Olga Shilyaeva: With me, they beat one woman at work there, they were not allowed into the detachment, they were not allowed into the toilet, they did not feed, and mocked. The administration has foremen, the daytime, whom they say “FAS”, and they begin to beat their own convicts. And they beat to such an extent ... They are beaten by the administration, and even in the detachment they begin to humiliate, make the toilets, do not let the toilet, do not allow them to sleep, beat, kill. Of course, it is impossible to prove, because all people are in single cameras.
Maryana Torocheshnikova: Anastasia, is it known about the fate of this prisoner-Gorbunov, in what condition he is? Are there any investigative actions? And what is this bibik?
Anastasia Zotova: Now Gorbunova is not beaten, he is still in the IK-6 of the Kirov region. The lawyer Natalya Kruglikova filed a complaint with the prosecutor’s office, and we handed out materials at a press conference. After that, investigators came to Gorbunov himself, interviewed him on this subject and forced him to sign the paper that if he gives false testimonies, he was aware that he could be subjected to criminal prosecution for a false denunciation. He signed all this, after which he was immediately refused to institute criminal proceedings and brought a new criminal case against him under the article “False denunciation”. Now, a lawyer, a colleague of Natalia Kruglikova, protects him in this case of false denunciation and is still trying to cancel a refusal decision to institute criminal proceedings.
As for Bibika, this is a surname familiar to human rights activists.
Lev Ponomarev: I hear this surname for ten years. He worked in different camps, and we exposed him, said that he was a rapist, just a sadist! This is a person who knows how to solve different issues, and he just needs a system. Now he is the head of IK-6.

He did not come out of there, because he was all the time indignant that they were beaten, that he could not complain. And so he said: "They didn’t beat me. But Bibik is generally well done, because our colony reports perfectly, it is an advanced production." This is what the authorities need-the colony produces something. There is monstrous corruption. I don’t know whether Bibik is shared or not, most likely, is divided, and he has a colony that may be an advanced production of production.
Maryana Torocheshnikova: And how do overseering bodies, prosecutor’s office react to such activities?
Lev Ponomarev: No way. In the village where this colony is located, everyone is tied. A large corruption component and kumovism are not excluded, because relatives work there. Anastasia Zotova : You can say to a person: "Or you behave normally, you cooperate with the administration, write denunciations on your neighbors - or go to Bibik."
Maryana Torocheshnikova: How many such torture colonies across the country?
There are only about a thousand places of imprisonment in Russia, and the torture of them are several dozen
Lev Ponomarev: There are five torture colonies in Karelia. Kirov region-IK-6. They are also in the Sverdlovsk, Saratov, Irkutsk, Vladimir, Kemerovo regions, in the Krasnoyarsk Territory ... The Omsk region is very difficult, and everything is closed there, there is no information at all! We have only about a thousand places of imprisonment: 700 colonies and 300 pre -trial detention centers, and torture - several dozen.
Maryana Torocheshnikova: But public observation commissions are in force, they are trying to resist torture. Or are they limited only to checking the quality of food and the conditions of detention?
Anastasia Zotova: Here you need to distinguish: there are colonies where one employee will hit one prisoner once a month, and this is not good, but there are colonies where all prisoners or 30-40% of prisoners beat every day. Relatively speaking, in one colony it is just an incident, and in another, a torture system.
And the PMC somehow does not act very much. For example, in Karelia, we talked with these social activists, and they seem to be normal, adequate people, do not say that everyone should be tortured, but at the same time, when I say: "Why don't you go to Segezh from Petrozavodsk?" - They answer: "Gasoline is expensive, it is difficult to go, it is not gaining people, it is difficult to conduct checks ..."
Maryana Torocheshnikova: But this is all in pure volunteerism, no one pays for observers' expenses, they go to the colony at their own expense, spend their personal time.
Lev Ponomarev: The system of execution of punishments does everything so that human rights activists do not work there. In addition, PMC is now full of people with a power background.
Maryana Torocheshnikova: Just at the end of last year, a new composition of the PMC was formed, and they simply removed especially active people from there, they did not enter.

