At the same time, the defense claims that only one of the IP addresses from whom they entered the account corresponds to the apartment of Bogatov. This IP address belonged to the Tor network of the Tor network, which operates on the Bogatov’s computer, so any anonymous network user who connected to the node could write a message.
Bogatov was detained on the night of April 6. Initially, he was charged with part 3 of Article 212 of the Criminal Code (calls to riots), the punishment of which provides for up to two years of the colony. On April 7, the judge of the Presnensky District Court of Moscow Naydenov refused to arrest Bogatov, since the crime imputed to him is of small gravity.
Despite the court decision, the detainee was not released . Instead, Bogatov’s case was retrained by submitting mathematics to the charge under Part 1 of Article 30 - Part 1 of Article 212 (preparation for the organization of riots) and part 2 of Article 205.2 of the Criminal Code (public calls for terrorism via the Internet). The maximum punishment on the first prosecution is seven and a half years of the colony, the second - seven years.
On April 10, after retraining of the prosecution, the same judge Naydenov arrested Bogatov until June 8.
