Slave labor, meager food, bodily punishments, the death of a teenager-in Rostov the Great, the process of the three abbesses of the so-called "Orthodox shelter" in the village of Mosseytvo, accused of children and the murder of 13-year-old Tatyana Lyubimova, is drawing to an end.

There are three elderly women in the dock on the dock: the adoptive mother of the deceased Lyudmila Lyubimova and her two friends - Rifa (Raisa) Gusmanova and Guzel Semenova. The trial has been going on for more than a year, however, the case file raises more and more questions both to the prosecution and the defense.

Moseitsevo

Mosseytsevo is a deaf village on the border of the Ivanovo and Yaroslavl regions. The temple in the construction forests, the rickety huts, drowning in the tal of snow, roads, empty streets. According to the rural paramedic Nina Casaurova, out of 287 registered residents, only 14 have work, the rest saves the subsidiary farm. On the one hand, the temple behind a high green fence is a two-story stone building of the former school, disbanded in the early 2000s, a little at a distance-two new houses upholstered by wooden siding: in all these buildings, members of the Lyubimova in 2000 of the charity organization "The Ugodich House of Mercy"-according to the name of the neighboring Mosyotichi village.

Still living in Moscow, Lyubimova adopted six babies born in 2001-2002, according to her, they were all sick, born in dysfunctional families, not one of them had a chance to find a family. “I took those from whom everyone refused,” says Lyudmila Lyubimova . According to the case materials, having finished the process of adoption, Lyubimova quit his job and left for the village.

Today, none of the shelter houses gives signs of life, although, according to the fellow villagers, people live there, and Lyubimova herself sometimes comes from Rostov, where she moved during the process. The neighbors willingly say that in the early 2000s, when Lyubimova and her daughters only settled in Moseitsevo, she was sociable and friendly-in the shelter they arranged holidays for Christmas and Easter, set the table, children read poetry (mainly religious), and along with Lyubimova lived other families, reached 30 people.

“There was a passage yard, some left, others came, rarely anyone delayed for a long time,” says Galina Petrakova, a resident of Mosseytsevo. According to her, numerous children were divided by age: the elders lived in wooden houses, where there was cattle and garden, the younger ones in the building of the former school. Men lived separately from women, for the offenses, like drinking alcohol, immediately expelled from the community.

In the "Ugodich House of Mercy" various incidents took place for a long time. So, the inspector of PDN Kovaleva told in court that in 2009, Lyubimova appealed to the department with a statement on the search for minor Alexandra. Kovaleva had to take explanations from the child in the presence of her adoptive mother, and when PDN employees "several times left with a check at the place of residence of Lyubimova in connection with the signals about the violation of the rights of the children, Lyubimova did not open the door, did not let into the house."

Finally, in 2013, the Yaroslavl Komsomolskaya Pravda published an investigation according to which the girls from the shelter were given to pedophiles. However, the investigation of these facts did not find these facts, and Lyudmila Lyubimova won the court of Komsomolskaya Pravda to protect honor and dignity.

Ksenia Semenova confirmed in the court that the girls almost did not study, began to study two weeks before the exams, the rest of the time worked. However, the teachers of the Ugodich secondary school, where the children were certified, were satisfied with them, and low performance was associated with poor heredity. Psychological and pedagogical examinations conducted after the death of Tatyana showed that the knowledge of girls in basic subjects correspond to elementary school, and not 5-6 classes, and experts found in some of them not inborn, but caused by the "features of their upbringing."

Labor therapy, according to the examinations of doctors examined, led more to negative results. Valentina Shkuro’s lawyer quotes the protocols of early interrogations in the court, in which the investigator, not hearing the answers of the victims, who tell him that “their mother did not beat them,” and they helped voluntarily, stubbornly returning to the same questions: “How did your mother punish you? She forced you to do this work?” Lisa Lyubimova refused to speak the most testimony at the trial, but Ksenia Semenova performed in one of the meetings, confirmed that the girls were regularly punished with rods - sometimes one person beat, sometimes two, "when the children broke up." When the lawyers asked Ksenia why she did not tell this during the investigation, the girl replied: “Catherine warned me, she was from the educators, that if they pick us up and interrogate us, then we need to defend everyone and say all the good things. What was punished and beaten, she couldn’t say that at night to Galuzinovo on the day Tanya died and explained everything.”

