An attempt to escape from the court, during which the members of the GTA were shot, was hardly a staging

The story with a shootout in the Moscow Regional Council, when the members of the GTA attacked the elevator in the convoy and were shot dead by the Rosgvard special forces, still leaves many questions both in terms of wild violation of the instructions for escorting and regarding the fact that it was: real negligence, or staging.

Five accused in the case of the so -called GTA gang accompanied only two escorts after the process, one of whom was a woman. To put it mildly, this is nonsense, they told the “new” on the basis of anonymity a number of former and current employees of the convoy service and the bailiff service. According to the departmental instructions of the Ministry of Internal Affairs of the Ministry of Internal Affairs of the Ministry of Internal Affairs intended for official use, there should be two employees of the convoy for one defendant, that is, the five defendants in the case should have accompanied at least ten escorts, but not two. Yes, and the regulations of escort never provided for and does not provide for the transportation of defendants in the elevator, especially calculated for all visitors of the court ... the defendants either lead the stairs or are accompanied in a closed separate elevator.

In the case of serious or especially serious crimes, as well as the crimes committed by an organized group or a criminal community having a large public outcry, the convoy unit was required to switch to an enhanced regime. This is spelled out in the order of the Ministry of Internal Affairs No. 140, which approves the instructions on the official activities of the temporary maintenance of the Ministry of Internal Affairs and the security and escort units. The order also implies the placement of employees of the Ministry of Internal Affairs in civilian clothes in the court building, and the defendants one in handcuffs should be escorted under the protection of the head of the convoy. On the entire path of the movement of the defendants, convoy posts are exhibited. If people are not enough, convoy can seek help from riot police or bailiffs.

For some reason, there was no nothing on August 1 in the Moscow Regional Council when escorting members of the Gang Gang, although riot police, bailiffs, and fighters of the Russian Guard were in court.

Who specifically from the leadership of the convoy was responsible for the protection of the GTA gang, on the account of which there were 17 murders and which it was necessary to escort at least with machine gunners and dogs (as they do in the case of other resonant cases, even economic) is still unknown. The name of the head of the convoy is not yet called the general public. But this unknown is similar to Kamikadze: such prohibitive negligence, if she really had a place, and not something else, has not yet met in Russian ships.

The question of the “new”, why the members of the GTA GTA were accompanied by only two escorts, the press secretary of the Moscow Regional Council was redirected to the Ministry of Internal Affairs and the Russian Guard, whose competence really belongs to the escort of the defendants. Both departments, along with the TFR and the prosecutor's office, are now being checked. The reasons for what happened have not yet been named.

The Investigative Committee instituted a criminal case on the “encroachment on the life of an employee of a law enforcement agency”, “theft of weapons” and “attempt to escape from custody”. The agency promises to “give a legal assessment of the actions of law enforcement officers and other structures that organized the escort of the defendants, secured the court’s building and were responsible for ensuring security as a whole.” Responsible for the distribution of escorts and violation of the regulations may threaten the punishment under Art. 293 of the Criminal Code (negligence). The head of the Russian Guard, Viktor Zolotov, has already stated that the perpetrators would surely bear responsibility, and the fighters who shot the attackers acted lawfully and will be represented for bonuses. He called what happened in the Moscow Regional Council “a gross violation from A to me” - and at the same time emphasized that it was impossible to stop the prisoners in the Gang Gangs case without their liquidation.

- Without death, it would not have been. When people have weapons in their hands, imagine, there were still people there, and they open shooting. How to stop them? Say: please stop? I want to say both the press and the townsfolk: when we can, we do everything so as not to destroy people. But when there is no such opportunity, when the life of other people is in danger - of course, we use weapons, ”he said at a briefing to reporters, noting that the escorts were beaten by gang members in the elevator before losing consciousness. They strangled and beat a man in the chest and broke their nose to a woman, beating her.

