The European Court recognized the sanctions of the EU against Rosneft substantiated

The European Court in Luxembourg recognized the sanctions of the European Union imposed on a number of Russian companies, including Rosneft, due to aggression in eastern Ukraine. As TASS reports , this is stated in a court decision in the lawsuit of Rosneft against the EU Council.

"There are no facts that could question the validity of the decision or adopted (on its basis. - Ed.) Legal norms," ​​the court decision said.

At the same time, the court admitted that restrictions should not apply to the processing by banks by Rosneft of payments, since the EU documents say only about the ban on “financing and financial assistance”.

"In this regard, the court notes that the purpose of regulation is not to freeze assets or restriction of the transfer of funds," the court decision said.

In October 2014, Rosneft filed a lawsuit against the UK authorities on the legitimacy of the EU sectoral sanctions introduced against Russia. According to Rosneft, Great Britain interpreted them too widely, which led to additional unjustified restrictions on the company in international markets.

In January 2015, the high court of London sent a lawsuit Rosneft to the European Court, since the Russian company disputes the decisions of the European Union and the British court has no authority to make a decision on their legitimacy. Rosneft also disputes the EU sanctions directly in the European Court of General Jurisdiction, the second most important in the EU after the European Court. However, the trial in this lawsuit was postponed until the decision of the European Court on the claim filed in the UK is made.

In November 2014, the administrative court of London, one of the units of the High Court, refused Rosneft in the lawsuit to suspend the order of export control, which introduces criminal liability for violation of the September sanctions of the European Union against the Russian oil sector.

The order on export control introduced in particular criminal liability in the form of a fine and/or imprisonment for a period of up to two years for violation of the sanctions regime in the UK or British subjects and companies anywhere. Rosneft insisted on the suspension of the document as a security measure for the period of consideration on the merits of the lawsuit, which disputes the legality of the order.
