
The judge of the Meshchansky District Court of Moscow, Elena Gudoshnikova, sentenced the former director of the capital's library of Ukrainian literature Natalia Sharin by four years with a conditionally test term on charges of extremism and embezzlement. This was reported by RAPSI.
Home arrest Sharina is canceled. The time spent under house arrest - 1 year 7 months - is set off within a trial period.
59-year-old Sharina was declared guilty under paragraph “b” of part 2 of article 282 (excitement of hatred or enmity using an official position) and parts 3, 4 of Article 160 of the Criminal Code (embezzlement in large and especially large amounts).
In the debate of the parties on May 29, the prosecutor Lyudmila Balandina requested for the defendant for five years conditionally with a five -year test term. She called the ball "one of the parts of a complex mechanism, the work of which is aimed at discrediting and discrediting Russian culture in Ukraine."
As an additional punishment, Balandin demanded to impose a ban on the librarian for three years after the test deadline to occupy positions in state structures and local self -government.
Sharina herself did not plead guilty. “This is a political matter,” Interfax reports her words after the sentence is announced. “I worked as a librarian for 35 years. Apparently, the destruction of the library was beneficial.”
The lawyers of the convicted Ivan Pavlov and Evgeny Smirnov will file an appeal against the verdict. The prosecutor of Balandin, for her part, said that Gudoshnikova’s decision was satisfied.
The case against Sharina became known on October 28, 2015 . Then she, as well as in the library of Ukrainian literature, took searches. The only prohibited publication, which, according to the Investigative Committee, was seized in the library, was the book of Dmitry Korchinsky, Vyne in Tagnpі ("War in the crowd", 1999), which was recognized as extremist in March 2013. At the same time, Sharina and her colleagues proved that there were no this book in the funds - she was thrown by law enforcement officers.
Visiters did not find any other forbidden literature. Books about Stepan Bandera, OUN and UPA were withdrawn, although none of these books are listed in the list of extremist materials. The investigators also seized the Barvinov children's journal, stating that it depicts the flag of the Right Sector.
In the final version of the prosecution, 16 prohibited books were already appeared. Sharina insists that all these publications were thrown into the library.
Sharina was detained and placed under house arrest. Recently, according to Lawyer Smirnov, it became known that on October 29, 2015, when the detainee was transported from the Tagansky OP for a while before the trial at the choice of preventive measure, she received a compression fracture of the spine: when the car driver did not slow down on a lying policeman, the car shook and Sharina hit her back.
The investigation was conducted by the department of the capital's head of the Investigative Committee for the investigation of especially important cases. Initially, only extremism was charged with a ball. However, on April 5, 2016, she was added to the charge under Part 4 of Article 160 of the Criminal Code . The department said that in 2011-2013, when the ball was persecuted in the previous case, she spent on her protection the funds intended for the payment of salaries to the library lawyers.
Lawyer Ivan Pavlov regarded this accusation as absurd. In 2013, he remarked, this case against the ball was closed behind the lack of corpus delicti, and the library lawyers did not have a lawyer status and therefore could not protect the ball on their own - it was the lawyer who paid for the accused, whose services she paid from her own funds. The excitement of a new case, Pavlov concluded, was required in order to continue to extend the rising period of house arrest: on charges of extremism, she could not appoint this preventive measure for more than six months, while the accusation of embezzlement allows.
Further, another emission of embezzlement was added to the case, qualified in part 3 of article 160.
Evgeny Tarasov, a factory department of the psycholinguistics of the Linguistics of the Russian Academy of Sciences, conducting an examination in the case of Sharina, saw signs of extremism in almost all analyzed publications, including the Barvin magazine.
The Moscow prosecutor's office approved the indictment only the second time . At the same time, the shortcomings of which the document was returned to the TFR after the first familiarization with the case, the investigation was essentially not eliminated. Hearing on the merits of the case in court continued on November 2, 2016.
In early February of this year, it became known that Sharina filed a complaint about unreasonable criminal prosecution and house arrest conditions in the ECHR .
According to lawyer Pavlov, in the event of a conviction in the current case, Sharina is threatened by two more. Firstly, an investigation in the case closed in 2013 can be resumed. Secondly, a certain new business can be initiated against the librarian.