Spreading versions of the shootout

Information about the shootout on August 1 in the reports of the official departments varied: some claimed that the gang members were preparing an escape, others - that they wanted to take the convoy hostage, others - that they simply attacked the elevator. Moreover, messages appeared almost simultaneously. And what really happened in the elevator of the Moscow Regional Council remains not entirely clear.

One of the defendants attacked the convoy and began to strangle it. As a result, the defendants were able to free themselves and seize the weapons of the escort, one of whom managed to cause reinforcement - employees of the Russian Guard. " When the elevator arrived on the third floor, according to the TFR, there were an attackers, a special forces were waiting for, a shootout ensued. Three defendants were killed, two more were hospitalized with severe injuries, one of the employees of the Russian Guard was wounded; The escorts also "received multiple bodily harm."

The version of the Russian Guard:

The department for interaction with the media of the Russian Guard, in turn, reported that the special forces managed to "prevent the escape from the court of armed criminals." According to the department, the members of the gang "attacked the policemen accompanying them, took possession of a service weapon and tried to hide." In addition to weapons, the criminals also took possession of the keys to the handcuffs. The attackers were the first to open fire on the security forces; At the same time, special forces acted lawfully, clarified in the structure. Later they added that on the morning of August 1, six employees of the Sergiev Posad riot police in the Moscow Region provided force for the delivery of another suspect in the commission of a particularly serious crime in the Moscow Regional Council. Around 14.00, the OMON outfit received information about the group attack of the defendants on the escorts in the court elevator. “Aware of the public danger that armed criminals for civilians can be represented, the senior outfit OMON decided to detain them. He divided the unit into two groups that blocked the second and third floors. At the same time, the main group focused on the second floor as more likely to escape, ”the Russian Guard said. However, armed criminals jumped out of the elevator on the third floor. There is a second group of two riot police and police officers for safety. As soon as the criminals jumped out of the elevator, one employee of the Russian Guard immediately received a gunshot wound in the shoulder. The other, hiding behind the column, opened fire and neutralized several attackers. On the other hand, the police opened fire on the attackers.

According to Tatyana Petrova, head of the press service of the GUMVD in the Moscow Region, during the break of the court session in the GTA Gang case, five out of nine defendants, accompanied by employees of a separate security and escort of the suspects, went to the special clip and began to go down to the convoy. She noted that between the second and third floors the defendants, swinging the elevator, stopped him and attacked the police officers, took possession of their service weapons and handcuffs.

At the opening of the elevator, the arrested opened firing at the senior sergeant of the police Denis Lansky and two employees of the Russian Guard, one of whom was wounded. One of the attackers was wounded with return fire, and the bandits attempted to break through the adjacent corridor, ”Petrova said. However, according to her, the criminals failed to break through: the police ensign Nikolai Makarenko and senior sergeant Denis Koropchan used weapons and liquidated three criminals.

Around 13.00 the next meeting ended, and the five defendants were taken to the elevator to escort to the convoy (four more remained in boxing in the hall). In the elevator, the criminals "attacked the convoy - two police officers, took possession of their table weapons, took them hostage and brought them to the courtroom on the third floor." Already in the hall, police and riot police blocked the criminals and opened fire on them to defeat. Classes of video surveillance from the Moscow Regional Council, including from the hall on the third floor, have already been seized. “Everything is provided to the investigation group,” Natalya Osipova, press secretary of the court, told the “new” press secretary. On the footage, which soon got into the network, it really shows how the criminals burst into the meeting room. The police, who were inside, took positions and opened fire on the bandits as soon as they were indoors. The wounded defendants still show signs of life for some time, but then subside. Then the police leave the hall to evaluate the situation in the corridor.

According to the press secretary of the Moscow Regional Council, the security forces who repelled the attack of members of the gang, actually ensured security in another process in the case of the accused of banditry and the murders of the ex-head of the city administration Viktor Ardabyevsky. The case of GTA gang was considered a floor above.

Eyewitnesses

The shots were heard by many eyewitnesses who were in the building at that moment.

