When a man killed, this is one when a woman is another. When the prince killed a free peasant, he did not become a bloodshed (kanly), but determined the one of his peasants who acquired this status. But if the servant of the prince killed a man, not he, but the prince became a bloodstream. If the killer was hiding in the house of another person, and he, defending him, killed one of the attackers, he did not become kanla. And so on".

Adat allowed revenge in any environment and in any situation. However, in some cases, the grain was considered unworthy of a man: the murder of unarmed, a blow or a shot in the back, the murder of a praying, sleeping and suffering from a temporary ailment (before his recovery). “According to our information, if the killer had grief, misfortune - a close one was dying, a house and so on, then the vengeance was postponed for a while. If the criminal was caught at the crime scene (murder, robbery, rape), then revenge was banned for his murder. Here, not only a relative of the victim, but also his friend could act as a punisher, ”explains Asma Musaeva.
Until what moment did blood feud last? Firstly, before reconciliation. Secondly, before the murder of the killer. Thirdly, sometimes the deadlines were determined, until what time the act of revenge could be committed, after this time the murder was prohibited. The natural death of the killer or his arrest by administrative authorities did not stop revenge. In the 19th century, women were also sometimes avenged in Ingushetia. “For example, when the only brother was killed, his sister took a vow of celibacy, dressed in men's clothing, shaken her hair and declared blood feud. Only after the reciprocal murder, she returned to ordinary life, ”says Mca Albogachieva.

If at first the whole clan was responsible for the crime of one, then they gradually took revenge on the murderer and his closest relatives. “Instead of the unlimited revenge in Adat, the doctrine of the equality of retaliation begins to penetrate that crime is concluded not so much in material harm as in the evil will of the culprit,” explains Asma Musaeva. Over time, they began to believe that self -defense, the murder of a robber or adultery at the crime scene should not be punishable by the return murder. The negligence and lack of evil intentions also became mitigating circumstances.

Sometimes the relatives of the killer were subjected to ostracism - expulsion from the community. This did not replace the grain, rather, put it off. At the same time, warring families did not cease to be considered bloodsmen. “It was a very harsh punishment, since in conditions of land deficit and in severe climatic conditions it was extremely difficult to find a refuge in another community,” says Asma Musaeva. - But even in cases of gaining a new habitat, they passed into the category of newcomers, non -native residents - “apoparak” (literally “located in the background”). And neither they themselves, nor their descendants were equal members of the community. ”
The recent news that 35 men-relatives of Alam Khadzhaev were expelled from the Chechen village of Achhai-Martan-this is just an example of ostracism. At the end of November 2016, Alam Khadzhaev made an accident in a drunken form - he drove into the oncoming lane and crashed into a car in which there were five members of the Shuipov family. Then another car crashed into them. As a result, seven people were killed, including Khadzhaev himself and all Shuipovs. The police found Khadzhaev guilty.
According to some data, the relatives of the perpetrator were expelled from the village to Ingushetia relatives of the victims. According to others, the police arrived and forced them to leave to avoid blood feud from the Shuipovs. The fact is that the next day on the Grozny television channel, the head of Chechnya Ramzan Kadyrov spoke about the responsibility of relatives: “Each parent knows if his son drinks or not, although they say that they did not know. They will know if you look. If it comes home late, ask where he was, why he came so late. If it works, then on a shift or where? Father or relatives should know what and where the son is doing, so that it is not too late tomorrow, ”Kadyrov said. But at the same time he clearly stated that everything should happen according to the law.

Кровную месть не одобряет не только государство, но и религия. Ислам однозначно выступает против кровной мести, которая существовала на Кавказе задолго до его исламизации. Еще в период национально-освободительной борьбы горцев в XIX веке руководители движения имам Гази-Мухаммад, имам Гамзат-бек и имам Шамиль пытались искоренить ее. «Уникальность наказания за убийство и нанесение увечий в исламе состоит в том, что семья жертвы может выбрать один из вариантов: настоять на наказании, принять материальную компенсацию или простить преступника, — поясняет Заид Абдулагатов. — Предпочтительным выбором по Корану считается прощение преступника. Но и здесь ислам натыкается на древние понятия о чести и достоинстве. Несмотря на то, что ислам призывает отказываться от мщения, во многих случаях и общинах такого рода пацифизм считается позором. «Отказ от мщения в традиционном обществе дагестанцев считался слабостью рода, — подтверждает Заид Абдулагатов.— Если закон не наказал убийцу, а родственники не предприняли никаких мер, это становится показателем слабости его близких и всего рода».
«Если убитый остается не отмщенным, то его род, тухум, покрывается бесчестьем и позором, — добавляет Асма Мусаева. — В некоторых горных аулах Дагестана до сих пор на кладбищах есть специальное место, где хоронят тех, кто умер, не исполнив «кровного долга» или не примирившись с врагами».
«В целом общество благосклонно к тем, кто прощает виновного, если не было злого умысла, — добавляет Наима Нефляшева. — Однако если, например, задета честь сестры, а брат простил обидчика — это вызовет осуждение. А в случае драки или ДТП, совершенного без злого умысла, прощение будет скорее приветствоваться».
Кровная месть не имеет срока давности. Известны случаи, когда мстили спустя десятилетия, когда и сам убийца, и его близкие родственники уже умерли. В 2009 году глава Ингушетии Юнус-Бек Евкуров сообщил о том, что удалось примирить кровников, вражда между которыми длилась 70 лет. Макка Албогачиева вспоминает, как ей в руки попал исторический документ 1802 года, в котором было сказано, что на тот момент в Ингушетии каждый взрослый мужчина имел как минимум одного кровника. Кровная месть была повсюду.
«Ужас механизма кровной мести в том, что вражда может тянуться и сто лет, жертвами становятся люди, абсолютно непричастные к конфликту, например, внуки виновного. Иногда кровная месть задевает несколько поколений», — говорит Наима Нефляшева.
Никто не хочет вымирать целыми родами, и народы Северного Кавказа не исключение. Помимо остракизма, примирения и прощения ради Аллаха в общинах все чаще практикуют штраф вместо крови. «Есть такое понятие «цена крови» — это материальная компенсация, которую родственники потерпевшего готовы принять. Раньше она взымалась скотом, лошадьми, деньгами, оружием, тканями», — рассказывает Наима Нефляшева. Размер штрафа зависел от статуса и богатства рода, а также от тяжести преступления.
Сегодня цена крови имеет вполне четкое денежное выражение. К примеру, еще недавно в Ингушетии она составляла плюс-минус 100 тысяч рублей. А в 2010 году там прошла конференция мусульман, на которой совет старейшин увеличил сумму выкупа кровной мести за умышленное убийство до миллиона рублей. Макка Албогачиева присутствовала на этой конференции и объясняет, откуда взялась такая сумма: «Кадий республики Абдурахман Мартазанов тогда напомнил, что материальная компенсация за гибель человека обозначена в Коране, и Аллах обязывает виновного в этом уплатить цену, равную стоимости 100 верблюдов. Посчитав среднюю цену верблюда в наши дни, муфтият получил сумму в миллион, и на общем голосовании ее одобрили».