From the stove to the cellar

November 22, 2014 at about 15 hours at the door of the paramedic Nina Casaurova, Lyudmila Lyubimova knocked. Прибывшая полиция не обнаружила в доме Любимовой никого, кроме нее самой и тела Татьяны – на вопросы об остальных детях Любимова отвечать отказалась, пообещав, что они будут на месте утром. Но, как рассказала начальник Подразделения по делам несовершеннолетних Ростовского МО МВД Ирина Галингер , наутро детей в доме не оказалось, более того, сотрудникам полиции не хотели открывать – пришлось взламывать дверь. Дома у Любимовой полицейские нашли только Лизу, остальных детей прятали в доме Гусмановой в Голузиново, где, согласно протоколу обыска, температура составляла 16 градусов. Все трое вскоре были арестованы, однако Любимову выпустили из СИЗО через год – по состоянию здоровья. Тогда же органы опеки изъяли и Ксению Семенову в доме ее матери в Закобякино, а также троих детей еще одной подруги Любимовой Наталии Роговой – ее дело было выделено в отдельное производство, 6 марта суд назначил ей штраф в 7 тысяч рублей за ненадлежащий уход за детьми. От наказания ее тут же освободили по истечению срока давности, но детей так и не вернули.

Жители "Дома милосердия" решили не сдаваться и даже попытались похитить труп Татьяны из ростовского морга, но, по словам заместителя начальника Следственного комитета по Ярославской области Виктора Денисова , автомобиль с телом был перехвачен по дороге.

Людмила Любимова уверяет, что 13 ноября, за девять дней до смерти, Таня оступилась и упала с печки, а потом 17 ноября снова упала в погреб, сильно ударившись головой. Лиза Любимова назвала виновницей гибели Тани Раису Гусманову. Лиза даже опознала цепи, которыми пользовались воспитательницы – их изъяли в Мосейцево и в Голузиново во время обысков. Ее слова подтвердила на суде и Ксения Семенова: "Связывали обычно на ночь. Зачем, не знаю. Это делала обычно матушка Раиса, а утром развязывали", – "А вы пытались сами руки развязать?" – спрашивает Ксению прокурор. – "Развязывали, но тогда придумали цепь и стали цепь закрывать замочком, и цепь невозможно было снять", – отвечает девочка.

Уже находясь в социально-реабилитационном центре, Лиза написала письмо, приобщенное к делу: "Меня и мою сестру Таню связывали руки за спину и говорили делать поклоны много раз. Тане вливали в рот кипяток, за то, что она не ела горчицу. Раны от кипятка мазали горчицей, и мне тоже за спину полили кипяток. Когда Таня слегла, имеется в виду в пятницу вечером, приехала Раиса [Гусманова] и связала ей руки, и они у нее опухли и покраснели, и когда она плакала, ей в рот засунули тряпку. Мама [Людмила Любимова] развязала ей руки, когда она умерла. Ноги ей стали связывать, когда она сказала, что сбежит", – написала девочка. Экспертиза удостоверила ее почерк, а также то, что она писала письмо не под давлением и в спокойном состоянии.

Практически вся фабула обвинения против Гусмановой строится на показаниях малолетней Лизы, у которой, как напоминает защитник Борис Кудрявцев , есть отклонения в психическом развитии, как и у остальных девочек, (эксперты, впрочем, посчитали, что потерпевшие не склонны к фантазиям и способны адекватно рассказывать о происходившем). "Сложно поверить, что у девочки умерла сестра, мама в тюрьме, а она пишет такое письмо в совершенно спокойном состоянии", – говорит Кудрявцев. Не подтверждаются слова Лизы и фактами: раны от ожога у рта у Татьяны не было, как не было и ожогов на спине самой Лизы. По словам Кудрявцева, девочка даже заявляла, что Гусманова выколола Тане глаз, но и оба глаза были на месте. Но самое главное – на первых допросах, записанных на камеру, Лиза о жестоких избиениях не рассказывала и лишь на последнем, когда видеофиксация почему-то не велась, вдруг заговорила юридическим языком, сообщив, когда, чем и по каким местам Гусманова наносила им удары.