“The elevator with the defendants and the escort stood between the floors for about ten minutes,” said Sergey Peshkov, chairman of the new Arbat, college, who at that moment was in court in another case. - I went down to the first floor to drink coffee, passing by the court officers, I heard that they say that on the third floor the elevator with the defendants was stuck and it was necessary to call workers to fix this technical malfunction. I went on and soon heard shots, after which everyone began to be led out of the court. Everything happened without panic. My colleague was at that moment in the process, when she heard shooting already in the corridor. Going down from the fourth floor, at the third she saw a woman in the form of all in blood. Immediately there were assumptions that this was an attempt to escape the defendants in the GTA gang case - other resonant cases in court are currently not considered.

A small number of security is in fact the GTA gang is a common occurrence

The protection of some defendants in the GTA gang case told the “new” that the defendants always escorted 2-3 people, there were never intensified security.

The same was confirmed by the journalists who attended the process. Thus, the Kasparov.ru correspondent Andrei Karev recalls: “When he went to the process of GTA gang, he was perplexed why only two or three escorts were allocated to the hall of nine accused to the courtroom, plus one sleeping bailiff sat in the hall.”

Both lawyers and journalists are extremely surprised: in other cases (even administrative or economic), where there is only one defendant, sometimes there are special cinols, special units of bailiffs, machine gunners in masks, dog. ” But only for some reason not on the GTA gang.

- Usually, during the transportation of such dangerous persons there is an enhanced escort. How did it turn out that they were accompanied by a woman and one convoy-male?! How did they turn out together in the elevator with five dangerous gang members accused of a series of cruel inhuman murders?! - Lawyer Sergei Peshkov asks the question. - It's just a mystery. Moreover, the handcuffs of the defendants were fastened in front ... Well, guys, this is not even funny. They themselves created all the conditions so that the gang members decide on this. And they had nothing to lose: they perfectly understood that they were waiting for a lifelong. Since 1990, I have been working in this area (first by an investigator, then a lawyer), I have never met this. If these comrades broke free, it is quite possible that there would be those who died by visitors and court officers. There are always a lot of people here.

The version of the staging

A number of commentators of the incident immediately put forward the version that the incident could be a staging of the attack, and in fact the goal was to eliminate the gang participants who could testify to high -ranking ranks from the Prosecutor General. After all, the leader of the gang Ibaidullo Subkhanov and a number of other members were detained in November 2014 in the suburban house of the manager of the Prosecutor General’s Office, Alexei Staroverov. The murdered Subkhanov allegedly worked in the cottage as a watchman. During the search on the site, a caches with weapons were found. Initially, in November 2014, a criminal case was opened against Staroverov for storing weapons, but the next day, Deputy Prosecutor General Viktor Grin canceled this decision. As a result, Staroverov was interrogated only as a witness, and Vladimir Markin, at that time, the official representative of the Investigative Committee, said that he had only handed over the house in one of the participants of the GTA gang, and there were no complaints about Starovereov. However, after that he was removed from work, and in December 2014 he quit of his own free will. According to Forbes magazine, in 2013, Old Believers became the most wealthy employee of the Prosecutor General. Together with his wife, he earned 50 million rubles. Data on the sources of the origin of such funds were not published.

In court, the Old Believers had not yet been interrogated over the “GTA gang” of the GTA, but it was planned that he would perform. “We still had two months before his speech,” said Abubakar Manaev, who represented the interests of one of the dead defendants in the case of the GTA of GTA Umar Hasanov, “new”. However, the defender does not believe in the version with a staging.

