
A year ago, Russian lawmakers accepted the so -called Spring package, according to which all experts gave identical conclusions: the rights of citizens were violated is expensive and generally impossible. Most of the disputes concerned the operators to store network traffic for six months, which, in addition to installing special equipment, would require the creation of giant data storage facilities. The requirement to store traffic, on the one hand, may contradict the constitution. On the other hand, it is quite pointless, taking into account the fact that a significant part of the traffic on the modern Internet is transmitted in encrypted form. But the main thing here is that the operator is offered at his own expense, that is, ultimately at the expense of users, to create one of the largest surveillance system in world history.
According to the estimates of the Minister of Communications Nikolai Nikiforov, tariffs for mobile telephony and the Internet can grow by 300%. Of course, business and citizens are not offered anything in return, except for "anti -terrorist events." And the main beneficiaries are the suppliers of equipment - that is, the “package” has an obvious corruption component, at least the potential for it.
State Duma deputy Oleg Shein and Senator Anton Belyakov proposed to hang the situation - to postpone the deadlines for the execution of the Yarova package for five years - from 2018 to 2023. According to Vedomosti, the government commission gave a positive imprisonment for this proposal, and only representatives of the FSB opposed. Which either is not tolerated to start the shipment of equipment, or the truth is needed to be a random data for catching terrorists.
While the situation looks something like this. Incomplete legislators adopt an impossible law, and even government officials are trying to lower it on the brakes who understand that there is simply no money in the country's surveillance system prescribed by this law. The operators, especially the “big four”, try to resolve the situation in the framework of negotiations - it is obvious that the delay for five years in the current situation is quite satisfied. And opponents are special services, the argument of which is that they supposedly simply cannot cope with their duties without collapse of the communication market in the country. The Chekists are not very worried that no one has a ready -made technological solution to storage data. There is the old logic “there are no such fortresses that could not take” - in our case, spring and special services.
But in this case, it seems, they will not take it again.

- I have never doubted that the implementation of a package of amendments would be delayed until better times. There are points that embarrass me as a lawyer, which can violate the rights guaranteed by the Constitution. There are also technical issues that simply caused bewilderment of member of the cellular services market. This was especially surprised by regional companies. The fact is that they do not have such budgets to fulfill these requirements.
According to the senator, it was necessary from the very beginning to hold a parliamentary hearings, invite to discuss the initiative of the participants of the cellular services market, “to receive a review from the regions”: “The security forces are already satisfied, they received what they wanted, now they wanted to legalize the receipt of materials without a court decision. Previously, if the operative came to the court with audio materials, he was asked where he took them. First, be kind to get a court decision, and then listen, protocolize. And now for them a court decision may have retroactive force, they get any audio recordings that are often obtained illegal methods that operators could not use technically. And these data will submit these data to the court as officially received from the telecom operators. ”

As we previously stated, the expulsion of 1% revenue to the corresponding needs is possible without tariffs for subscribers, larger costs will inevitably affect the cost of services.

Therefore, it is obvious that the time remaining before the entry into force of the law is not enough. In this regard, the company supports proposals to transfer the deadline for the requirements of the Yarovaya Law.

- The cellular market is no longer very profitable. Operators now earn 10-15%, there is no growth in this business, everyone pressed. Companies simply have no reserves to ensure the implementation of this law. The number of subscribers will decrease, operators will increase by 20%, and they can double. Prices will have to be raised, respectively, too. For large companies, the implementation of this law may cost costs comparable to annual revenue, they will have to take loans, and small regional companies will not be able to fulfill the requirement of the law.
It must be understood that there is such a thing as elasticity of demand: if one and a half trillion rubles is the whole mobile market, then it will grow by 20%. These 300 billion rubles cannot take now. Someone will simply refuse these services, the question for people will arise in this way: buy a bread or pay for the Internet. As a result, this will affect our economy, on inflation, or may generally lead to a market collapse.
If the implementation of the law is transferred to 5 years, then everyone will simply exhale and wait for these 5 years - the term is quite large. Now everyone is sitting and do not know what to do: the dollar has risen, the equipment is imported, and the prices for communication services have not risen, the companies in quantitative terms began to invest in development at times less than in 2013.

- I will remind you that the discussion on the package of Yarova was a year ago. A year ago, the decision took place in a series of terrorist acts in which about a hundred people died in France. In this context, the discussion of the anti -terrorism measures of the bill was quite complicated. But even then it was said that the adoption of the package will entail not just a significant rise in price of services of electronic communication, Internet and mobile communications. Indeed, according to this law, it is assumed that for six months they should store all SMS, video messages, audio recordings of people's conversations - about vacation, about concerts, about kittens and other things that are unlikely to be of deep interest for Russian special services. Meanwhile, by law, operators are required to resort to technical measures to ensure this decision. A year ago, the price of the issue was 2.2 trillion rubles. A year later (especially against the background of the last discussion in telegram), it is obvious that the situation is rethought. And already the question is not about the phased entry into force of provisions from the law, but about the complete delay of the package.
- If the adoption of the package is postponed, will it be amended?
- Certainly! This will mean that it will be substantially changed. The Russian model of legislation is as follows: if a delay is taken, this is done in order to make substantial changes to the bill. Obviously, the delay in this case will entail a reduction in the package and its restrictions. After all, everyone understands that such a shaft of information, which is ordered to store providers, and to analyze special services, is simply deprived of a semantic load for real anti -terrorist work.
- Who opposes amendments and delays in acceptance?
- It is difficult for me to judge, because neither I nor Anton Belyakov were present at a meeting of the working group in the Government of the Russian Federation. I think that special services and the FSB can express a restrained reaction. But judging by the information that the media give, with reference to sources, the special services probably also look at things more realistic than before. Their task is to find terrorists, and not to be littered with a completely unnecessary stream of ordinary conversations between people.
