The ECHR again demanded that Russia allow lawyers to see the person involved in the “Bolotnaya case”

The European Court of Human Rights again demanded that Russia allow lawyers to see Ivan Nepomnyashchikh, convicted in the Bolotnaya case, and other prisoners of IK-1 of the Yaroslavl region who complained of beatings. This is a repeated request from Strasbourg. The court is also seeking an independent medical examination of those convicted. This was reported by Radio Liberty with reference to the lawyer of the Public Verdict Foundation, Irina Biryukova.

The Ministry of Justice responded to a request from the ECHR demanding to explain the reason for the “failure to comply with interim measures.” This is stated in a message from the Ministry of Justice received by RBC.

According to the Ministry of Justice, on May 4, Russia “informed the ECtHR about the successful compliance with interim measures applied in accordance with Rule 39 of the Rules of the European Court in complaint No. 31236/17 “Vakhapov and others against Russia”, filed by prisoners Nepomnyashchikh, Makarov and Vakhapov. The department noted that public discussion of the content of the document, which is sent on behalf of the Russian authorities to the ECHR, “is not practiced.”

“As far as we know, the Russian authorities have not fulfilled a single point regarding the use of urgent interim measures, in accordance with the 39th rule,” Irina Biryukova commented on the situation in a conversation with RBC.​

According to defense attorney Sergei Sharov-Delone, on April 21, a special unit of the Federal Penitentiary Service entered the territory of IK-1, whose employees, “according to an established habit,” beat those who were in the colony’s isolation ward at that time. Before this, it became known that Nepomnyashchikh was placed in a punishment cell in the colony for 7 days. The next day, a search took place in the camp, during which the “masks” beat people in the detention center. Immediately after this, Nepomniachtchi and several other prisoners were transferred to a specially isolated part of the punishment cell - the “island”.

On April 28, information appeared that Ivan Nepomnyashchikh was never released from the punishment cell, and he was given another eight days of imprisonment there.

Earlier it became known that the Strasbourg court ordered the Russian authorities to provide, within two days, an independent medical examination of convicts serving their sentences in the Yaroslavl colony I. Nepomnyashchikh, Ruslan Vakhapov and Evgeniy Makarov.

Despite the demands of the ECHR, on May 2, defense lawyers Yakov Iontsev (“Public Verdict”) and Sergei Sharov-Delone (“Rus Sitting”) were not allowed to see the beaten prisoners. The lawyers came to meet with their clients: the defendant in the “Bolotnaya case” Ivan Nepomnyashchikh, Ruslan Vakhapov and Evgeny Makarov. At the same time, the activists were examined by doctors.

On April 5, Nepomniachtchi was given another six days in the punishment cell.
