The French National Court of Paris of Paris granted political asylum to 31-year-old Alexei Sweetheart, the older brother of the Primorsky partisan, Alexander Sweet, who died in 2010. This was reported on her FB page by journalist Anastasia Kirilenko.
The decision was made based on the results of the examination of the emigrant appeal against the refusal of the asylum, which was made by the French refugee and stateless persons (OFRPA) service.
Sweet veins in the find; He rarely met with his younger brother, who remained in the village of Kirovsky. Nevertheless, in August 2010, two months after the defeat of the partisan detachment, pressure began on the sweet, senior. He was fired from the department of Sberbank, where he worked as a guard, and the boss directly told him that this was the initiative of Moscow. After that, for two and a half years sweet, it was not possible to find a job, and he was forced to interrupt random earnings. As the emigrant said, he "could not get a taxi even in a taxi, although there was a constant shit of personnel."
Police threatened sweet to the criminal case to be forced to testify against the seaside partisans. “At first there was a fear that I would be attracted with everyone,” he noted. That is how, the partisan’s brother reminded, they acted with the defendant of the case Vadim Kovtun, arrested a few months after the defeat of the detachment. “There were hints about drugs,” said Sweet.
As the Caucasian Knot reported , the emigrant later reported that he himself demanded to recognize his participation in the detachment.
I did not receive official challenges for interrogations. Instead, he was “pulled out, of course, without warning, they were taken to them, they beat, beat him, and then thrown out in the city, on some square, half an hour from the center, so as not to fall.”
Judging by the publication of the "Caucasian Knot", in total in 2010-2012, the partisan’s brother was illegally detained and tortured three or four times. He invariably refused to sign the confession.
Fearing further persecutions, the sweet passport with the Schengen visa, delivered by the French authorities, issued sweet, with the assistance of acquaintances. In December 2012, he drove through France to the Netherlands and there he turned for a political officer. However, the Dutch officials in the request refused , sending an emigrant back to France as a country of arrival in the Schengen zone.
OFRPA examined the request of sweet on February 19, 2015. A few months later, on June 2, it became known that the emigrant was refused asylum.
Having studied the photos presented by the refugee and the conclusion of medical examination, French officials agreed that he was tortured. The negative decision, made on request, they explained to "the refusal of the sweet to tell the details about his service in Chechnya in 2003-2004."
Initially, it was indicated in the document, in response to the question of the military service, the emigrant said that he had passed it in Ussuriysk. However, when the official pointed to him at the press in the press, which reported the Sweet service in Chechnya, he admitted that from September 2003 to August 2004 he served on an appeal in the 14th Brigade of the GRU special forces at Hankala. "At the same time, the shepherd of the shelter showed loyalty to the Russian special services, mentioning his obligations of confidentiality, forbidding him to answer questions about his military service," the refusal resolution said.
Meanwhile, officials noted, the 14th brigade led the Chechen security officials who were loyal to Russia, who during the Second Chechen war were engaged in abduction, torture and the best-west executions of local residents.
Meanwhile, the director of the Human Rights Analysis Center, which lives in Norway, Ahmed Gisaev, who was tortured on the basis in Hankal, just at the time when he served sweet, defended the emigrant. "The brand soldiers themselves were tortured, and it is impossible to indistently blame any Russian soldier of torture Chechens, for whom at least officers are responsible," the human rights activist said.
In the statement by Human Rights Analysis Center, which was quoted by the Caucasian Knot, it was noted that "there is no information regarding the commission of it (sweet. - Ed.) Of any crimes against residents of Chechnya." “And the very fact that Sweeters was only a conscript, already excludes any possibility of his involvement, even in a hypothetically, in the commission of any acts regarding the civilian population,” the human rights activists said.
It was emphasized that the sweet ones themselves "should be considered ... as a victim of the highest military-political leadership of Russia, which in fact with a threat of life and health sent him to a potential risk zone, to the territory of hostilities."
At the hearing in the court, which took place on March 8, the lawyer of the emigrant Marie Paul de Clerk also drew attention to the fact that the conscript "may not always affect the part of him."
During the trial, he assured the sweet ones that "he did not take part in any torture."
After the meeting, the emigrant told the "Caucasian knot" that in Khankala he himself was put in a hole with water, which is why he fell ill with pneumonia. “This was a classic punishment for refusing to fulfill the small assignments of the elders in rank,” said sweet. In Chechnya, "no one spared the personnel," he remarked.
On March 29, three weeks after consideration of the appeal, the court announced the decision in favor of the sweet.
