So, after all, on which side the law is, what can be removed and what is impossible? And what if you are forbidden by photo and video shooting?

The guards and the police may have their own ideas about the rule of law
A year ago, Yana Katelevsky was delayed twice - first for the video shooting of unauthorized parking near the police department, and then for shooting a plot about their detention. The judge of the Ramensky city court Olga Golysheva found Katelevsky guilty of disobedience to the legal request of the police officer and appointed a total of 22 days of administrative arrest.
Vadim Korovin, who after a few months gave reporters an interview with the same police department, was fined. And more recently, Vladislav Lunkov, who achieved the cancellation of the ban on the shooting of internal affairs departments, was detained in Bryansk for the shooting of the local police department. And this confrontation between social activists, lawyers, guards of some establishments and police continues, and the end and the region is not visible.
To begin with, Vladislav, please explain, are there any places in Russia where you can’t take pictures and make video?
Vladislav Lunkov: Of course there is! They are stipulated by special law. And what you are talking about: police, public places, shops - this is a little absurd, which is forbidden to shoot there.
Maryana Torocheshnikova: And what definitely cannot be removed?
Vladislav Lunkov: There are secret facilities, closed enterprises - of course, you cannot shoot there.
Maryana Torocheshnikova: But you have to get there somehow ...
Vladislav Lunkov: That's it! This is when someone violates some kind of internal order or secrecy ... But how can a simple person break the secrecy, if he simply has nothing to do with her?

Maryana Torocheshnikova: Nevertheless, we know about criminal cases about the disclosure of some state secrets by people who did not even have access to state secrets ... Vadim, from your point of view, how justified by the introduction of some prohibitions and restrictions for the production of photo and video shooting?
Vadim Korovin: This is justified only from the point of view of the law. All that is written in the law is an exhaustive list. These are objects with a secrecy regime, where an ordinary person really cannot get just like that, he must get a special admission, he signs paper, familiarization with the secrecy regime.
But there is such a moment: private and public. If I am at someone at home, I have no right to start to fix something, because it will be an invasion of private life. And I can openly fix it only with the permission of the owners, otherwise I violate their personal space.
And the store is, on the one hand, a private territory, but it does not cancel its publicity. Any person can go there, this is public space.
Maryana Torocheshnikova: And, accordingly, you have the right to shoot, photograph, conduct online broadcasts and so on.
Vadim Korovin: But then the law on the image, intellectual property comes in conflict with our desire. We began to understand: where have the right to limit the shooting of cinemas? And we did not find in the law that a person is forbidden to fix the image directly in the cinema. If he removes this image for himself, then this is not a violation of the law. The moment of violation of the law is the illegal distribution of the image with profit. Courts call this preparation for a crime. If a person repeatedly fixes the image, and then traces appear from his lens, and through the examination it somehow turns out that copies received by the pirate method and common on the Internet were received using this equipment, this is already direct evidence.
Maryana Torocheshnikova: But just like that, even a guard in the cinema is not entitled to approach and demand to turn off the phone from the viewer who fixes something?
Vadim Korovin: But I think that I have the right, because it is spelled out in the conditions of visiting the cinema. There is a 1996 decree signed by Yeltsin that cinemas have the right to establish their own rules.

Jan Katelevsky: Vadim says that this is a public offer that you must obey when buying a ticket. But I do not agree with this. When private individuals are given the opportunity to create some of their own rules, this is wrong. There must be a law that prohibits, for example, video shooting due to copyright violations. For example, copying is prohibited, this is spelled out in the law, for this such and such a sanction is supposed, and not this blurry: “A private person in his cinema can create some rules” ... After all, they can change their rules every day, and we will have to study them every day.
Maryana Torocheshnikova: Tell me about the police and their order, which was either canceled, or not. It seems, on the one hand, they said that citizens now have the right to remove anything in the territory of the internal affairs departments, and on the other hand, Vladislav was detained for this. Yan, why did you decide to shoot something in the police?
Jan Katelevsky: This is a public place, and everything that happens in the police should be public so that the employees understand that they are eye behind them, they fulfill the will of the people exclusively. This is a tool so that there are no crimes, corruption on the territory of the police. People must see what is happening there. And there are caring people. For example, a person was detained, and he removes his arrest, the preparation of some administrative materials, if it allows the norms. The Criminal Code has restrictions on shooting during some procedures. Actually, for this we remove and try to cancel illegal orders and decrees.
Maryana Torocheshnikova: That is, at the call of your soul, you went to the police department and began to remove the spontaneous parking there, and then they shot, how are you delayed during the shooting?
Jan Katelevsky: Yes. At the moment when they tried to detain me, I collected evidence to write a statement.
Maryana Torocheshnikova: What did the police say to you to stop the video, how did they justify their requirements?
Jan Katelevsky: At the time of the detention, they referred to the Federal Law No. 3, the federal law on the police, said that it was illegal, and that’s all.

