On Tuesday, the Presnensky District Court of Moscow began consideration of a criminal case against three police officers accused of criminal inaction during the conflict at the Elements restaurant in 2015, which led to the death of two people, the detention of an influential “thief in the law” of Zakhary Kalashov (Sharro young) and a scandal in the Investigative Committee. The owner of the restaurant Zhanna Kim did not come to court, saying that he lives in Kazakhstan and plans to participate through his representative in the process.

On Tuesday, the Presnensky court was strengthened by security measures: at the entrance to the building, a string of visitors lined up, which the bailiffs looked literally in every pocket. The meeting in a crowded stuffy hall began with a serious delay. Judge Tatyana Vasyuchenko immediately entered the skirmish with lawyer Andrei Averin. She reported him for being late and muttered: "Your plans for the day are not interested in me." The judge turned to her assistant much more affectionately: "Sashulya."

Averin, a tall bearded man in a Ray-Ban costume and dark glasses, represents the interests of the accused Denis Romashkin, who categorically does not admit guilt. When the judge certified the identities of the accused and called Romashkin the temporarily acting chief of the criminal investigation department of the Presnensky police department, he immediately corrected: “According to investigators”. He himself proves that at the time of the conflict on Rochdelskaya he had already issued a transfer to a new place of service - in the Hamovniki police department. The lawyer notes that during the incident in the restaurant, in fact, the head of the district criminal investigation department on Presny was already another person.

Romashkina, the operative of the Presnensky Department of the Department of Internal Affairs Ildar Shakirov and the district authorized Presnensky district of Renat Zinnatulin was arrested in August-September last year on charges of negligence (Article 293 of the Criminal Code, up to seven years of imprisonment), which was soon re-qualified for a more stringent punishment of the article on abuse of abuse official powers (part 3 of article 285, up to 10 years). In the indictment, which the prosecutor Dmitry Dyadur read at the meeting, it is said that the defendants "committed abuse of power in the form of inaction."

According to the prosecution, the criminal inaction of the police took place in the late evening of December 14, 2015 on Rochdelskaya Street in the Presnensky district of Moscow - a couple of minutes to walk from the Government House, next to the three -born manufactory. According to investigators, on that day, the operative of Shakirov carried daily duty. At 20:36, the operational duty officer received a message from the owner of the Elements restaurant Jeanne Kim, who told about the visit to the institution of “suspicious citizens”. Shakirov went to Rochdel, calling his leader and friend Romashkin, who, in turn, says that at that time he was not in performance, had no weapons with him and responded to his colleague's call only on friendship.

A quarter of an hour later, Shakirov arrived in elements , and a district Renat Zinnatulin got there for another half an hour. At 21:50, at the entrance to the restaurant, a fight began “using violence in the form of blows and hands”, and then traumatic weapons. Budantsev’s subordinates received light gunshot wounds; The lawyer who was tumbled to the ground went more: a closed fracture of the lower jaw, bruises of the head, a concussion, a massive paraorbital hematoma, dull injury and hemorrhage into the vitreous body of the left eye. Budantsev, with a swimming eye, which the former special forces FSIN, Roman Molochaev, who was located on the site of the conflict, grabbed from a conflict, grabbed the Beretta 92 pistol and opened fire. He was supported by colleagues. As a result, two members of the Shakro young brigade were killed, demanding a penalty; A few were injured.

According to the prosecution, not preventing the massacre on Rochdelskaya, police officers violated the interests of society and the state, which "was expressed in discrediting and undermining the authority of the internal affairs bodies."

Romashkin and Shakirov refused to admit the guilt from the very beginning, who received a refusal to the special order of the consideration of the case Zinatullin, after that, also decided not to admit guilt.

Jeanne Kim through her representative Irina Vareev handed the judge a statement with a request to consider the case without her participation and recognize her as a civil plaintiff. Kim explained that now she lives in Kazakhstan and was not going to come to Moscow. The term of detention of police officers previously extended until September 2. According to Averin’s lawyer, the process will definitely take all summer: about 70 witnesses will have to be interviewed, the meetings will be held once a week.
