
The Moscow City Court rejected the lawsuit of the resident of the capital Alexander Parkhomenko regarding the demolition program of Khrushchevs. The press secretary of the court Ulyana Solopova informed Interfax about this.
The man filed a lawsuit against the Moscow government and mayor Sergei Sobyanin, in which he asked to recognize the vote under the program violating the Russian Constitution, civil, housing and land codes.
As Solopova clarified, the Moscow City Court is now considering four similar statements.
The vote about the demolition of Moscow five -story buildings ended on June 15. Residents of houses could vote for their inclusion in the program through public services centers and the “Active Citizen” project. According to the results , the residents of 4079 houses voted for demolition, and 460 against - 460. At general meetings, residents of the houses will be able to vote under the Renovation program until July 15.
The first lawsuit against the metropolitan authorities due to the law on the demolition of five-story buildings was filed by a resident of Perovo. In her opinion, the law violates the 35th article of the Constitution (“no one can be deprived of its property, otherwise than by court decision”). The plaintiff also recalls that the opportunity to make a decision on demolition at a general meeting of residents is not provided for in the Housing Code.