Anastasia Zotova: Elena Vinichenko said that she had an ulcer on her leg, and she was not released not only to the toilet, but also to the medical unit to make dressings. Maryana Torocheshnikova: Here is a person from a colony with such a foot - and he may complain: let the investigation conduct a check for non -ordering medical care or criminal negligence.

Anastasia Zotova: But it is very difficult! We have such a person in Karelia - Oleg Kuznetsov, who was sitting in a schizo, they told him that they would kill him, and he decided for himself that he would begin to complain when he came out. And so he went out, began to complain, and they say to him: "You are the first person who began to complain after the exit!" Everyone else came out, they think: all this remained somewhere behind, I want to forget all this as soon as possible.

Lev Ponomarev: And they are also afraid to do it. Here is a former prisoner from Karelia, who is now working in Moscow, says: "I do not want to, I'm afraid to lose work."
Anastasia Zotova: And those who now live in Karelia are afraid even more. They say: "We are ready to give certificates, but without names, otherwise the drugs will be thrown to us and sent back to the same colony." And Kuznetsov lives in Moscow, and he sued the Karelian fsin for illegally placing in the penalty area. In the Supreme Court of the Republic of Karelia, he sued himself some small amount, five or ten thousand rubles, that is, the state nevertheless admitted that he was illegally put in a schizo. And now, with the help of our lawyer Nikolai Zaproshenko, a complaint was filed against torture in the European Court of Human Rights .
We hope that for all the prisoners who are now sitting in IK-7, and in IK-1, and in LIU-4, and were subjected to torture there, write complaints to the European Court of Human Rights in order to officially show that the colony is torture. But before going to the ECHR, we need to go through all the courts in Russia, and for this we need to get documents, which is also not easy.
Lev Ponomarev: It would be more correct to be the federal investigative authorities, the Federal Prosecutor's Office would take this investigation, that is, investigators would come from Moscow, and the Prosecutor General would have taken supervision. They have no kumes, it is away from everyone ... But they don’t do it.
In Karelia, Nastya and I collected such packs of documents twice and sent, and this, as a rule, was lowered down. And there is this Czechard: they refuse to initiate a criminal case, then we write again, they cancel the refusal again, investigate again, then refuse again ... it has been going on for six months, and it is clear that they are interested in all this. I am writing to the Commissioner for Human Rights in Russia, we write to the chairman of the Human Rights Council under the President, they write to the Prosecutor General’s Office: take under supervision ...

Anastasia Zotova: for example, one prisoner who is located in the IK-1 colony, Gennady Kirdalev, a citizen of Moldova, said: "Refuse the lawyer Markin who goes to you, otherwise we will rape you." He opened his veins, but he still has not allowed him to be a lawyer, for more than a month, and it is not clear what is happening to him now.
Lev Ponomarev: We hire lawyers, collect money on the Internet to send lawyers there, and here the lawyers travel from St. Petersburg to Karelia with almost a rotational basis.
Maryana Torocheshnikova: Here is the story of the 53-year-old Natalia Ulyanova: she did not have time to send the norm on the industrial zone, and in December 2013 she was not allowed to get up from the sewing machine and forced to work in two shifts. At this time, they did not even go into the toilet or the dining room at that time, they did not even go to the medical unit, when she became ill after these two changes in continuous sitting behind the machine without food and water. Anastasia Zotova: Just the death of a colony prisoner to employees is very easy to write off. For example, a person died that he did not leave the sewing machine for two days, did not go to the toilet and did not eat, and they write: a heart attack.
Lev Ponomarev: Or maybe it was a heart attack - just from exhaustion.
Maryana Torocheshnikova: But the question is in a causal relationship.
Anastasia Zotova: And sometimes the prisoner died, lies in the morgue, he beats, and it is obvious: he has blue hands, blue legs, and he is written to death-a heart attack or something like that. And you will not prove that the reason is different.
Maryana Torocheshnikova: Lev Alexandrovich handed me a brochure where there are photographs of people who died in the colony, and there are, among other things, people are in complete exhaustion. One person died in the Investigative Isolator "Butyrka" in Moscow. There are also photographs of brutally beaten people, and absolutely blue corpses, on their hands are traces of handcuffs ...
Lev Ponomarev: And then amazing impudence! We write that we received information from relatives that the person was beaten, died, he was killed, and the colony writes to us that he fell from the stairs.
Maryana Torocheshnikova: But a year ago they imitated the death of the prisoner in the cell through hanging, although it was obvious that he could not do it on his own.