Vladislav Lunkov: Unfortunately, we were faced with the police who behave like that. More recently, our friends went to the city of Ufa, went into five or six police departments and freely shot there. They were met by police officers, some introduced themselves.

Yan Katelevsky: When drawing up administrative materials on Vladislav Vladimirovich, the police referred to several of their intra -division orders, where, inter alia, it was indicated that these are orders for official use.

They delay people on Red Square almost every day and take it to the Khiva-Gorod police department, and people with cameras are running after the citizens who are being moved, run into the department, so they are always ready to run up with cameras and show this order to everyone. Some departments know that this order gives the head of the territorial department the right to determine the method of obtaining permission to video, that is, he must give a written resolution on this.
Absolutely unconstitutional order! It is not possible to get it legally, because it is not registered with the Ministry of Justice, we took a copy of the Internet. I understood that lawsuits would begin in the summer. And then, then the judge Golysheva discussed with the police how to roll Yana Katelevsky, despite the fact that he was absolutely innocent. She complained about what she could not find in the "consultant" the norm that can be applied.
And I understood that the norm is unconstitutional, it must be canceled. I called the Agora : "Guys, what are we going to do?" - "We cannot do anything because we cannot get it, this norm is nowhere to be found." I say: "A second, it is present in the protocols." I rummaged everything, found a link to this order in the protocols, found the text of the order on the Internet, just downloaded it in the Word format and sent it to Agora. And on the basis of this, a lawsuit was born.
Maryana Torocheshnikova: That is, you filed a complaint with the Supreme Court of the Russian Federation on the recognition of this order illegal.
Vadim Korovin: Yes. But in the end, the judge of the Supreme Court passed between Scylla and Haribda: in order not to offend the minister and act according to the law, he decided to simply wash his hands in the process, and between the first and second meetings, Minister Kolokoltsev abolished his own order so as not to load this by the Supreme Court.

