In the appeal of the verdict sentenced by the North Caucasian District Military Court in Rostov-on-Don, the supervisory authority indicated that the subscribed to Zeitullaev part 1 of Article 205.5 of the Russian Criminal Code (organization of the terrorist organization) provides for a period of 15 years to lifelong. The appointment of the term below the lower limit, the prosecutor’s office said, “it is possible only in the presence of exceptional circumstances”, which are absent in Zeytullaev. In this regard, the agency required a 17 -year -old regime for the Politzek. It was such a period that the prosecutor Gennady Trukhanov requested at the hearing in Skovs.
Nevertheless, the judges gave Politsyk the minimum term of imprisonment and the minimum term of restriction of freedom from those provided for by the Code.
The position of the supervisory authority was represented by the prosecutor Roman Gutnikov.
In one meeting with the submission of the prosecutor's office, an appeal was also considered, filed by the lawyers of the Politzek Emil Kurbedinov and Edem Semedlyaev. They demanded to justify their client.
Zeytullaev himself participated in a meeting on video communications from the Rostov SIZO-1. There was a T -shirt on it with the inscription "The order is executed". In September last year, another person involved in the case, Nuri (Yuri) Primov, put this T -shirt to announce the verdict . Zeytullaev himself was then in a T -shirt with the inscription "The performance is over." The inscriptions on the T -shirts of all four defendants in the case were formed in the phrase "The performance is over. The order was made. Crimean Tatars are banned again."
During the break of the meeting in the Armed Forces, and then, during the performance with the last word, Zeitullaev showed the public posters with the inscriptions of “repression in the 21st century”, “The deception is not eternal!”, “True, the water sharpens”, “Simple builder!”, “Who needs it?”, “When they hear us?”, “Patience”, “Thanks to people”.
At the beginning of the hearing, the political prisoner demanded to interrogate the district police officer, who gave him a characteristic contained in the case, as well as witnesses who were present during his search in his house. Lawyers, in turn, were asked to call a specialist in the "Memorial" by Vitaly Ponomarev so that he would evaluate the expert opinion in the case.
After a brief meeting, the judges rejected these petitions, saying that all the necessary witnesses were already questioned in Skovs.
In protest, Politzek for the third time since the beginning of April declared an unlimited hunger strike. He demanded to allow him to be Ukrainian Ombudsman Valery Lutkovskaya, the Genconsul of Ukraine in Rostov-on-Don Vitaly Moskalenko, as well as Russian human rights activists and journalists. In addition, he stated that he insisted on his return to Ukraine and the cessation of the persecution of Crimean Tatars.
"The judicial petition of Zeytullaev is not related to the subject of the proceedings, accepted for note," the judge Voronov announced. "We go to the debate."
Although Politzek expressed a desire to testify, the judicial investigation did not open, and he gave the testimony in the debate. Zeytullaev began his performance by quoting the plot of the accusations, adding a particle not to each verb: “I did not organize the terrorist organization on the territory of the village of Orlin and other areas of Sevastopol, did not use skills for hidden anti -Russian activity, etc.” “All of the above has no common life with me and my way of life,” the convict emphasized.
Further, Zeytullaev analyzed in detail the contradictions in the testimony of witnesses.
After that, he remarked: "The Crimean FSB'Shznik Kozhemyak is interested in the outcome of my business, who rubbed into confidence and shot a video of a kitchen conversation." Meanwhile, Politzek added, "if talking about the influence of the media on society, how the debauchery comes to society, record and consider the struggle against international terrorism, then fear will come to society."
Continuing the theme of falsification, Zeytullaev noticed that in the video shot by Kozhemyak he called himself AMMI (ar. Ignorant). Meanwhile, the case claims that he used the word Amir (commander, emir).
Regarding the formulation of the wording, “also agreed to meet” the political prisoner remarked: “For our people, to visit each other normally.”
“I am behind bars, because I want to think,” Zeytullaev emphasized. “In the legal field of Ukraine, I was a human rights activist, and in the legal field of Russia I was called a terrorist. Whatever your decision, I will not become a terrorist. I will continue to defend the rights of citizens. I am not going to make excuses for the terrible wording“ Organizer of the terrorist organization ”: everyone already see, whoever I am.
The lawyer Kurbedinov, speaking in the debate after his client, remarked: "If it seems to you incomprehensible the lifestyle of Crimean Tatars and Muslims, this does not mean that we are terrorists." Lawyer Semedlyaev also drew attention to the absence of a crime in Zeytullaev’s actions.
In the last word, the political prisoner called on the Crimean Tatars not to be afraid of persecution. “Even if they all put us in the camps, the whole world will see and condemn this,” he emphasized. “Stay (in the Crimea. - Ed.) And defend your rights and freedoms ... Those who have temporarily left,” return to the Crimea as soon as possible. ”
“If I die in these dungeons, my loved ones will be proud of me,” Zeytullaev remarked. “And for the rest I will be an example of honor and courage.”
32-year-old Zeytullaev-a worker worker from the village of Orlinin within the annexed Sevastopol. He was arrested on January 23, 2015. According to the plot of the case, which was led by the Crimean Glavk of the FSB, at the end of March 2014, Zeytullaev organized in the villages of Orlin, the rear and assault Balaklava district of Sevastopol, as well as in other parts of the city, the Hizb Ut-Tyrir cell for the creation of the Crimean Vilaifat in Sevastopol as an administrative unit of the World Caliphate. It is claimed that from three other persons involved in the case - Primov, as well as Rustem Vaitov and Ferat Saifullaev - he demanded to propagate the ideas "Hizb Ut -Tahrir", recruit new members, and later organize his own units of this structure.
In the investigation, all four political zones refused to testify. Zeytullaev did not testify during the first process in the case, which was held in Skovs in the middle of last year.
The prosecution of the first process was also represented by the prosecutor Trukhanov. For Zeitullaev, he, like in a second trial, demanded the same 17 years of a strict regime. For Saifullaev, the prosecutor requested eight, and for Primov and Vaitov - seven years of general regime. Unlike the main person involved, he was charged with part 2 of Article 205.5 of the Russian Criminal Code (participation in the activities of a terrorist organization), which in the editorial office, acting at the time of the episodes incriminated by him, provides for 5 to 10 years of the colony.
However, the Judicial College, under the chairmanship of Vyacheslav Korsakov on September 7, 2016, re -qualified Zeitullaev’s accusation from part 1 of Article 205.5 to part 2 and gave him seven years of general regime. The remaining three political zones received the minimum terms provided for by the Code - five years of general regime.
None of the defendants pleaded guilty. Speaking with the last word, they announced the political motivation of the case .
Meanwhile, the prosecutor's office appealed the sentence to Zeytullaev. On December 27, 2016, the college of the Armed Forces, as part of Igor Krupnov, Alexander Zamashnyuk and Sergey Sokkerin, canceled the sentence to the main defendant and confirmed the decisions in relation to the other three.
At the beginning of this year, Primov, Vaitova and Saifullaev was sent to the colony. Primov is contained in the Mari IK-5 in the village of Yasius Sovetsky District, Vaitov-in IK-1 in Kurgan, and Saifullaev-in the Kirov IK-17 in Omutninsk. The last two colonies have a torture reputation.
Meanwhile, the case of Zeytullaev since February this year has been considered in Skovs again. The verdict of Politzeka was sentenced on April 26 by the college, chaired by Anatoly Kolesnik . In the repeated process, the judges agreed with the charge under Part 1 of Article 205.5. The reasons why Politzek was given a deadline below stipulated by the Code, in the media, as far as is known, was not explained.