Lev Ponomarev: These are rare cases when, thanks to the efforts of both relatives and human rights activists, it is possible to institute criminal proceedings and punish those responsible. I think that this is not more often than one to ten or one by twenty cases. Most of these cases take place without any investigation.
Maryana Torocheshnikova: And how do relatives behave in such situations? Do they help human rights activists or, on the contrary, interfere? Были у вас такие случаи, что приходили родственники заключенного, погибшего или избитого в колонии до страшного состояния, и говорили: "Пожалуйста, перестаньте жаловаться, а то будет еще хуже"?
Анастасия Зотова: Я такого не видела. Наоборот, родственники говорят: "Жалуйтесь, делайте что угодно! Мы готовы наполовину оплачивать вам адвоката, помогать, как сможем, чтобы все это довести до конца". Все более-менее понимают, что даже когда сотрудник ФСИН говорит: "Не жалуйтесь, будет хуже", – это ему будет хуже, если мы будем жаловаться, а заключенному, наоборот, будет лучше, его оставят в покое, если поймут, что за ним есть жена, мать или правозащитная организация, которая готова каким-то образом за него бороться. А если человек начинает отказываться от своих показаний, поверив, что его не будут трогать, все происходит как раз наоборот.

Лев Пономарев: Но такие случаи были. Погиб один парень. Сначала к нам обратилась его мать, а потом к ней пришли и сказали: "У тебя есть второй сын – ты не думаешь о его судьбе?" И она сказала нам: "Нет, я дальше не буду бороться, а то они посадят моего второго сына". А посадить ничего не стоит – подбросят наркотики или еще что-то сделают.
Марьяна Торочешникова: Тем не менее, в России возбуждают уголовные дела против бывших сотрудников ФСИН или полиции, которые пытают задержанных в полицейских участках. Какие усилия требуется приложить для этого?
Анастасия Зотова: Мы очень верим, что у нас получится хотя бы отстранить от должности тех людей, которые избивали и пытали заключенных в Карелии. Колонией ИК-7 мы очень плотно занимаемся с декабря, больше полугода, и единственное, чего удалось добиться, это отстранения от должности двух заместителей начальника. Сергей Леонидович Косиев, который, со слов заключенных, является главным садистом и руководит пытками, пока что на своей должности, его не отстраняют, уголовное дело не возбуждают, ограничились заместителями. Очень хотелось бы добиться хотя бы отстранения, мы уже не говорим о том, чтобы реально возбудили уголовные дела или посадили людей.

