The Presidium of the Astrakhan Regional Court, under the chairmanship of the deputy chairman of the court Tatyana Shustova, terminated the absence of a crime on extremism against the leader of the Russian Astrakhan movement Igor Stenin, sentenced to a two -year term. It is reported by the "Caucasian Knot".
Thus, the court granted the cassation appeal of the lawyer of the political prisoner Tatyana Ivanushkina. Now Stenin must be released, he has the right to rehabilitation and receive compensation for illegal persecution.
“The Supreme Court poked the Astrakhan courts with his nose in the obvious. The fact that Igor Stenin did not call anyone for extremist activity, and his criminal case was absolutely politically motivated from the very beginning,” said the lawyer Damir Gainutdinov, representing the interests of the politicalese in the ECHR. “Now Igor has to undergo a rehabilitation procedure, receive an apology of the prosecutor and compensation on behalf of the Russian Federation and compensation For more than a year in prison.
At the same time, the lawyer believes that Stenin “won the lottery”, and this precedent is unlikely to affect the fate of other political speakers. "In the affairs of Andrei Bubeev, Rafis Kashapov, Daria Polyudova, dozens of other people, for the years sent for bars, there were no more grounds for the prosecution, and their defense also did everything possible and impossible to prove their innocence to the court and society," Gainutdinov said. "Until the system of anti -ecstrom! Behind the backs of "experts in uniform", afraid to take responsibility for justice, no one can feel safe. "
The FSB was initiated against Stenin in January 2015. The activist was charged with part 2 of Article 280 of the Criminal Code (public calls for extremism via the Internet). The reason for the opening of the case was a post that Stenin, who performs on Vkontakte under the pseudonym Ingvar Stefan, published on August 28, 2014, in the midst of the offensive of Russian troops on Mariupol, in the VK group ROA Russian Astrakhan (from 14 to 88). The post consisted of only two phrases: "Death to the Kremlin invaders! Hands off Ukraine!".
At the same time, the plot of the case was fabricated - the activist, along with his text, was charged and another. Directly under the post of Stenin is the commentary of the user Sergey Romanov. Romanov copied a small text about the situation in the ATO zone, placed on the same day on a personal FB page by Ukrainian journalist Peter Shuklinov, and also gave a link to the original publication.
The process of Stenin was led by the judge of the Soviet district court of Astrakhan Lilia Lisitskaya. The hearings were held closed. At the trial, as well as in the investigation, Stenin emphasized that under his post above Romanov’s commentary there were likes, which would be impossible if the post and comment was one publication. He petitioned for introducing his correspondence with the VKontakte support service to the case file. Support agents confirmed that Stenin’s post and Romanov’s commentary are two different notes. However, the judge Lisitskaya refused the application.
On May 16, 2016, Lisitskaya pronounced Stenin . On July 28, the judge of the Astrakhan Regional Court, a member of his Presidium Adil Tagirova, left Lisitskaya’s decision . On October 26, the judge of the same court Evgeny Teslin rejected the first cassation appeal of the convict.
In January 2017, it became known that the complaint about the verdict of Stenin was sent to the ECHR.
According to the verdict, Stenin was supposed to serve a term in a colony-settlement. On September 9, 2016, in accordance with the order of the penal inspection, he appeared at the section of the colony-settlement in IK-10 in his city. However, almost immediately after arriving there at the Police, they imposed a far out of a far -fetched occasion; In addition, he was put on a vocational school. After that, on September 27, the FSINITS filed a lawsuit to tighten the stenin of the sentence. Soon, however, the paper was withdrawn, since the Politzek was illegally transferred to the Tambov region .
On November 7, Stenin was delivered to the Tambov KP-2. Two days later, on the 9th, he was sent to the schizo for the first time, and on November 21 - on the second. According to Politsyk, from September 9 to November 20, he "spent a total of 42 days in a schizo and transit chambers."
At the same time, on November 10, KP-2 appealed to the court with the same submission as the Astrakhan colony. On November 28, the judge of the Kirsanovsky district court Nadezhda Korolev replaced the Politzeku colony-settlement with a general regime colony. On January 24, 2017, the Tambov Regional Court confirmed this decision . On March 1, Stenina was transferred to IK-3 in the same region.