Можно простить виновного и без компенсации. Примирительная комиссия будет настаивать на ней, если в семье убитого остались женщины и дети. Но если семья виновного небогатая, то сумму компенсации можно снизить. Многие семьи и вовсе не берут ее, потому что не хотят уравнивать жизнь человека с каким-то денежным эквивалентом. «На моей памяти был только один случай, когда семья погибшего в ДТП приняла миллион, — вспоминает Али Котиков. — Но деньги сразу же передали имаму, который присутствовал на примирении, на строительство новой мечети».
Как кровную месть практиковали в условиях первой и второй чеченских войн? Олег Орлов, руководитель программы «Горячие точки» правозащитного центра «Мемориал», объясняет, что практически никак:
«Кровная месть, будучи обычаем индивидуальным, когда конкретные люди мстят за кровь конкретных людей, не очень применима к условиям войны. Когда большая группа людей сражается против другой такой же, тут не до кровной мести. Прежде всего, неясно, кому мстить. Как в перестрелке понять, чья пуля попала именно в тебя? Даже если известен батальон и его командир. Но если даже в теории удалось бы узнать личность конкретного бойца, в условиях военных действий не до этого.
Другое дело, если в ходе зачисток конкретный лейтенант Иванов приехал в дом к боевику, увез его и убил. Тогда семья может объявить кровную месть. Но следует помнить, что в мирное время на русских этот обычай не распространяется. Впрочем, русские спецназовцы недаром работали под чужими именами и во время спецопераций были в масках. Это делалось и для того, чтобы избежать возможной мести в будущем. При этом мне не известен ни один случай, когда русскому объявлялась бы кровная месть.
Полковник Юрий Буданов был, безусловно, кровником родственников Эльзы Кунгаевой, которую он убил. Однако Юсуп Темерханов, которого обвинили в последующем убийстве Буданова, родственником Кунгаевых не был, поэтому это уже другая история. Это была определенно месть, но не кровная.
Вообще важно различать кровную месть и просто месть. Второе на войне случалось намного чаще. Во время второй чеченской войны многие шли в вооруженные формирования именно из мести за убитых в первой войне родственников. Был такой громкий случай, когда 18-летняя Айзан Газуева потеряла во время второй чеченской войны мужа, дядю и двух братьев и в 2001 взорвала себя и коменданта Урус-Мартановского района Гейдара Гаджиева. Это была однозначная месть — она мстила за убитых родных. Но это не пример кровной мести, ведь комендант не убивал этих мужчин.

Но Кадыров сегодня активно борется с этим обычаем, поэтому никто вслух не сообщит, что объявляет кровную месть. Более того, сегодня многим обычным чеченским семьям важнее выжить, а не подвергать себя риску, и если отомстить за родственника в данный момент рискованно, то это всегда можно отложить на неопределенный срок.

Большинство экспертов считают, что со временем кровная месть исчезнет как архаический пережиток прошлого. По мнению Заида Абдулагатова, есть несколько причин, почему кровная месть существует до сих пор. «Во-первых, это подсознательные стереотипы, которые исторически закреплены в человеке и не подчинены социальным и правовым нормам. Во-вторых, несогласие и недовольство со стороны пострадавших принимаемыми государством законными мерами. То есть, когда закон не соответствует справедливым решениям. Например, в России на сегодня нет смертной казни даже серийным убийцам. Такого рода «гуманность» воспринимается как издевательство над жертвами насильника. В-третьих, имеет место отсутствие должного правового сознания. Даже адекватное наказание законом, например, за непреднамеренное убийство, нередко принимается пострадавшей стороной недостаточным. В-четвертых, нередко преступник, подкупая суды, уходит от заслуженного наказания, и это очевидно воспринимается как несправедливость».
Говорить о кровной мести как о мракобесии, не учитывая национальных особенностей народов, не очень правильно. Представители власти, религиозные авторитеты и сами люди находятся в сложной и в цивилизационном смысле интересной ситуации, когда сталкиваются разные уклады. Но цель их одна — восстановление справедливости.