Вот в Саратове удалось расследовать убийство после очень большой кампании в прессе и очень больших усилий мамы – она ходила везде, и к нам тоже, и добилась того, чтобы, в конце концов, возбудили уголовное дело и посадили виновника.
Марьяна Торочешникова: А насколько адекватны бывают такие приговоры? Все помнят копейское дело , когда был бунт заключенных в колонии, они там вскрывали себе вены, забрались на крышу... Там начались проверки, приезжали многочисленные делегации, возбудили уголовное дело, но в результате большая часть заявителей отозвали свои заявления на вымогательства и пытки, а те, кто остались, тоже находились под жестким прессом.
Лев Пономарев: И организаторам дали новые сроки.
Марьяна Торочешникова: Да, их обвинили еще в каких-то новых преступлениях. А начальник копейской колонии отделался условным сроком.
Лев Пономарев: Да, это неадекватное наказание, и все это вместе создает благоприятную обстановку для того, чтобы скрыть убийство или получить не такое большое наказание. Это отсутствие политической воли сверху, из Москвы. Но самое удивительное: казалось бы, в 30-е годы люди ничего не знали про лагеря, просто жили своей жизнью, правда о лагерях не была известна. У нас же все об этом знают. Вот я, например, точно знаю, что СИЗО №1 города Иркутска – пыточное, и об этом пишут многие местные независимые интернет-порталы и газеты, но ничего не меняется! Видимо, обществу это безразлично, и это признак умирания российского общества.
Марьяна Торочешникова: Очень многие люди считают, что если человек осужден, то он виновен, а если виновен – что же, его там плюшками кормить? Это выстраивается в общественном сознании, в том числе, благодаря и сериалам, и риторике представителей российских силовых ведомств, что "не надо с ними сюсюкаться, а то они еще будут, как Брейвик, требовать, чтобы судили надзирателей за то, что не так посмотрели".
Видимо, обществу все это безразлично, и это признак умирания российского общества
Лев Пономарев: По статистике, в России каждый третий мужчина к 60 годам сидел. Так что общество хорошо знает, и что там происходит, даже на примере своих собственных семей, и насколько несправедливо люди сидят. Но это какая-то импотенция общества – люди не хотят сопротивляться очевидным вещам. Ну, убили...
Анастасия Зотова: И эта риторика, что правозащитники защищают преступников… Конечно, если человек совершил преступление, то суд его судит, приговаривает к тюремному заключению или штрафу. Только вот в наказание по российскому Уголовному кодексу не входят пытки, избиения, переломы ребер и убийства.
Марьяна Торочешникова: И рабский труд!
Анастасия Зотова: Если человек попал в исправительное учреждение, то он должен исправляться, ему там должны рассказывать про Толстого и Достоевского, про то, что нужно честно работать, не надо воровать. Для меня пример системы исполнения наказаний – из романа Виктора Гюго "Отверженные", Жан Вальжан: он выходит и понимает, что все его ненавидят, а когда священник начинает к нему относиться хорошо, человек меняется. Человек может измениться, но не в том случае, когда его избивают, унижают и относятся не как к человеку.
Марьяна Торочешникова: А в российских местах лишения свободы существуют какие-то программы социализации? Я знаю, что теоретически человек может, находясь там, получить даже высшее или среднее специальное образование за счет государства, то есть возможности для роста и исправления есть. Насколько широко они используются?
Лев Пономарев: У нас нет полной информации о нормальных колониях. Я надеюсь, что нормальных в десятки раз больше. Валерий Шухардин сидел по экономической статье и там получил юридическое образование. Он сейчас один из самых известных адвокатов, работающих в системе исполнения наказаний.
Я знаю и другие примеры. Племянник одного известного олигарха попал туда, ко мне пришли и говорят: "Помогите!" Я списался, и мне говорят: "Мы готовы открыть компьютерный класс, но только пусть он тогда оплатит весь компьютерный класс, не только для одного этого парня". И этот олигарх сделал компьютерный класс, и его племянник там учился.
Марьяна Торочешникова: А это не коррупция?
Лев Пономарев: Нет, потому что это как бы сверх того, что могло быть там. И все эти деньги пошли на компьютерный класс.

Анастасия Зотова: Тут сложный вопрос. Если семья думает: ну, вот в колонии, наверное, не хватает телевизора, подарю-ка я им телевизор, – это одно. А если человек хочет передать в камеру своего родственника телевизор, а этого родственника перевозят из одной камеры в другую, потом в третью, потом в четвертую, чтобы его семья в каждую камеру покупала телевизор, то это уже похоже на коррупцию.
Марьяна Торочешникова: В копейской колонии родственники заключенных ежемесячно передавали деньги, чтобы их близких просто не били.
Лев Пономарев: И это определенно коррупция, потому что эти деньги точно шли в карман.
Или другой пример: мы сейчас хотим возбудить расследование в одной из колоний, где вымогали деньги у предпринимателей, которые там сидели, и эти деньги якобы шли на ремонт. Начальник колонии отчитывался этими самыми квиточками, а на ремонт одновременно шли государственные деньги, которые он клал в свой карман. Это точно коррупция.
Марьяна Торочешникова: А это можно остановить?
Лев Пономарев: При желании – да. И коррупция – когда люди работают, а им ничего не платят. У тюремной промышленности огромные заказы, на миллиарды рублей, но у заключенных зарплаты нулевые: могут платить, например, десять рублей в месяц.
Марьяна Торочешникова: А куда смотрит Трудовая инспекция?
Лев Пономарев: У них ограниченные возможности туда проходить, ведь это закрытые учреждения. Кроме того, действие Трудового кодекса на колонии не распространяется. Мы сейчас добиваемся, чтобы там были какие-то элементы Трудового кодекса – трудовой договор, например. Или, если колония получила заказ, то чтобы на сайте колонии вывешивали всю информацию: что за заказ, сколько они за это получили. Мне один из замов начальника ФСИН России говорил: "Ты что, если заключенные это увидят, они же будут требовать законную зарплату"…