Vadim Korovin: The order is not just canceled, it is canceled as follows: the 58th order was canceled the 11th, and the norm prohibiting the video introducing the permit format did not move into the 58th order, which was kindly informed by representatives of the Ministry of Internal Affairs. But the 58th order was not provided to us, because it is the same ds. In general, this is such a circus! Jan Nikolaevich will get acquainted with the case file, and a new 58th order should be presented there - they at least granted it to the court. But they will still not publish it.
Maryana Torocheshnikova: Is it normal that some department issues some kind of order for official use, and people who cannot know about its content should obey him? For example, you are a lawyer, and how can you know that the police have any special order?
Vladislav Lunkov: We received a response in the Supreme Court about the abolition of this notorious 11th order. The representative from the Ministry of Internal Affairs clearly said that this order is in no way valid for citizens. And when the judge refused the complaint that we filed, and terminated the case not on the grounds on which we insisted, he said: "He does not concern you in any way." And when we said that Jan Nikolaevich was held accountable, the judge of the Supreme Court was very surprised! He said: "And you have not appealed yet? Your decision has not yet been canceled?" - "No, everyone was scored."
Maryana Torocheshnikova: And the man served 22 days in Kutuzka, under arrest, and, it turns out, no one suffered for this punishment?
Vladislav Lunkov: We will appeal this. I think, sooner or later, someone should answer for this. The judge of the Supreme Court and the representative of the Minister of Internal Affairs say that this is illegal, this order does not apply to citizens in any way, and we have a trial protocol.
Maryana Torocheshnikova: But you won’t go to all police branches with the protocol of the court of the Supreme Court, proving the police that you can shoot!
Vladislav Lunkov: This is no longer our problem, this is the problem of society as a whole and the ministry: the ministry should bring this to its employees.
The law is always in practice
Vadim Korovin: And why not, in fact? I believe that at first the person who plans to carry out video can print the protocol (this is the Supreme Court, there is no above it!), Print the decision of the Supreme Court with excerpts of the position of the Ministry of Internal Affairs, and when the next policeman will prohibit him, you can show it to him. And the policeman will say that he has an order of the boss, and here we will have a clash of two norms.
The law always goes on practice. We will see this one, the second, third time, and then the legislator will not have anything left, except, in the end, this is allowed - at the legislative level to fix the right of citizens to exercise a video within the police departments, where it is not prohibited by other norms. The Code of Criminal Procedure prohibits the shooting in places where procedural actions are carried out, without the permission of the person carrying them out. For example, in the office there is an interrogation or confrontation - you can’t break there and shoot the video. But in the present place: in the police department, in the duty unit, where information shields hang, stands where people were brought, you can shoot.
Vladislav Lunkov: Go to any court - and there they will ban the shooting. But, having got into the Supreme Court, we fell into another state where the bailiffs and police officers help journalists transfer their cameras.
Vadim Korovin: And there wasn’t even a question there: with cameras - please come in, and that’s it. I believe that it is necessary to legislatively consolidate the fact that in the present places no official: neither the bailiffs nor the chairman of the court - no one has the right to prohibit something with their orders. You just need to cut off this business!
Go to any court - and there they will ban the shooting
Vladislav Lunkov: Now, March 23, I was as a listener in the Soviet district court of the city of Bryansk. Before that, our journalist went there. I asked him to get an audio recording or mark in writing, but he was not even allowed into the process. I was forced to intervene in the situation, and the next day already as a lawyer joined this process. I stated the application that the press is located here, we will record ... But the judge said: “Your camera (and I have a tiny one, standing on the table) will distract the participants in the process, I am very worried about them ...” Although all participants in the process said that they want to shoot! I said that the camera would stand static, will not be aimed at the chairman, if he does not want, nor at the prosecutor. But the prosecutor and the judge decided that the camera would very much interfere with the defendants.

Maryana Torocheshnikova: Maybe soon the question of shooting and video broadcasting in the courts will receive the final permit, because two weeks ago a bill appeared in the State Duma, which proposes to prohibit broadcasts from the courtrooms. If before that everything went to the openness and transparency of the judicial system, and a special law was adopted on this score, now, on the contrary, everything is collapsed. They may also adopt the law that video shooting will be prohibited in the police ...
Vadim Korovin: It is very good if such a law is adopted, because then they will have to cancel a bunch of their orders, and everything will be simplified immediately. There is an order 707 and order 1010, which determine what information should be contained in the stands. There is a federal law on the access of citizens and the openness of information: a person can go inside and get acquainted with it in any convenient way. I do not have to rewrite or memorize everything that is on the stands, I have the right to get the camera and fix it all.
Maryana Torocheshnikova: But it’s easier to ban everything so that there are no questions!
Vadim Korovin: Of course, it’s easier! And even easier to send 600 thousand to the Gulag, to get gold to the camps. But we say that the Russian Federation is a democratic country, and we, a society, have the right to demand democratic transformations and reforms. In addition, practice shows that openness is always better.

Марьяна Торочешникова: Я задавалась вопросом, почему такая дискриминация: гаишников разрешают снимать, они на это не жалуются, а обычных полицейских в обычных отделениях, оказывается, снимать не разрешается, нужно какое-то специальное разрешение.
Владислав Луньков: Прекрасно, если будет законодательно принято, что это запрещено, потому что сейчас нам нечего обжаловать. Обжаловать можно только прямой запрет.
Марьяна Торочешникова: Предлагаю перейти от присутственных мест, судов и отделений полиции к общественным местам: кинотеатрам, музеям, магазинам. Здесь все вместе - и юридическая безграмотность, и «принципиальность», потому что одно порождает другое. Если бы они знали законы, разве они стали бы сознательно их нарушать? I doubt it.
У меня есть ролик, тоже связанный с запретом съемки. Это было в "Fix Price", и там ко мне точно так же подошли люди, попытались мне запретить, но я точно так же высказала свое мнение на этот счет. Это было года два назад, и мне писали зрители: они тоже не знали, что снимать нельзя, то есть им запрещали, и они молча выключали камеру. Я тогда выложила ссылки на законы, прописала для них эти законы. Дело даже не в блогинге. Ведь закон есть закон, он один для всех.

