In the Kaliningrad region today, up to 90 percent of the world's reserves of amber are concentrated, a large piece of which costs a black market more than gold of the same weight. At the same time, in the region, raw materials are being mined without any licenses - the so -called "black diggers". In the year, the volumes of illegal production of amber reach 100 tons. In the pockets of successful black diggers and their patrons, dozens and hundreds of millions of rubles go annually. The Kaliningrad farmer Islam Shirinov became a victim of this illegal fishery, on the site of which black diggers found amber deposits.

Islam Shirinov is the only farmer in the Baltic district of the Kaliningrad region. Twenty years ago, he came here from Azerbaijan. In Baltiysk, Islam found a beautiful woman and bought a small apartment in an old German house. Now they are raising three children, the youngest of whom has recently turned two years old. For many years, Islam in Baltiysk sold fruits and vegetables in the market. In 2011, he decided to engage in farming and received a plot of land in the rural settlement of Divnaya, which is located 12 kilometers from Baltiysk. A few years later, in 2015, Islam entered into a lease agreement for another site.

For one year I completely processed the earth, sowed it and removed the first crop

- When I first saw this land, here it was for a continuous booster and buzin. Since the war, no one has cultivated this land. Every day from morning until night I took out stones, cut down bushes and trees, uprooted the roots. Then he plowed, cultivated and discount the soil. Within one year, I completely processed the earth, sowed it and removed the first crop. The earth here is fertile, the weed grows very quickly, so I process what is abroad, ”the farmer says.

In the possession of Islam Shirinov - over twenty hectares of land, where he grows potatoes, zucchini, pepper, cucumbers, strawberries, as well as rye and wheat. On his land, the farmer dug up two large ponds, divorced Karpov there, and built a heated greenhouse 60 meters long, in which vegetables grow all year round. Each year, Islam is invited to the regional agricultural fair. His successes report on positive indicators in the industry.

Along the farm section, the Primorskaya River flows, which has long attracted black diggers of amber. At the shore everywhere, sands and cut strata of soil are visible everywhere. In the area of the channel periodically, freshly erased deep pits appear, filled with water and resembling the results of the bombing. These are traces of illegal fishing of black diggers. Basically, they are noticeable along the coast, but more and more often they began to appear in Shirinov’s possessions.

- The whole story began when, at the end of March 2016, the head of the police department [Alexander] Gorlachev and the prosecutor [Dmitry] Prokhorov came to my household twice, went along the river bed and examined the territory. After their visit, different people began to visit me, who are called black diggers, and to extract amber. I just asked one: who gave good to you to work here. He says to me: “These are Ephesians, you know, he says, I have many friends among the Chekists,” the farmer says.

Shirinov nevertheless tried to protect his lands from uninvited guests. Every morning he began to do the bypass of the entire site, came to the farm at a later time with a check. And often he forced black diggers on his lands. Some of their brigades were replaced by others. Then Shirinov decided to seek help from the local police.

- I called the police department, and submitted statements, asked to go to the place to my farm and stop these visits of the diggers - there is no reaction. Once they did not even want to accept a statement from me. Another time, I told them on the phone that they were digging again in my site, asked to go to the household and fix everything, and for some reason they came to my house, ”Shirinov was indignant.

In mid -April 2016, a friend called the farmer at night and said that outsiders were again on the territory of his possessions. Islam arrived and found two diggers who, using a motorcycle, washed amber from the soil near the river bed. Immediately, the Baltiysk police department suddenly appeared on the site, they detained the violators and asked Islam to help bring their seized equipment to the police department.

- The police asked me to take the motorcade to the department, since she did not fit into their car. I agreed to help, provided them with my car, and then came to the department to pick up the keys. They detained me there and they made me a protocol for the illegal production of amber, released home only the next day, - recalls Shirinov

I had to pay a fine, and at night diggers continued to come to my site

That is, of the illegal production of amber, the police accused Shirinov himself. A trial in the case of an administrative violation was held, during which the police, with whom Shirinov met at night on his site, confused in the testimony. Nevertheless, the farmer was a fine of 5 thousand rubles for the illegal production of amber.