"Во-первых, странно выглядит, что девочке наносят десять ударов по голове, а она стоит и не пытается убежать. Во-вторых, почему, если по голове били обеих, у Лизы не нашли никаких повреждений, так же как не нашли их и у остальных девочек, которых, по словам Лизы, регулярно избивали", – говорит Борис Кудрявцев. Его слова подтверждает и заместитель главврача из детской больницы Надежда Папылева: на суде она рассказала, что телесных повреждений на детях не было, вели они себя спокойно, "были красивые, нормальные, ухоженные дети". Впрочем, на спине у Веры Любимовой эксперты нашли "гиперемию, то есть покраснение кожи (…) в виде множественных полос 4-5 штук размерами и длиной не менее 20 см и шириной до 0,5 см" – природу и давность этих повреждений эксперты определить не смогли.

Умерла от совокупности

Пролить свет на обстоятельства гибели Татьяны могла бы патологоанатомическая экспертиза и следственный эксперимент, проведенный в Мосейцево, когда следователи использовали куклу, "падавшую" с печки и в погреб. Оба документа оказались в распоряжении Радио Свобода.

Патологоанатом обнаружил на голове Тани шесть гематом, полученных от удара тупым предметом: на лбу, слева и справа между виском и скулой, справа между лбом и виском, около правого уха, на затылке и на темени. При вскрытии выявилась закрытая черепно-мозговая травма, а также субдуральная гематома (кровоизлияние под твердой оболочкой мозга. – РС) . Кровоподтеки были на обоих плечах, предплечьях, кистях рук, бедрах, голенях (всего 20 повреждений), а также семь ссадин: под левой лопаткой, на левом плече и на обоих локтях, на правом предплечье и правой кисти. На левом предплечье эксперты обнаружили рубцующуюся рану, а над левой ключицей – рубец после ожога, сзади на голове в двух местах были вырваны волосы. Все повреждения были нанесены в разное время, в том числе и на голове. Кроме того, девочка была крайне истощена, на теле образовались пролежни. Признаков "травмы ускорения", которые могли бы свидетельствовать о том, что девочка получила смертельные повреждения при падении, эксперты не увидели.

Не подтвердил версию Любимовой и следственный эксперимент с куклой – по мнению экспертов, повреждения, которые погибшая могла бы получить при падении, не соответствуют реальным травмам.

На первый взгляд, исследования отвечают на поставленный вопрос и вполне соотносятся с показаниями Лизы: девочку забили до смерти, и даже если она падала с печки, это не стало причиной гибели. Однако независимая экспертиза обоих документов, проведенная по запросу адвокатов, выявила многочисленные противоречия в заключениях экспертов, которые ставят под сомнение их выводы и предъявленное Гусмановой обвинение. По словам Бориса Кудрявцева, причиной смерти государственный эксперт считает "совокупность осложнений", то есть все обнаруженные на Таниной голове гематомы, и указывает одну давность их появления – 4-6 дней до смерти. Он не исследует каждую гематому по отдельности, как того требует приказ Минсоцразвития, а значит, и причину смерти нельзя считать установленной.

Независимые эксперты сомневаются и в результатах следственного эксперимента: в выводах одной строчкой написано, что Таня не могла получить при падении свои травмы, хотя эксперт должен был бы исследовать каждое повреждение в отдельности. "Экспертиза сделана настолько непрофессионально, что по ней просто нельзя судить, от чего умерла Таня. Эксперты даже не задались вопросом, не могла ли она умереть от гнойной пневмонии, которой, согласно данным той же экспертизы, болела", – говорит Борис Кудрявцев.
