The story of a mathematics teacher of the Moscow Financial and Legal Academy Dmitry Bogatov, to which he most likely has nothing to do, began after March 26 this year.

The organizers of the action for a long time remained unknown. As requirements, they resigned Prime Minister Dmitry Medvedev, the termination of military operations in Syria and Ukraine, the justification of Alexei Navalny and moral compensation to all detainees at Sunday rallies.

Most likely, this is a fake account, since all the personal photos of the girl are copied from another account-22-year-old Julia Kovazhenkova from Nizhny Novgorod. In a conversation with Znak.com, Kovazhenkova confirmed that this is her photographs and she often meets them in various fake accounts, but she does not bother her.

The suspicions that these calls are provocation appeared among Internet users almost immediately, as soon as information about it began to be pushed in all official media. It is true, it is strange-someone collects someone for the action, thousands of people support it, but none of the “experienced” oppositionists know anything about her. And so, having neither suspects, nor the fact of a violation, the metropolitan administration of the Investigative Committee of the Russian Federation (TFR) on April 1 initiates a criminal case of calling for mass riots on the fact of calls that appeared on the network to participate in an unauthorized action in the center of Moscow on Sunday.

“The investigating authorities of the Main Investigative Department of the Investigative Committee of the Russian Federation for the city of Moscow opened a criminal case on the grounds of a crime under Part 3 of Art. 212 of the Criminal Code of the Russian Federation (call for mass riots), ”the representative of the headquarters Julia Ivanova told reporters of official publications. The suspicions of the investigators, based on the IP address of posts posted on the Internet, turned out to be for some reason more significant evidence of Bogatov’s innocence recorded on video from surveillance cameras.

The investigation asked the court to introduce a letter from the FSB of Russia to the case. It states that, according to the Institute of Linguistics of the Russian Academy of Sciences, Bogatov’s posts “contain calls to carry out terrorist activities and riots”. The investigation also reported that Bogatov has a passport valid until April 6, 2021, and that he was allegedly going on a trip to Italy. The court considered that Bogatov could prevent the investigation and hide, and arrested him until June 8, 2017.

The only evidence of the investigation - the network address (IP), which Irat Bashirov once used - he belongs to Dmitry Bogatov. The use of the network address Dmitry’s protection explains by the fact that Bogatov has an output node of the Tor network on the computer, that is, he provided his address to everyone who strives for anonymity on the Internet.

Sysadmins.ru, publications from which Bogatov is in guilty, is one of the oldest active forums in Runet. The forum was opened in 2001 by two system administrators from Moscow. One of them - Peter "Sklif" Bocharov - is still actively engaged in it.

The forum has three Ayrat Bashirova. They portray themselves of democrats-radicals, insult other forum participants, publish their personal data. The name Ayrat Bashirov has been borrowed from the system administrator from Ufa, a forum participant since 2004. In the signature, the Ayrats Bashirovs use a joint photograph with the wife of another ITSHAN from St. Petersburg, as well as Nazi symbols.

“Some time ago, new accounts registered for real user names began to appear,” real Ayrat Bashirov from Ufa told reporters. - The names of the attackers learned, for example, finding photos from the forum in social networks. Of these accounts, extremely marginal materials fasted from under these accounts, in fact, the goal was to annoy the person whose name was used. ”

Bocharov has been living in Barcelona for four years. The Tor network confuses the Internet connection, distributing it randomly through the nodes located around the world. It also allows access to the “deep web” - the Internet segment inaccessible to search engines.

When using Tor, the site owner or supervisory authority see only the last network address in the chain - output node. The number of weekends Tor changes, at the time of publication there were more than 800 of them. The dozens of weekends are located in Russia.

Dmitry Bogatov opened his outlet node on July 19, 2015 (now it does not function for obvious reasons). From this moment, Irat Bashirov (the oldest account, which is now suspected of extremism) left 2120 messages on the forum, only 630 before - only 630 years.

It turns out that through the output node, Bogatov should have passed at least two messages of Ayrat Bashirov. The probability that an extremist appeal has passed through this knot is less than a percentage, but this is not affirmed in the case.

At the court to choose a preventive measure to Bogatov, his lawyer Alexander Mordvinov tried to draw the attention of the judges to the fact that the investigators limited themselves to verification of only one of the 750 network addresses, from which, according to his data, Irat Bashirov wrote.

Most of these addresses, according to a lawyer, are located in the Netherlands, Japan, the USA and other countries where there are many weekends of Tor. One of the messages was posted from the network address in Podolsk near Moscow. But the investigators checked only the Moscow address and thus reached Bogatov.

