In Kaliningrad, a real estate agency sold the apartment of a pensioner who suffered from partial memory loss, the press service of the regional prosecutor's office reported . The elderly man now lives in a night shelter.

The pensioner lived alone in a two-room apartment on Sovetsky Prospekt. The man owned half of the apartment, the second part of the share belonged to his daughter living in Germany.

In the spring of 2016, neighbors noticed that an elderly man was missing and contacted the police. He was found only a few months later, in May. Due to partial memory loss, the pensioner could not explain where he had been all this time.

His apartment was occupied by a new owner - the man claimed that he had acquired half the share. An investigation by the prosecutor's office showed that an agreement to purchase a share in an apartment for 860 thousand rubles was concluded with a real estate agency, which is located in the same building where the pensioner lived.

“None of the representatives of the real estate agency could explain who approached them about the sale of this residential premises, who presented the documents and the key to the apartment,” said the press service of the prosecutor’s office.

The second share of the apartment, as it turned out, was sold in May. An unknown woman brought the pensioner to register the transaction in a wheelchair. He could not independently write a receipt for receiving the money due to severe hand tremors, but the buyer did not attach any importance to this.

To circumvent the requirements for the daughter’s right to buy out the remaining share in the apartment, the realtors entered into two agreements - an agreement of donation of 1/20 of the share and purchase and sale of 9/20 of the share. For this, the pensioner allegedly received 690 thousand rubles, but in fact he was given a plastic bag, the prosecutor’s office established.

The prosecutor of the Central District of Kaliningrad went to court demanding that the apartment be returned to the pensioner. A forensic psychiatric examination showed that at the time of signing the contract, the man was in such a state that he could not understand the meaning of his actions and control them.

The court invalidated the purchase and sale agreement and the apartment donation agreement and returned the ownership of half of the apartment to the pensioner. The fact of the transfer of 860 thousand rubles from the new owner of the apartment was considered unestablished.

The court decision has not yet entered into legal force. Due to the fact that the apartment is occupied by a new owner, the pensioner still lives in the night house.

Earlier, in the city of Svetly, Kaliningrad Region, a court evicted a large family from an apartment due to mortgage debts. The administration was unable to provide the family with temporary housing.
