The Supreme Court replaced suspended sentences with real ones for those involved in the Hizb ut-Tahrir case

On July 27, the Collegium for Military Personnel of the Supreme Court changed the sentences of four residents of Nizhnevartovsk accused of involvement in Hizb ut-Tahrir. The court decided to replace the defendant with suspended sentences for real ones. This is reported by "Frontiers".

Earlier, the prosecutor's office of the Khanty-Mansiysk Autonomous Okrug appealed against the suspended sentences of Ruslan Shamsutdinov, Rinat Bagaveev, Zaid (Eduard) Khusainov and Ildar Gabdrakipov. The supervisory authority demanded that all four be sentenced to real terms with serving sentences in a strict regime colony.

In February 2017, the Volga District Military Court sentenced Zaid (Eduard) Khusainov to six and a half years of probation, Rinat Bagaveev to six years of probation, Ruslan Shamsutdinov and Ildar Gabdrakipov to five years of probation. In addition, all four were assigned a five-year probationary period and fines over 100,000 rubles.

All four were charged with participation in the activities of a terrorist organization (under Part 2 of Article 205.5 of the Criminal Code). Bagaveev, Shamsutdinov and Khusainov were also accused of inciting hatred or enmity for posting videos on social networks (under Article 282 of the Criminal Code).

Today, July 27, the Supreme Court granted the appeal of the prosecutor's office and replaced all the defendants with suspended sentences for real:

• Zayd (Eduard) Khusainov was given six and a half years of general regime without a fine,
• Rinat Bagaveev - six years of general regime with a fine of 140 thousand rubles,
• Ruslan Shamsutdinov - five years of general regime with a fine of 120 thousand rubles,
• Ildar Gabdrakipov - five years of general regime with a fine of 140 thousand rubles.

The Supreme Court decided to place four convicts in custody. At the same time, the convicts themselves refused to participate in the meeting and did not make a video call with the court. All four were represented by their lawyers. The verdict of the court entered into force.

Ruslan Shamsutdinov was arrested on March 25, 2016. The arrest of three more defendants in this case was reported on April 14 in the media. According to investigators, the four defendants purchased Hizb ut-Tahrir literature and distributed it in Nizhnevartovsk, and published videos on social networks “aimed at creating a negative, hostile and hostile attitude towards the work of law enforcement agencies, representatives of Christianity and the Christian religion in general.”

Hizb ut-Tahrir is an Islamist organization, groundlessly recognized as a terrorist organization in Russia.