Практика показывает, что открытость всегда лучше
Вадим Коровин: Цирк, конечно! (laugh)
Марьяна Торочешникова: Кто-то мог бы и испугаться, ведь охранники бывают очень убедительны. И как себя вести в этой ситуации? Правильно ли действовала Елена, когда снимала какие-то товары в магазине?
Ян Кателевский: У нашего друга Иванова Бориса есть много таких печальных историй. Он тоже ходит по магазинам, снимает блог о товарах, и сотрудники магазинов неоднократно его избивали, ломали ему камеру, вызывали полицию. Даже когда разбили фотоаппарат, вызвали полицию и забрали только Бориса. Он написал заявление, но дело все равно не возбудили. Это все происходило в Москве, на Арбате, причем неоднократно. И полиция считает это нормальным, когда сотрудник магазина вызывает полицию, говоря, что человек ходит с камерой. Сотрудники полиции приезжают и забирают его как подозрительную личность, непонятно зачем. Как правило, выясняют его личность и отпускают. Никаких оснований для задержания нет, протоколов они не составляют.
Марьяна Торочешникова: А чем сотрудники магазинов объясняют то, что там нельзя снимать?
Вадим Коровин: Внутренними правилами магазина. Но любой внутренний нормативно-правовой акт организации распространяется только на ее сотрудников. Все остальное регламентируется федеральным законом.

Марьяна Торочешникова: Я правильно понимаю, что владелец магазина может сказать: "это моя частная собственность, и я могу на своей частной территории устанавливать любые правила"?

Владислав Луньков: Даже не все сотрудники полиции хорошо знают законы. Мы, юристы, тоже не можем все знать. А что же спрашивать с охранника? Ну, не знает он каких-то вещей, верит старшим, ему сказали: "сиди и запрещай" - и он будет запрещать.
Марьяна Торочешникова: А в чем смысл этого запрета? Я еще понимаю, когда в кадр может попасть товарный знак, который потом захотят неправомерно использовать: тут может пострадать деловая репутация. Но закон о правах потребителей дает человеку право собирать полную информацию о товаре и услуге.
Вадим Коровин: Прежде всего, каждый предприниматель понимает, что если соблюдать все, то лучше даже не открываться. Скорее всего, они понимают, что у них есть куча нарушений. Сотрудники также это понимают, и публичность всегда чревата для них какими-то последствиями. По этой же причине нам запрещают видеосъемку.
Владислав Луньков: Может быть, они торгуют просрочкой или левым товаром, или осуществляют в магазине какие-то мошеннические действия, продают вместо золота медь и боятся, что это увидят.
Вадим Коровин: У нас в российском законодательстве такое нагромождение всякого, и, может быть, он даже не знает, что там не подметено или недостаточно освещено, но от греха подальше лучше все это убрать. Я думаю, мысли примерно такие.
Марьяна Торочешникова: Иными словами, в магазинах, кафе и ресторанах тоже можно снимать всегда и везде?

