Former Politsyk Stenin requires 5 million rubles for illegal persecution

The leader of the Russian Astrakhan movement Igor Stenin, last year, sentenced to a two -year term in the case of extremism, and in the current one justified by the cassation instance, demanded from the state to pay 5 million rubles to compensation for moral damage for illegal criminal prosecution. A civil lawsuit was filed in the Soviet District Court of Astrakhan. The defendant was named the Ministry of Finance, represented by the regional department of the Federal Treasury, and third parties - regional FSB, prosecutor's office, the Office of the Judicial Department and the Federal Penitentiary Service.

"The prosecutor, affirming the indictment, and the courts that considered the criminal case against me formally approached the study and consideration of the case," the lawsuit said. As a result, Stenin notes, he was illegally deprived of freedom for 8 months 23 days.

The activist also indicated that Rosfinmonitoring, despite the abolition of the sentence, still did not exclude him from the "list of terrorists and extremists."

The FSB was initiated against Stenin in January 2015. The activist was charged with part 2 of Article 280 of the Criminal Code (public calls for extremism via the Internet). The reason for the opening of the case was a post that Stenin, who performs on Vkontakte under the pseudonym Ingvar Stefan, published on August 28, 2014, in the midst of the offensive of Russian troops on Mariupol, in the VK group ROA Russian Astrakhan (from 14 to 88). The post consisted of only two phrases: "Death to the Kremlin invaders! Hands off Ukraine!".

At the same time, the plot of the case was fabricated - the activist, along with his text, was charged and another. Directly under the post of Stenin is the commentary of the user Sergey Romanov. Romanov copied a small text about the situation in the ATO zone, placed on the same day on a personal FB page by Ukrainian journalist Peter Shuklinov, and also gave a link to the original publication.

The process of Stenin was led by the judge of the Soviet district court of Astrakhan Lilia Lisitskaya. The hearings were held closed. At the trial, as well as in the investigation, Stenin emphasized that under his post above Romanov’s commentary there were likes, which would be impossible if the post and comment was one publication. He petitioned for introducing his correspondence with the VKontakte support service to the case file. Support agents confirmed that Stenin’s post and Romanov’s commentary are two different notes. However, the judge refused the petition.

On May 16, 2016, Lisitskaya sentenced Stenin to the two years of the penal colony . On July 28, a member of the Presidium of the Astrakhan Regional Court Adil Tagirova left Lisitskaya’s decision in force . On October 26, the judge of the same court Evgeny Teslin rejected the cassation appeal of the convict.

On September 9, 2016, after the sentence entered into legal force, the stenin in accordance with the order of the penal inspection appeared at the colony settlement in the IK-10 in his city. Almost immediately after arriving there, a far -fetched occasion was imposed on the political prisoner; In addition, he was put on a vocational school. After that, on September 27, the FSINESS filed a lawsuit to tighten the stenin of the sentence, asking him to replace him with a colony of general regime with a colony. On November 7, Stenin was delivered to the KP-2 in the village of Sadovy Kirsovsky district of the Tambov region. At the same time, on November 10, the KP-2 administration appealed to the court with the same submission as the Astrakhan colony. On November 28, the judge of the Kirsanovsky district court Nadezhda Korolev satisfied the request of the FSINITS . On January 24, 2017, the Tambov Regional Court confirmed this decision . On March 1, Stenina was transferred to IK-3 in the village of Zeleny, the storyteller of the Tambov region.

Meanwhile, on April 19, it became known that the Supreme Court ordered the Presidium of the Astrakhan Regional Court to consider the cassation appeal filed by the lawyer of the political prisoner Tatyana Ivanushkina. At the same time, the decision was called into question both the motivation for the conclusion about the need to appoint Stenin the real term, and the very fact of the presence of a crime in the actions of an activist.

On May 30, the Presidium of the Regional Court, headed by the deputy chairman Tatyana Shustova , canceled the sentence to Stenin and stopped his case for lack of corpus delicti. Behind the activist, the right to rehabilitation and obtaining compensation was recognized.

In January of this year, it was reported that the complaint about the verdict of Stenin was sent to the ECHR. The lawyer of the Agora Damir Gainutdinov, representing the interests of the activist in Strasbourg, after the cancellation of the sentence noted that before Stenin received adequate compensation, should not recall the complaint.
