A supporter of the banned Volya party was sentenced to one and a half years of suspended imprisonment

Olga Avilkina, a supporter of politician Svetlana (Peunova), was sentenced to one and a half years of suspended imprisonment. This was reported by Avilkina’s associates.

Lady-RusOVD-Info On June 15, the Krasnogorsk City Court of the Moscow Region found Avilkina guilty of inciting hatred against the social group “power” (Article 282 of the Criminal Code). The trial took place behind closed doors.

According to the prosecution, Avilkina, using an email newsletter, distributed a leaflet “Appeal to the Russian Army”, which was prohibited for distribution on the territory of the Russian Federation by a decision of the Leninsky District Court of Yekaterinburg dated July 9, 2015. According to Avilkina’s comrades, at the time of the alleged crime, the “Appeal” had not yet been included in the list of prohibited materials.

Prosecution witness Olga Nikiforova, who did not want to testify against Avilkina, has a similar case under Art. 282 of the Criminal Code.

The Volya party, founded by Peunova, was banned on August 9, 2016 due to the distribution of extremist materials - leaflets “Appeal to the Russian Army” and “We do not trust this government.” At the same time, according to the SOVA IAC, only the first material is rightfully recognized as extremist.

We believe that the leaflet “Appeal to the Russian Army” in 2015 was generally rightfully recognized as extremist, since it contains an unambiguous call for a military coup. However, the grounds on which the Rudnichny District Court of Prokopyevsk in 2011 recognized the leaflet “We don’t trust this government!” extremist, we find insufficient. The leaflet did not contain calls for violence, and the “sharply negative assessments and characteristics” of the authorities, found in the text by the expert involved in the investigation, cannot indicate its extremist nature, especially since the authorities are not a group requiring protection in the form of extremist legislation.

In July 2016, a court in Samara arrested Peunova, chairman of the Volya party, in absentia. She is suspected of fraud and put on the international wanted list. Criminal cases have been initiated against her party comrade Marina Gerasimova under Article 159 of the Criminal Code of the Russian Federation “Fraud on an especially large scale.”
