
The Minister of Health of the Saratov Region Vladimir Shuldyakov canceled the order obliging the chief doctors of medical institutions to provide information about the sexual activity of minors to the internal affairs bodies. This was reported by Interfax with reference to the press service of the department.
“Disputes on this issue began. The company shared the supporters and opponents of this order. Today, the minister decided to cancel, send it to an additional detailed study,” the press release said. “A clear legal assessment of the orders and law enforcement agencies should be given. Recommendations of the Federal Ministry of Health and other structures will be taken into account.”
According to the ministry, in the near future additional consultations will be held with lawyers, specialized doctors, specialists of various levels.
At the beginning of the week, the children's Ombudsman Anna Kuznetsova sent a request to the Saratov prosecutor’s office to verify compliance with the regulatory acts of this order.
By the order of May 30, signed by Schuldyakov, the head physicians of the medical institutions of the region, were obliged to report to the police about girls under the age of 16 , deprived of virginity, who became pregnant or abortion. As stated in the document, he was released "with the aim of criminal law protection of children and adolescents, ensuring timely response to the facts of crimes against sexual freedom and sexual integrity of minors." It is noted that the order was issued in accordance with the Decree of the Regional Government of November 1, 2016, as well as with Article 134 of the Criminal Code (sexual actions with a person who has not reached the age of 16).
In the commentary of the regional Ministry of Health, which appeared on the website of the department on Monday, it is indicated that the Federal Law of 2011 on the basics of health protection establishes cases in which the disclosure of medical secrets without the consent of the citizen or his legal representative is permissible. "The case of informing the internal affairs bodies about the receipt of the patient is attributed to such cases, in respect of whom there is sufficient reason to believe that the harm to his health was caused as a result of unlawful actions," the comment was noted.
It was emphasized that the document was prepared on the initiative of the regional headquarters of the Investigative Committee and received the approval of the prosecutor's office of the region.
In November last year, a few days after the resolution of the Saratov Regional Government, the Central Glavk of the Investigative Committee of the Investigative Committee invited the Federal Ministry of Health to report adolescents younger than 16 years old, leading sexual life.