On April 10, lawyer Mordvinov explained this by the fact that Moscow investigators did not want to investigate the case in the improper territory. Mordvinov wanted to dwell on this issue in more detail, but the judge interrupted him, saying that the court was deciding only to the extent of the restraint and did not consider the case on the merits.

“This is a very dangerous precedent,” Stanislav Shakirov, the technical director of Roskomsvoboda, characterizes the case. “This is the first case in my memory in Russia: a person is arrested for the fact that the attacker went on the Internet through his output node.”

Представители инициативной группы, выступающей в защиту Дмитрия, в своём Telegram-канале рассказали , что следователя смутили «не те компьютеры, которые мы [следствие] привыкли видеть» и что «там были программы, которые мы не знаем». Продлили срок содержания якобы для того, чтоб закончить компьютерную экспертизу, а на свободе Дмитрий «уничтожит улики, сбор и фиксация которых на данный момент не завершены».

Ранее защита представляла суду характеристики от проекта Debian , с которым сотрудничал Богатов, заявление от родственников с просьбой внести за него залог, а также обращение от президента международной ассоциации ветеранов подразделения антитеррора «Альфа» Сергея Гончарова. Все эти аргументы суд последовательно отклонял. Следствие по делу Дмитрия Богатова отказалось приобщать к материалам дела результаты проверки на детекторе лжи

Следствие в своём ответе называет проводившуюся с Дмитрием процедуру прохождения полиграфа «манипуляцией», а также делает вывод о заинтересованности полиграфолога, поскольку он получил от обвиняемого вознаграждение за оплату своих услуг.

«Довольно печально, что пришлось более 3 месяцев держать человека в СИЗО и еще 5 месяцев под домашним арестом, чтобы в результате выяснить полную непричастность Богатова к размещенным постам и инкриминируемым преступлениям. И это несмотря на то, что у него было железобетонное алиби, подтвержденное камерами магазина и данными систем контроля фитнес-центра, результаты независимого полиграфа, полностью исключающие его причастность к постам, а также подтвержденные открытые сведения, что он являлся оператором выходного узла Tor. Но все это казалось следствию неубедительным.
Результаты компьютерно-технической экспертизы для нас были очевидны. Теперь же после того как эксперты авторитетного для российского следствия учреждения подтвердили отсутствие хоть каких-либо цифровых доказательств его причастности к совершенным деяниям, мы будем настаивать на скорейшем снятии всех обвинений с нашего подзащитного и его полной реабилитации за довольно сложное время, которое ему пришлось пережить из-за некомпетентности тех, кто это дело вообще против него возбудил», — адвокат Дмитрия Богатова, глава юридической практики РосКомСвободы Саркис Дарбинян.

Следователи не стали продлевать Богатову домашний арест

Саркис Дарбинян сказал, что 30 января — последний день для подачи ходатайства о продлении меры пресечения. 31 января истекает срок меры пресечения.

«Следствие отпустило из-под домашнего ареста Богатова в связи с отсутствием оснований для продления ему меры пресечения», – цитируют журналисты источник в Следственном Комитете РФ. В Пресненском суде Москвы подтвердили, что ходатайство следствия о продлении меры пресечения Богатову в суд не поступало.

Чуть позже Татьяна Фёдорова сообщила, что Дмитрия выпустили из-под домашнего ареста под подписку о невыезде до конца марта.

Математик Богатов допрошен Следственным комитетом уже в качестве свидетеля

Московский математик и бывший «узник Tor» Дмитрий Богатов дал свидетельские показания по уголовному делу о призывах к терроризму и попытке организации массовых беспорядков, сообщил адвокат Алексей Тепцов: «Мой подзащитный сегодня дал показания СК, что на его компьютере действительно стояло программное обеспечение Tor, и он в связи с этим не контролировал тех лиц, которые могли размещать любой контент в сети интернет, что успешно было подтверждено проведенным расследованием».

Адвокат уточнил, что его подзащитный проходит в статусе свидетеля и «дальше следствие будет идти своим путем» без участия Дмитрия Богатова. «На этом поставлена большая процессуальная точка»,— заявил он.

Супруга Дмитрия, биолог Татьяна Фёдорова, выразила надежду, что на этом инцидент исчерпан и больше у властей нет к Богатову никаких претензий: «Вот теперь Дима совсем отстрелялся. Надеюсь, он никогда больше не переступит порог Следственного комитета».
