Bastrykin demanded to collect materials for the arrest of the BMW driver suspected under an article that does not imply a pre-trial detention center

Chairman of the Investigative Committee Alexander Bastrykin gave instructions to collect the materials necessary to arrest the driver of a BMW X5, who is suspected under Article 116 (beatings) for beating a woman with children at a pedestrian crossing. This is reported on the UK website.

“The investigation believes that while the suspect is at large, he can obstruct the investigation by putting pressure on witnesses and the victim, or hide from the investigation. In this regard, despite the minor gravity of the crime committed, it was decided to petition the court to impose a preventive measure against the defendant in the form of detention,” the department’s press service reports.

According to Article 108 of the Code of Criminal Procedure (detention), the court may arrest a person accused of committing a crime punishable by imprisonment for a term exceeding three years. The maximum sanction for battery is imprisonment for up to two years.

The Criminal Procedure Code allows a suspect to be arrested under an article that prescribes a term of less than 3 years if he was hiding from investigation or trial, does not have permanent residence in Russia, his identity has not been established, or he violated a previously chosen preventive measure. However, the Investigative Committee did not indicate these grounds in the release.

According to investigators, on May 5, the suspect “unreasonably showed aggression towards a woman” who was crossing the road at a pedestrian crossing with her children.

The victim, Maria Moiseeva , said that on the morning of May 5, she and her children were crossing the street at an unregulated pedestrian crossing. In the middle of the road, she had to pull her son towards her because the driver of a black BMW X5 did not give way to her. After that, the woman slammed her palm on the car's bumper. The driver of the BMW caught up with her and punched her in the forearms at least twice.

According to Moiseeva, the BMW driver shouted: “You’re ****** [finished], bitch! I will find you and ***** [kill you].” Passers-by tried to detain the man and offered to accompany the victim to school. At this time, the attacker calmly got into the car and drove away.

“Unfortunately, this driver was not stopped by the fact that there was a woman in front of him, nor her two minor children, whom she was taking to school. Therefore, the unworthy and clearly unmanly behavior of this person will now be considered by the investigator not from the point of view of moral and ethical standards, but from a criminal legal perspective,” reports the press service of the Investigative Committee.

Later, the victim wrote a statement to the police and recorded the beating: doctors recorded a shoulder injury and a bruised collarbone.

Previously, the Investigative Committee had already asked the court to arrest the suspect under an article that did not imply detention: on April 7, the investigation requested that mathematician Dmitry Bogatov, who was charged with calls for mass riots, be sent to a pre-trial detention center. For the first time, the judge of the Presnensky Court did not satisfy the request of the Investigative Committee. Later, the investigation accused Bogatov under Part 1 of Article 30, Part 1 of Article 212 of the Criminal Code (preparation for mass riots) and Article 205.2 of the Criminal Code (calls for terrorism), after which on April 10 the court, having considered the petition of the Investigative Committee for the third time, arrested Bogatov until June 8.