Марьяна Торочешникова: Еще одна история. Первый день в ИК-2 у Татьяны Гавриловой вышел очень запоминающимся, как для нее, так и для всей администрации колонии: "Главный по безопасности в колонии ИК-2 тут же позвал меня к себе в кабинет и несколько раз ударил по виску дубинкой. Мне ничего не оставалось делать, и я начала обороняться".
Лев Пономарев: Она мастер спорта по единоборствам.
Марьяна Торочешникова: "На крики прибежали все сотрудники, но я, понимая, что терять мне нечего, не ослабляла захват, – рассказывает Гаврилова. – Он приказал всем выйти из кабинета, дал слово офицера, что больше меня никто тут бить не будет. Я его отпустила. Он сел на диван и спокойно сказал, что я никогда не выйду из колонии живой ".

Марьяна Торочешникова: Что вообще могут в таких случаях предпринимать заключенные? Нужно ли сообщать родственникам, и что они могут сделать, когда получают такие сигналы?
Анастасия Зотова: Это очень сложный вопрос. Чаще всего у человека даже нет возможности пожаловаться. Приходит прокурор, человек жалуется прокурору, и тот говорит: "Ну, и что, это все нормально. Слушайся администрацию колонии, и тебя не будут бить". Приходит ОНК, человек жалуется ОНК и получает примерно такой же ответ. И за жалобы человека могут побить еще сильнее. Письма, разумеется, цензурируются. Единственный вариант – связываться с родственниками. А родственники могут только искать каких-то правозащитников, честных адвокатов.
Марьяна Торочешникова: Либо рассказывать журналистам. Настя, вы же начали интересоваться тем, что происходит в российских колониях, после истории с вашим мужем, Ильдаром Дадиным ?

