The Mathematics Case Dmitry Bogatov is the clear success of our special services: they have long been operated by factories of extremist content, suspects can be chosen at random

On Monday, April 10, the Hall of Judications No. 17 of the Presnensky District Court of Moscow resembled a scene from a crazy thriller. I got the impression that neither the judge, nor the prosecutor, nor the investigator, and even more than the friends and relatives of Dmitry Bogatov, who came to the court session, did not believe in the involvement of the 25-year-old teacher of mathematics in the commission of the crime of which he was accused. And Judge Yevgeny Naydenov, and an employee of the Moscow prosecutor's office, Eduard Bogdasarov, and even an investigator for especially important cases of the Moscow department of the Investigative Committee of Rakilov, who came to the court in front -line form with the brand new captain’s epaulets, almost the entire court session sat, bashfully buried in papers.

The operatives and investigators seemed to establish that the “call” to go on April 2 to the Manezhnaya Square with the demand for “systemic changes in the country” was marked by the user under the nickname “Ayrat Bashirov” and that he uses computer programs (for example, the Tor program), allowing to hide the real IP address. During the court session, it turned out: the user “Bashirov” all the time posted comments and texts from different IP addresses, whose account exceeded seven hundred. And they are supposedly in the Netherlands, Latin America, Japan. But, as investigators believe, despite the tricks of Bashirov, he was able to calculate and detain him. Information appeared on the website of the Investigative Committee that the suspect was charged under Part 3 of Art. 212 of the Criminal Code of the Russian Federation ("Calls to the riots").

Light target

Yes, indeed, the Tor program is installed on the home computer of Bogatov. As the IP specialists explained, Dmitry could use Tor to enter, for example, to the Rutracker.org resource, which allows you to download films, music, books, software, games. To accelerate the work of the Tor program, without pursuing any reprehensible goals (or even by chance), Dmitry could turn on the Exit Node mode, which makes his personal IP address accessible to everyone who at the same time uses the Tor program. So Bogatov turned into a light target for fighters with extremism.

This was obviously understood by the court: on April 7, the federal judge of the Presnensky district court, Yevgeny Naydenov, did not dare to give a sanction for the arrest of the detainee - he issued a decree on a "subscription of a lower leave".

The TFR was offended, and despite the fact that the Code of Criminal Procedure (the Criminal Procedure Code) obliges to immediately execute such decisions, April 7, Bogatov left the court in handcuffs and under escort. He was again taken to a temporary detention center. And already on Saturday, April 8, Bogatov was charged with a new accusation, more severe. However, according to the same “facts” the alleged placement of calls to them to go to the Manezhnaya Square and demand “systemic changes in the country”. This time, the charges were made under part 2 of Article 205.2 of the Criminal Code of the Russian Federation (“Public calls for terrorist activities using the Internet”), which provides for a punishment of up to seven years in prison. And in the materials of the criminal case there was a preliminary conclusion of the Institute of Linguistics of the Russian Academy of Sciences, whose experts found in the text posted on the Internet on March 29 (at 22 hours 25 minutes) signs of calls for the “implementation of terrorist activity”.

The presumption of involvement

On April 10, when Bogatova was again taken to the Presnensky district court, the prosecutor Bogdasarov read: “Calls to the riots entail social tension in society, so one of their initiators should be in custody.” Nobody argues with this. Except, perhaps, the defense of Bogatov, who recalled that the decision of the Plenum of the Supreme Court of Russia obliged the district courts when electing a preventive measure to find out whether the suspect was really involved in the crime. What the investigator and the prosecutor objected, dashingly replacing the legal concepts of “guilt” and “involvement”: they say, now the petition is considered to choose a preventive measure, and not the guilt of the suspect. Judge Naydenov agreed and refused to protect the case of evidence of Bogatov’s non -involvement in the case materials to post a appeal with a call to use bottles with Molotov cocktail, gasoline, tires ...