Вадим Коровин: Кроме подсобных помещений. В торговом зале, безусловно, можно.
Марьяна Торочешникова: А если человек начинает снимать ценники, они часто говорят: "Это коммерческая тайна!" Что можно на это возразить?
Вадим Коровин: Закон прямо говорит о том, что это не может быть коммерческой тайной.
Владислав Луньков: Я очень уважаю нашу полицию, но ситуация такая. Ты приходишь с камерой, хочешь снять что-либо, а тебе говорят: "Знаете, у нас сейчас такая обстановка..." Или: "А вдруг террористы?" Ребята, да они уже давно все знают, где и что находится! Если у них, не дай бог, будет задача совершить теракт, то они зайдут, а мы даже не заметим, что уже все сняли. А так люди только показывают видимость, что с чем-то борются. Давайте бороться молча, а не хватать люди с телефонами.
Вадим Коровин: В законе о коммерческой тайне есть исчерпывающий и закрытый перечень того, что может являться коммерческой тайной, а все остальное не может ею являться.
Владислав Луньков: Все, что публично выставлено и общедоступно, не является коммерческой тайной.
Марьяна Торочешникова: Да, но это может являться объектом авторских прав, например.
Владислав Луньков: К любому ценнику есть требования: там должны стоять печать и подпись, но не все это делают. И они, скорее всего, боятся таких вещей.
Марьяна Торочешникова: А вот имеют ли право в музеях или в парках брать деньги за осуществление на их территории фото- и видеосъемки, если это не профессиональная съемка?
Ян Кателевский: 29-я статья Конституции разрешает это делать. Я не вижу каких-либо законов, запрещающих копирование для себя, а не для распространения.
Марьяна Торочешникова: А на каком основании тогда требуют деньги за съемку в музеях?
Можно снимать и в медучреждениях, это не запрещено
Ян Кателевский: Я бы сказал, что это, скорее, не требование, а просьба.
Владислав Луньков: Но многие музеи действительно просят за это деньги.
Марьяна Торочешникова: И никому еще пока не пришло в голову обжаловать в судебном порядке тот факт, что музей взимает деньги за осуществление видеосъемки.
Владислав Луньков: Правильно. Мы и проводили такую аналогию. Когда мы знакомились с 11-м приказом, там было четко сказано: "С разрешения руководства". И я сказал Яну Николаевичу: "Может, надо было просто заплатить?" Мы просто прошли мимо кассы, как в музее! (laugh)
Марьяна Торочешникова: А в метро можно снимать?
Ян Кателевский: Можно. Есть правила, установленные постановлением правительства Московской области, о том, что в метро можно снимать только на любительскую технику, исключение - профессиональная техника, обусловленная определенными габаритами. Можно снимать и в медучреждениях, это не запрещено.
Марьяна Торочешникова: А как же все эти истории о праве человека на собственное изображение? Часто говорят: вы снимаете в метро, на улице, а мимо идут люди, они не хотят, чтобы их снимали, у них есть право на их изображение...
Владислав Луньков: Пускай подают в суд - какие проблемы?
Ян Кателевский: 152-я статья Гражданского кодекса говорит о том, что человек имеет право на свое изображение исключительно в том случае, если он является единственным объектом этой съемки.
Марьяна Торочешникова: То есть, если я намеренно снимаю вас где-то на улице, вы это замечаете, и вам это не нравится, вы мне говорите: "Немедленно прекратите снимать!", и я обязана перестать вас снимать. А если я фотографирую памятник Пушкину, а вы каким-то образом попали в кадр, то вы не имеете права предъявлять претензии.
Вадим Коровин: Нет, конечно! И если вы снимаете непосредственно человека, который является субъектом правонарушения, то есть он нарушил правила парковки или что-то откручивает, ворует, а он говорит: "Прекратите меня снимать, это мое право на изображение!", - то вы отвечаете: "Я имею право это снять и выложить в любое общественно-доступное место, потому что это общественный интерес". Вы снимаете в интересах общества, хотите показать, какой он негодяй и как не нужно делать.
Человек имеет право на свое изображение исключительно в том случае, если он является единственным объектом съемки
Ян Кателевский: В данном случае он совершает предположительное преступление или правонарушение, и вы фиксируете доказательства.
Вадим Коровин: Снимать вообще не запрещено, запрещено распространять.
Марьяна Торочешникова: А несовершеннолетних нельзя снимать без согласия их родителей?
Вадим Коровин: По-моему, тоже - только распространять. Но как же быть с вот этими государственными камерами, которые висят?..