Анастасия Зотова: Да, но я ведь закончила факультет журналистики, и поэтому, когда я получила от Ильдара письмо с подписью: "Пожалуйста, опубликуй это в прессе", – я просто написала всем своим бывшим однокурсникам и попросила всех, кого только могла, опубликовать это письмо следующим утром.
Марьяна Торочешникова: Коме того, Ильдара Дадина и так знали, это был известный на всю страну заключенный.
Анастасия Зотова: Еще до письма Ильдара Дадина очень многие заключенные и жены заключенных писали примерно такие же письма в российские СМИ, в "Новую газету", в "Независимую газету", уполномоченному, у нас в "Вестнике защиты прав заключенных" публиковались письма о пытках в той же Карелии. Только никому не было интересно, когда совершенно неизвестные люди, осужденные за какой-нибудь разбой или грабеж, сообщают о пытках.
Марьяна Торочешникова: А что должно произойти, чтобы изменилось отношение читателей к этим историям?
Анастасия Зотова: Мы пытаемся это сделать, ведем группы в социальных сетях, "ВКонтакте", в "Фейсбуке", в "Телеграме", в "Твиттере", сейчас попытаемся завести группу в "Одноклассниках".
Марьяна Торочешникова: А вы общаетесь с представителями ФСИН? Они готовы с вами общаться?
Анастасия Зотова: Общаться-то они готовы, только делать ничего не готовы!
Лев Пономарев: На волне борьбы за Ильдара Дадина, когда было видно, что Ильдара уже практически отпускают, вдруг меня вызывает руководство ФСИН, мне жмут руку и говорят: "Все, Лев Александрович, мы создаем штаб, рабочую группу, будем бороться с пытками!" Это говорил господин Максименко, зам начальника ФСИН, и начальник Службы собственной безопасности. Я составил список, думал, что это все серьезно: все-таки генералы со мной говорят…
Видимо, пыточные зоны находятся под контролем спецслужб
Это было перед Новым годом. После этого, наверное, им поступил какой-то новый сигнал, и дальше ничего не движется. Дело в том, что руководство ФСИН даже не руководит этими пыточными зонами. Я в свое время встречался с начальником УФСИН Красноярска, и он мне сказал: "Лев Александрович, я не руковожу этими пыточными колониями, это все из Москвы. Туда привозят террористов, воров в законе, ломают, это все спецслужбы". Видимо, пыточные зоны находятся под контролем спецслужб.
Марьяна Торочешникова: Понятно: одни кивают на других, а в итоге получается, что людей унижают, пытают, и реакции на это нет.
Лев Пономарев: Путин 7 декабря прошлого года встречался с Советом по правам человека, где правозащитник Игорь Каляпин говорил о том, что пытают в Карелии, и он сказал: "Я поручаю Генеральной прокуратуре заняться этой проблемой". Буквально через несколько дней он выступал на коллегии Генеральной прокуратуры и сказал там, что прокуратура должна следить за соблюдением прав в системе исполнения наказаний. Но ничего не произошло, полный ноль! Мне кажется, это было сказано просто, что называется, для картинки, а они уже умеют считывать эти сигналы.
Вот Корниенко, нынешний руководитель ФСИН – когда его только назначили, я имел возможность с ним встретиться. Там сидели уполномоченный по правам человека Лукин, Корниенко, я и еще один правозащитник. И он говорит: "Я буду все делать, но вы же понимаете, что это все снизу". Правильно, эта проблема есть, но ставьте молодых офицеров, еще не испорченных! Он говорит: "Нет, мы будем ставить видеорегистраторы, чтобы все контакты сотрудников с заключенными фиксировались. Но они это прекрасно освоили – они выключают регистраторы, когда бьют, и включают, когда надо показать, как человек возмущается.
Марьяна Торочешникова: А вам хоть раз удавалось истребовать видеозаписи?
Уволили бы для примера десять садистов и объяснили почему – это произвело бы сильное впечатление
Лев Пономарев: Чтобы там были избиения? Not yet.
Анастасия Зотова: Истребовать видеозаписи удалось пока только одному человеку – это Татьяна Николаевна Москалькова , и она признала, что, когда она попросила видеозаписи из Карелии, ей примерно такие и предоставили – идет видео, а потом черная дыра, то есть или удалена часть видео, или просто выключалась камера.
А еще проблема в том, что это видео, по всей видимости, хранится в той же самой колонии. Даже если, не дай бог, на видео попало, как начальник колонии мутузит заключенного, окунает его головой в унитаз, потом можно зайти в специальную диспетчерскую и все это вырезать. Эта информация должна храниться где-то в другом месте, откуда ее можно было бы истребовать, и откуда сотрудники колонии никак не могли бы ее удалить.
Марьяна Торочешникова: Или транслироваться онлайн, как на выборах в Госдуму.
Анастасия Зотова: Такие предложения, кстати, уже поступали, но в руководстве ФСИН пояснили, что это будет противоречить закону о персональных данных, то есть, может быть, заключенные не хотят, чтобы на них все смотрели в режиме онлайн.
Лев Пономарев: Но самое главное, и из Москвы не едут. Вот если приедут из Москвы, то все-таки размотают.
Марьяна Торочешникова: То есть эти столичные проверки дают результат.
Lev Ponomarev: Of course! Если бы увольняли, по крайней мере, то это уже изменило бы ситуацию. Уволили бы для примера десять садистов и объяснили почему – это произвело бы сильное впечатление.
