
The ECHR ordered Russia to pay 409 victims with a terrorist attack in Beslan compensation for a total of 2 million 955 thousand euros, as well as reimburse 88 thousand euros of legal costs. The decision made on Thursday is published on the website of the Strasbourg Court.
Seven claims filed by the victims were combined into one production. Russia has found guilty that it has violated in relation to the applicants of Article 2 (right to life) and 13 (the right to an effective means of legal protection) of the European Convention.
As stated in the decision, the authorities during the assault on the Beslan school No. 1, captured by the Chechen separatists, did not take measures to minimize the risks for hostages. In the future, the circumstances of the attack and the causes of the death of people were not investigated.
The ECHR also recognized as proven that the Russian security forces had information about the terrorist attack at the stage of its preparation.
According to TASS, the press secretary of Vladimir Putin Dmitry Peskov criticized the withdrawal of the Strasbourg Court that Russia did not take sufficient measures to prevent a terrorist attack. “It is impossible for us to agree with such a wording - a country that has repeatedly been attacked by terrorists,” the official said.
Later, the Ministry of Justice said that he would appeal the decision. "A number of findings of the European Court are unfounded, and the used argumentation is unconvincing and does not correspond to the evidence represented by the Russian authorities," the department said.
An indication of the ECHR on the “lack of written registration of orders and orders of the operational headquarters”, according to officials, “indicates a clear misunderstanding of the judges ... the whole severity of the situation in Beslan, as well as the specifics, features and risks of the process of conducting law enforcement agencies of the rescue operation”.
The conclusion about the use of heavy weapons by the security forces in the Ministry of Justice was called "absolutely groundless." At the same time, the department referred to "the results of the thorough work of the investigating authorities, which significantly established the absence of the affected by weapons with special services."
On the morning of September 1, 2004, more than 30 Chechen separatists under the command of Rasul Khachbarov (Colonel) captured the Beslan school No. 1 during the line on the occasion of the start of the school year. Armed people who arrived on a truck covered with an extension opened automatic shooting over the heads of the audience and driven almost everyone into the school building - mostly to the gym. After that, they mined the gym. In the next two days, almost all male hostages were shot.
On September 3, around noon, a car with four employees of the Ministry of Emergencies drove up to the building, who were supposed to take the bodies of the killed hostages. At that moment, explosions were heard at the school, after which random firing began on both sides, and children and women began to jump out of the windows and the gym formed in the wall of the gym.
334 people became victims of the attack, including 318 hostages, of which 186 are children. In addition, 10 FSB special forces, two employees of the Ministry of Emergencies and 15 policemen were killed. 810 hostages, as well as special forces by the FSB, police and military, received injuries.
Almost all participants in the capture during the assault were killed. Only one remained alive - Nurpashi Kulaev. He was condemned by a life sentence.
The victims filed complaints with the ECHR in June 2007 - May 2011. July 2, 2015, the court recognized most of the complaints justified . At the same time, however, the judges rejected the charges against Russia under Articles 3 (prohibition of torture), 6 (the right to a fair trial), 8 (the right to respect private and family life) and 10 (freedom of expression) of the European Convention.
On September 1, 2016, at school No. 1, five activists of the Beslan Voice Committee - local residents, whose children died or were injured during the assault on the school were detained. They came to the gym in T -shirts with the inscription "Putin - the executioner of Beslan." All participants of the action were appointed fines or mandatory work.