Вадим Коровин: Они же не разбираются, ребенок или нет, они фиксируют все.
Ян Кателевский: В 152-ой статье прописано, что в государственных интересах гражданин не имеет права на свое изображение.
Марьяна Торочешникова: Это 152-я статья Гражданского кодекса РФ.
Вот существует Кодекс об административных правонарушениях, и там есть статья, которая запрещает проведение фото- и видеосъемки с борта авиасудна, с самолета. И за это предусмотрены административные санкции. Правильно ли я понимаю, что этот запрет тоже ограничен, то есть нельзя снимать что-то конкретное? Вообще, люди, сидя в самолете, могут делать селфи, фотографировать то, что видят из окна?
Вадим Коровин: Тут интересно, что может запретить командир борта, что может регламентировать авиакомпания, а что оставляется на откуп общему законодательству и личным правам гражданина. Это вопрос безопасности, потому что командир и авиакомпания несут ответственность за людей, которые у них на борту. И если у них есть такое правило - не снимать, значит, на это есть какая-то причина.
Марьяна Торочешникова: Можете ли вы дать конкретные рекомендации человеку, который пришел в магазин, в отделение полиции, в метро, в музей или на борт судна и решил там сделать фотографию, а ему запрещают?
Не каждый человек может отстоять свои права
Владислав Луньков: Про это снято уже много роликов. Обычно вызывают полицию. Скажу как адвокат - лучше не связываться, потому что вы просто можете пострадать. Вот Ян Николаевич пришел, снимал, и что с ним сделали сотрудники полиции? Они забрали человека, который обратился к ним за защитой своих прав! И так у нас часто заканчивается. Не каждый человек может отстоять свои права.
Марьяна Торочешникова: А если человек настроен решительно и хочет отстоять свои права, что он должен делать?
Ян Кателевский: Прежде всего, он может ссылаться на Конституцию, 29-я статья которой дает право свободно получать информацию. При любом запрете, исходящем от должностного лица, будь то продавец в магазине, сотрудник полиции или работник медучреждения, нужно требовать оснований для запрета на съемку. И если должностному лицу что-то не нравится, то пускай оно вызывает сотрудников полиции. Если сотрудники полиции или медучреждения по телефону разъясняют должностному лицу, что люди имеют право снимать, то все в порядке. Иногда сотрудники полиции приезжают, забирают человека, и ничего страшного не происходит, максимум - составят какой-то ни к чему вас не обязывающий документ и отпустят. Так что снимайте все, что хотите!
Марьяна Торочешникова: А что делать человеку, если у него в процессе дискуссии с охраной или с полицией отобрали карту памяти, заставили удалить фото и видео или сломали видеокамеру, фотоаппарат, телефон?
Вадим Коровин: Полиция и максимальная публичность того, что сделано.
Марьяна Торочешникова: То есть нужно обращаться в полицию, писать заявление? О чем, кстати? О самоуправстве?
Вадим Коровин: А пусть они сами квалифицируют.
Владислав Луньков: Квалифицировать должен следователь, это его право.
Вадим Коровин: Человек должен описать все, что произошло, какие его права были нарушены, по его мнению (нанесен ущерб имуществу или его физическому здоровью)….
Марьяна Торочешникова: А реально в этом случае добиться компенсации?
Вадим Коровин: В разных случаях по-разному.

Ян Кателевский: Нет, нереально. (laughs)
Владислав Луньков: Это зависит от доказательной базы и от того, к какому судье попадет дело.
Марьяна Торочешникова: То есть чем больше вы успели наснимать в процессе, тем лучше для вас.
Владислав Луньков: Видео в любом случае является доказательством, но это не безусловное доказательство. У нас в процессе, когда Яна Николаевича пытались осудить, сотрудники полиции говорили: "Да, здесь изображен я, я разговариваю с Яном Николаевичем". А председательствующая судья сказала: "Я не верю этому". И не стали принимать…
Вадим Коровин: Последний случай в Саратове: двое сотрудников ГИБДД препятствовали видеосъемке гражданина, которого они привлекли по административке. Он стоял в пункте ДПС и снимал телефоном, а они его заломали, надели наручники, отобрали телефон. Двух сотрудников ГИБДД привлекли к уголовной ответственности по статье "Превышение должностных полномочий", и все.
Марьяна Торочешникова: То есть, осуществляя съемку, вы реализуете свое право. Другое дело, что, может быть, придется и штраф заплатить, и под арестом посидеть...
Вадим Коровин: Да, подумайте о последствиях. Очевидно, что в обществе назрела необходимость на это право: людям надо чаще, больше, всегда и везде снимать, чтобы фиксировать нарушение своих прав. Право идет за практикой. А практика идет к тому, что нам это нужно все больше, поэтому право будет прогибаться, то есть законодатель будет идти на поводу у общества, исполнять его потребности.
