
The program for helping borrowers appeared in 2015 to help people who find themselves in difficult life situations. Russian families were given the opportunity to use the restructuring of a mortgage loan. However, initially the conditions were so strict that in a year and a half only one Russian family was able to receive help. At the end of 2016, the conditions were softened, and some categories of citizens promised to return not 20, but 30% of the remainder of the loan amount. All changes were for the better. Thousands of people went to draw up documents, but most of them received nothing. Why did it happen and who was enriched on the “mortgages”, a 7x7 correspondent understood .
The resident of Petrozavodsk, Ivan Trofimov, learned about the program of assistance to borrowers from his colleague in January 2017 and immediately “caught fire”. He has two children, his wife - on vacation for child care. Family income is barely enough for a monthly mortgage payment, about 10 thousand rubles remains for life. (food, school expenses, apartment fees, etc.). The family, according to all the criteria, approached the program, it remained only to collect the necessary certificates. One of them (about real estate) cost the family 7 thousand rubles.
“The bank was warned that the program soon ends, that we may not have time,” Ivan told the 7x7 correspondent. - But we managed, handed over the documents on January 24. On March 7, we were informed that the application was approved and in the near future it would be necessary to sign an agreement on restructuring.
But the Trofimov did not rejoice for long. Already on March 20, the same bank employee called and said that the application was double -check and the family was excluded from the program. At the same time, the colleague of Ivan, who submitted the documents a day later, managed to conclude the contract. Ivan turned for clarifications at JSC “ Mortgage Agency for Housing Lending ”. There he was explained that "in accordance with the conditions for the implementation of the program, the bank on the restructuring of a specific mortgage loan makes it independently, may even refuse to comply with the borrower to all requirements." Ivan made a request for the reasons for the refusal to the bank, however, his lender was short: “The bank considered your appeal about the restructuring of a mortgage loan under the program of assistance to certain categories of borrowers and reports a refusal to restructure debt.” Employees proposed participating in other assistance programs. True, for this it is necessary to collect a package of documents again, and the conditions are completely different.
Thousands of Russians share similar stories today on the Internet. Differences in the details: someone has one child, someone has four, someone spent six thousand rubles on certificates, someone ten. People submitted applications, as if playing in the lottery: lucky or not. The main claim of those who did not get into the program is the costs of certificates of real estate from Rosreestr. According to people, banks could request the data themselves, because the program was developed to help people who are already not rich, in need.
On March 7, 2017, borrowers reported that banks will no longer accept applications, since the money allocated for the implementation of the program is almost spent. Less than a month has passed since the last changes to the program adopted on February 10. Dissatisfied Petrozavodsk people went to Rosreestr and the multifunctional center with the hope of returning at least money spent on certificates. However, they were denied these departments, since they received the service, and the federal program is not in their maintenance. In an interview with the 7x7 correspondent, the MFC said that people were warned that extracts were expensive, but there were no guarantees for the program.
The 7x7 editors sent a request to the Russian government to find out in connection with which a decision was made to extend the program, whether the analysis was carried out, how much money was mastered for its implementation and how much was left. The response came from the Ministry of Construction of Russia: “ The implementation of the state program for assistance to mortgage borrowers is associated not only with the terms, but also with the limit of funds allocated for it from the federal budget in the framework of the Decree of the Government of the Russian Federation No. 373 of April 20, 2015 (the editors dated 10.02.2017) and stipulated in the Federal Budget for 2015 and for the planning period of 2016 and 2017 and 2017 and 2017 and 2017 Years “... Acceptance of new applications from citizens to participate in the state program of assistance to mortgage borrowers is not made by creditors in connection with the expected complete spent on the allocated funds (4.5 billion rubles) for already accepted applications. All applications for participation from citizens will be considered by creditors. Support has been provided or has already decided to provide it with the amount of budget financing allocated for the implementation of the program. ”
If we translate the above into a simple language, the Government of Russia does not plan to allocate additional money for the implementation of the program.
At the request of the 7x7 editorial office, the local branch of Rosreestr said that in February, when the latest changes were made on the extension of the program before May 31, 2017, 24 thousand people turned to Rosreestr with various requests, and 55 thousand in the first three months of 2017. For comparison: for the same period of 2016, 18 thousand appeals were registered in the Karelian Rosreestr. However, how many of these requests were for the manufacture of certificates of real estate, the department could not say. If we assume that the certificates requested at least half of the applicants, it turns out that only in Karelia in the first months of 2017 the department earned about 50 million rubles at these certificates. (The cost of one certificate is 1,800 rubles). And how much did the state work for all the years of the program? If we take into account that throughout the country, the help eventually received 22 thousand family, which means that most applicants were not useful. But money for the documents was not returned to people.
The 7x7 editors tried to find out how many applicants the program had for all the time of its existence. However, the Russian government did not provide information on this issue, under the pretext that "the issue relates to the competence of the Ministry of Construction of the Russian Federation and JSC" Agency for Mortgage Housing Lending "." But there we did not receive an answer to a rather simple question. The Ministry of Construction reported: " AIZHK is the program operator, they receive all applications, they will give you the most reliable information." But even in AIZHK, it turned out, they also do not know how many Russians wanted to participate in the program. The agency answered: “ Issues of acceptance, consideration and decision -making on applications for restructuring are related to the competence of creditors.”
It turns out that only banks who issued mortgage loans are known about the number of applicants. The state program operators stubbornly do not want to disclose simple information about the number of applicants. It would be strange if they had not owned this information. The program was signed by the Prime Minister Dmitry Medvedev.
Another moment. At the end of May, Kommersantwrote that 52.3 thousand statements received the restructuring of “banks, of which 34 thousand applications were responsible for the necessary conditions.” The same news was about the fact that the Ministry of Finance and the Central Bank made a proposal to extend the program. At the same time, AIZHK and the Ministry of Construction , according to the interlocutors of the publication, opposed "sharply against continuing assistance, citing the fact that the help should not be endless."
If we assume that information about the number of applications is reliable, it turns out that the state has earned at least 200 million rubles on certificates (one application - at least two certificates from family members). That is, from the help paid to borrowers in the form of 4.5 billion rubles. Almost 5 % of the money returned.
What to do to people who believed the state, collected documents, spent their money and did not get anything? Comments the Karelian lawyer Elena Paltseva:
- Of course, people have the right to go to court. And demand at least reimbursement of expenses related to the paperwork. But here many factors will affect the legal assessment: the application was approved for 2017 or for 2018, approved before the end of the program, or first approved, and then closed and the previous decision was canceled. In the latter case, probably, there are chances to return the money. These relations are in the nature of public law, but I agree that the state should not “throw” its citizens, the rules of the game should be clear, understandable, with the predictable legal result for citizens in the first place.
That is, those who did not get into the program can, if desired, again get involved in the bureaucracy: to file a lawsuit and try to prove their case. But even in this case there is no guarantee that the money will be returned, and new expenses (for lawyer services, payment of state fees) cannot be avoided. The most active Russians who have not got into the program are still fighting. Anastasia Ponomareva from Tyumen created a petition addressed to the Prime Minister of Russia Dmitry Medvedev. She asks to allocate additional money for the program for helping borrowers.