“I had to pay a fine, and at night diggers continued to come to my site,” says Islam Shirinov.

On the night of May 12 to May 13, 2016, diggers reappeared on Shirinov farm. Shirinov again turned to the police. During the next court hearing on this fact, police officers said that they saw how that night Shirinov arrived at the site in his car, and unloaded the motoroke from the car. The farmer himself was again accused of illegal fishing.

In July 2016, the Baltiysk prosecutor’s office made an idea that said the multiple facts of the illegal fishing of amber Shirinov. The prosecutor’s office demanded that the administration of the rural settlement of Divnaya take measures to eliminate violations and indicated that the farmer’s land was “can be forcibly seized”.

March 2, 2017, the Baltic City Court decided to take the land from the farmer

The trial in the case of farmer Shirinov lasted more than a year. Shirinov tried to prove the groundlessness of the charges of the illegal extraction of amber and the inappropriate use of the land plot. Its lawyers presented the court with the results of checking the farm possessions of the cadastral service and Rosselkhoznadzor. According to the acts of these inspections, misuse, as well as a violation of the fertile soil layer, which the prosecutor's office stated, were not detected.

Despite all this, the lawsuit of the Administration of the rural settlement of Divny was satisfied: March 2, 2017, the Baltic City Court decided to take the land from the farmer.

- Over the year, 10 ships have already taken place. I changed two lawyers. I need to sow the field, repair the equipment, but instead I go to the courts. I don’t see my family. I’m getting home - the children are already sleeping, I’m leaving - they haven’t woken up yet, ”says Shirinov.

According to him, the head of the local rural settlement took the decision to take the land from the farmer under pressure.

- In September, I dug potatoes on the field. I look, the car stopped, the then head of the Divy Mr. [Ivan] Victorchik administration came out of it and says: listen, such a situation, the prosecutor’s office and the police are pressed to terminate the lease with you, ”the farmer recalls

Now Islam Shirinov has submitted an application for a delay in the execution of a court decision. He asks that he would at least extend the land use right until November 1, 2017, when the harvesting campaign ends.

-In the region, more than 50 percent of agricultural products is imported from abroad. The lack of delay will damage the residents of the region and will negatively affect the implementation of the food security program. Shirinov is offered to participate in agricultural fairs, but at the same time they take the ground, not even allowing to remove the crop. According to the law on the farm, what my truster sowed on earth is his property, ”said farmer , Mikhail Zolotarev, lawyer of the farmer during the last court hearing.

In the court decisions in our case, a personal conflict of interest is observed

However, these arguments were not heard by the court. Judge Lyudmila Choliy decided that "there are no reasons that impede the execution of a court decision." The arguments about the availability of agricultural crops on the site, for the cleaning of which a delay is required until November 1, are recognized as insolvent.

At the last meeting, the defender of the farmer Mikhail Zolotarev announced the withdrawal of the entire Baltic City Court, citing this as follows:

- In the court decisions in our case, a personal conflict of interest is observed. Judge Anatoly Agureev, who satisfied the lawsuit of the Divny administration, is the son of the judge of the Kaliningrad Regional Court Svetlana Agureeva. She used to work in the regional prosecutor's office with Olga Kramarenko, the current deputy chairman of the Kaliningrad Regional Court. It was Kramarenko who rejected the appeal of my principal. And her daughter once worked as a secretary for Lyudmila Choliy, ”says the lawyer.

However, judge Lyudmila Choliy refused to satisfy the request for the withdrawal, since "no facts that cast doubt on my objectivity and impartiality, the defendant was brought to the defendant." Thus, in the very near future, the land from farmer Shirinov will be seized.

“I do not blame ordinary police officers,” the farmer says. - They are an angular people, they obey the boss. The boss will say: this milk is not white, but black, they will say: yes, this is black. The authorities give them a team what to do, and they do. If the land is completely taken away, I am sure that no one will plant anything there, they do not need this land in order to grow something on it, they will only get amber here. For this, they drive me out of the ground. And people in the region, apparently, will soon be fed by amber instead of potatoes if it goes on.

On the night of June 14 to 15, 2017, the black diggers of amber again dug eleven holes right on the potato field of Shirinov farmer.