The proof is actually very “serious”. Back on Friday, Bogatov told the court that he could not place the text incriminated to him on April 29 at 22 hours from his home computer because he was in the gym with his wife, and after training he went to the food store. And he returned home without a quarter eleven.

Bogatov’s lawyers got a video from the surveillance cameras of the store, which confirms Alibi of the suspect. The video recorded that Bogatov and his wife left the store four minutes before the recording appeared. And it was still necessary to get home, having passed one and a half kilometers.

Let me remind you that Bogatov was detained and taken to a temporary detention center on the night of April 5 to 6, immediately after a search in his apartment. Since April 6, he had no access to the computer or the Internet. And the user under the nickname "Ayrat Bashirov" continues to leave comments on the very site where he posted the "appeal" on April 29. On April 11, for example, he marked several comments in the topic “Ayrat Bashirov was arrested! So follow the bazaar ... "

Extremism factory

As the specialists-computer workers and sources in the FSB told me, the site on the forum of which the user under the nickname “Ayrat Bashirov” posted the appeal “We demand systemic changes in the country” was registered in April 2003 and for fourteen years of work became popular among system administrators. But not only among them. The forums of the site have long been monitoring law enforcement agencies. First of all, employees of the FSB information security center and a similar unit of the Ministry of Internal Affairs. All my interlocutors agreed that the old -timer of the forums (Ayrat Bashirov user) with his frankly provocative comments had to attract the attention of law enforcement agencies for a long time. And the fact that he has not yet been calculated and not neutralized may indicate that

“Ayrat Bashirov” or recruited by the special services and works “in the interests of the Motherland”, or he wears epaulettes, filling the forum with comments in service times.

Why is this necessary? My sources shared the assumption. “Ayrat Bashirov”, provoking someone to actions that clearly fall under the articles of the Criminal Code, provides special services with “Working Material”. And the computer scientist who “pecked” at the provocation has practically no choice: either become a defendant in the criminal case and get a criminal record, or agree to cooperation with special services ...

I specially registered on this site, which turned out to be not so simple. The administrators demanded that I indicate my e-mail. At the same time, I did not suit the address on the Mail.ru servers, they demanded that I indicate the mailbox open to gmail.com. Which I did. Having registered on the forum, he wrote to Ayrat Bashirov. And he answered me: in a short message of four words, the three words turned out to be abnormal.

My sources said that the site administration, on which Ayrat Bashirov posted its appeal, would not be articulated and, if law enforcement agencies are applied, would immediately provide all the user registration data, including the address of his mailbox on Gmail.com. And Google, which owns this server,, with official appeal, would hardly have to hide the data of a terrorist orientation of the suspect in committing a crime. In the case, which considered the Presnensky district court on April 10, there are no traces of such requests. That is - this option is not needed?

Apolitical prisoner

April 10, before the trial, I talked with Bogatov’s mother, with his wife, sister, friends. And they all unanimously claim: Dmitry is an absolutely apolitical guy. He never went to rallies and pickets, stopped any talk about politics. In addition to mathematics, he was generally not interested in little. After school, Dmitry entered the Mechanical and Mathematics Faculty of Moscow State University, then he received a degree at the Faculty of Physics at the Moscow State Pedagogical University. He worked at the Russian representative office of Samsung as a software developer, then in Skontel. Since 2014, he taught mathematics at the Moscow Financial and Legal Academy (MFUA).

But the Presnensky District Court of Moscow gave sanction for the maintenance of Dmitry Bogatov in the pre -trial detention center until June 8. And Bogatov became the first political prisoner to completely not be interested in politics.

When the federal judge Evgeny Naydenov announced the decision, the mother of Dmitry Margarita Bogatov fainted, and his stepfather squeezed his teeth. To him, the Alpha veteran, the backward Major of the FSB, who neutralized more than one terrorist, probably, was more uneasy for the fact that a person close to him by the name of the Russian Federation was called suspects in calls to terrorism.
