Handcuffs plus night court = 1 thousand rubles

On April 29, after the dispersal of the action #I was tired in St. Petersburg, Idrisov went to the police department No. 22, where more than 16 people were delivered (more than 110 people were detained in the city). When Idrisov arrived there, about half of the detainees remained in the department. Among them was activist Ekaterina Prokopovich, Idrisov had a power of attorney, giving him the right to represent her interests as a defender. At this point, the detainees were in the department more than three hours laid according to the law, and some began to draw up protocols under Part 5 of Art. 20.2 Code of Administrative Offenses (violation by a participant in the public event of the established procedure for holding a meeting, rally).

The obstacles of the human rights activist began to be repaired on the threshold: the department employee refused to let him even into the duty unit and tried to tear his mobile phone out of his hands. Idrisov was forced to remind the policeman that the order prohibiting the shooting in the police departments was canceled (since then, however, the shooting in the departments has still become a reason fordetentions ).

Idrisov wrote a statement to the head of the department to the police lieutenant colonel Nikita Kamenshchikov due to the fact that they refused to let him go. At this time, Ekaterina Prokopovich appeared in the duty unit along with the police captain, who refused to introduce herself to Idrisov and explain why Prokopovich was held in the department. The captain did not answer questions at all, and most of his time stood his back to Idrisov, blocking his path to the department. They were going to draw up a protocol on Prokopovich, but Idrisov insisted that after three hours she had the right to leave the department. He also demanded that the rest began to let go.

The employee on duty told Idrisov that he had handed over his application to the deputy chief Petrov. Other employees assured that Petrov would go down, but no one went down. Later, the head of the department in the court claimed that they did not have an employee by the name of Petrov in the department. The duty officer insulted Prokopovich, saying that she was ready to sell her mother for money.

While Idrisov and Prokopovich were waiting in the duty unit, it turned out that the activist at the same time draw up protocols under Art. 19.3 Code of Administrative Offenses (disobedience to the legal order of a police officer) - this article admits an arrest as a possible punishment, and the detainee, who is drawn up for this article, can be held in the department until 48 hours. Thus, according to Idrisov, police officers came up with an excuse not to let her go.

"Take, meet, hug, kiss"

Later, other detainees appeared in the duty unit. They did not leave, because they did not give a copy of the protocols. The light in the duty unit where people were located turned off (later they explained that the accident was in the department). Prokopovich did not return their passport (then the police claimed that they did not give her a passport for gross expressions to the policeman). Tired of waiting, Idrisov, along with Prokopovich and another detainee, Ivan Hutsulyak, went inside the department and, going into one of the offices where the lights burned and there were people, began to ask who the elder, why they hold people and did not give the documents. He was not answered, they demanded to get out of the regime room and stop the video (all this time Idrisov led a direct Internet broadcast of what was happening from the phone), after which he was twisted, tilted to the floor and put on handcuffs . On the record posted on Idrisov’s page on Facebook, you can hear how he shouts that he was painful, and demands to return personal belongings.

At the court, the head of the department claimed that Idrisov (whom he described as a “man of incomprehensible appearance”) burst into his office, where a working meeting was held, scaring a minor who was there (Idrisov tried to find out why the child was in the evening at the evening, but the judge took off the question), as well as the boss himself. The boss, in his own words, “politely, correctly” ordered Idrisov to go out, pointing him with his hand “the path to the bright”. He allegedly went to the dressing room, after which he immediately returned, then the boss allegedly said to two police officers: “Accept him,” but did not see the detention. To the question of Idrisov, what it means to “accept”, Lieutenant Colonel Kamenchikov replied: “Take, meet, hug, kiss - who understands.” The boss also said that Idrisov was in the office only with Prokopovich. In addition, Kamenshchikov said that his assistant Vishnevsky took the phone from Idrisov and returned after ten seconds. The selected phone Idrisov was really returned, but not at once.

On Idrisov, a protocol under Art. 19.3 Code of Administrative Offenses and left for the night.

A lawyer came to one of the detainees, they also refused to let him go. The members of the public observation commission were not allowed . Idrisov told the OVD-Info that the attendants closed the doors and windows from the inside. By midnight, all the detainees, except Idrisov and Prokopovich, were released. The handcuffs were removed from Idrisov, but for several hours they did not make protocols. He saw the protocol only at five in the morning, after more than seven hours after the detention.

Idrisov is a member of the territorial election commission with a ruling vote, so he had no right to detain him without the sanction of the prosecutor. The police claimed that they could not get through to the duty prosecutor. Idrisov’s statements about unlawful actions refused to accept.

In the fortress

Since the department continued to be at the department (representatives of the associations of Russian carriers joined the former detainees), police officers called the Russian Guard and machine gunners, the head of the investigative department was arrived by Less Division Roman Fedorov, who accused the audience of an inconsistent campaign. Then, already at about three in the morning, a lawyer was allowed to Prokopovich. But the defender Ksenia Mikhailov, who came to Idrisov, was not allowed, announcing the “Fortress” plan in the police department.

Idrisov later told the OVD-Info that he was on his feet until seven in the morning. He was fed (the boss personally brought him coffee and sandwiches), but they did not take him to the toilet, referring again to the accident.

On April 30, Prokopovich was taken to the Petrograd District Court, where they fined under Art. 19.3 Administrative Code for 500 rubles. Meeting under Art. 20.2 Administrative Code postponed.

Idrisov had to be taken to the Krasnogvardeisky District Court. But the court returned the case , since the detention of Idrisov was never authorized by the prosecutor. After this, the police managed to achieve the sanction of the prosecutor to detain and the possible arrest of Idrisov, but, as the OVD-info told the Idrisov himself, the city prosecutor did this in violation of the law, because he did not indicate the motivation: according to the law, the prosecutor is obliged to evaluate whether he will arrest the member of the tic of damage to public interests.

Meanwhile, the cordon was organized around the Red Guard Court. Idrisov was taken to court, and they did not let visitors go (the same thing happened in Petrograd). Later they were still allowed.

And together we met dawn

The meeting began in the evening and was intermittent until the early morning. Judge Sergei Kulakov rejected most of the petitions of Idrisov and the defender, including requests for video resolution, to attract the prosecutor to the process, the call of Prokopovich and Gutsulyak as witnesses, on the introduction of records from video surveillance cameras in the police department. From one of the police officers, Idrisov called to the court in the court of the court heard that the decision on his arrest was already ready.

The court listened to the head of the Kamenshchikov department, who claimed that his office was a regime object, but at the same time referred to a secret order and refused to state it. When asked whether Idrisov’s statement received Kamenchikov about the prevention of his activities in the department, the boss replied that he did not remember.

After the interrogation of the chief, the judge satisfied the request of the defender and postponed the meeting on May 2. It was already five in the morning. Idrisov was free.

On May 2, Idrisov was supposed to act as a witness in another court - in the city of Vsevolozhsk, the Leningrad Region in the case related to the scandal around the elections in the village of Morozov. In this regard, the defender Mikhailov on May 2 brought to the Krasnogvardeisky court a petition and Idrisov on the transfer of a meeting. Mikhailova herself on this day participates in another process. The petitions were about the need to collect evidence and witnesses. However, Judge Kulakov instead examined the case in the absence of both Idrisov and Mikhailova.

Idrisov, having learned about this from eyewitnesses, shared the assumption with the OVD-info that the court intends to make a decision on his arrest, then they began to look for him. He recalled that the case under an article involving arrest as a possible punishment cannot be considered in the absence of an “offender”.

However, on the same day, the court limited himself to fining Idrisov by a thousand rubles.