- The versions about the staging are complete crap. If this occurred to our valiant organs, they would have done it in an investigative insulator. Better than there, you won’t do it anywhere. There, ask Zekov controlled - that's all. In a regular cell, they never find who killed. So they are unlikely to decide to eliminate them. You see, this is not that audience. I assume that there were some relations between the Old Believers and the leader of the gang of Subkhanov. I do not think that he took off the dacha from Staroverov. The market value of the object is very large, like several good apartments in Moscow. And a person who has such a house does not need to rent real estate for 10-15 thousand rubles a month. I suppose there were some agreements between the leader and master killed in 2014. And those who were shot in a shootout, they do not even say in Russian. They have nothing of themselves, they knew nothing much and did not communicate with people, because of which it would be worth removing. Here, who died during the detention of Ibaidullo Subkhanov - he knew everything. And these sixes: bring, give, do not bother ... They did a dirty job. With the exception of the only one in the elevator, Kholik Subkhanov, the leader of the leader ( he was also shot on August 1. - Ed. ). I also do not think that they themselves planned this attack in advance. If there were people who attack not only defenseless citizens, as the “GTA gang” is charged with, but in armed people, it would be possible to expect such a thing from them. And these have never attacked a police patrol or some kind of armed object. They always had unarmed victims. I think that they were in the elevator and seeing that they were five of them against two convoy, including a woman, they decided to attack.

- I would not look for a black cat in a dark room. Most likely there is wild negligence from the leadership of the convoy service, ”said lawyer Sergey Peshkov. - Plus - now the time is time, the convoy is not enough not only in the region, but throughout Moscow, the lack of personnel, the savings, the workload ... In addition, it must be borne in mind that the Moscow Regional Court is not a Moscow City Court, where the escort is much tougher. There are no resonant matters in the Moscow Regional Council. Apparently, relaxation played a role.

What is known about the "GTA gang"

The “GTA gang” of the media and the public dubbed a criminal group that was operating in the Moscow Region in 2012-2014. According to investigators, at least 15 immigrants from Central Asia entered the gang. They killed and robbed drivers both on the tracks near Moscow, and sometimes within the city. In total, 15 robbery attacks were committed with the murder of 17 people and the attempt for another two. The criminals at night, sometimes with the help of homemade spikes, pierced the wheels of cars, forcing drivers to stop. After that, the attackers killed the victims and took their property. 9 people were on the bench. Two were put on an international wanted list, one to the federal, two more were judged in Tajikistan, the leader of the group Ibaidullo Subkhanov, during the detention, resisted, throwing a grenade, after which he was killed. Как удалось выйти на след банды — СКР не сообщал. На суд по избранию меры пресечения фигурантам дела не удалось попасть ни одному журналисту.

Следствие завершили к октябрю 2015 года. Маркин, на тот момент официальный представитель СКР, назвал мотивы убийц «банальным желанием завладеть чужим имуществом и деньгами», подчеркивая, что те «не брезговали иногда просто мелочью», даже платьями убитых ими женщин. Безуспешные попытки задержать банду быстро СКР связывал с конспирацией участников: «Вели себя неприметно, занимались частным извозом, строительством, работали сторожами, то есть ничем не отличались от других мигрантов. Многие имели семьи. В силу такого образа жизни, в совокупности с продуманной системой нападений, банду было крайне сложно вычислить».

Из обвинительного заключения следовало, что главной добычей банды за более чем 4 года существования стал автомобиль Toyota Land Cruiser. Как правило, они либо уходили ни с чем, либо довольствовались наличными деньгами жертв, планшетами, серьгами, мобильными и даже дешевыми солнцезащитными очками.

Согласно обвинительному заключению, банда, организованная Ибайдулло Субхановым и «иными неустановленными лицами», характеризовалась «особой сплоченностью участников, проявившейся в безусловном их подчинении руководителю банды, наличием строгой иерархии, а также связанностью их как этническими и конфессиональными, так и родственными связями. Субханов разработал методику обучения владению огнестрельным оружием, а также использующимся в ходе нападений приемам рукопашного боя». Субханов формировал состав участников, финансировал, обеспечивал жильем и оружием и сам принимал участие в преступлениях. Его родной брат Холик, а также Файзлетдин Хасанов были его ближайшими приближенными и находились на особом положении — «контролировали соблюдение принципа единоначалия». Рядовые участники приобретали автомобили, средства связи, экипировку, оружие и участвовали в преступлениях. На вооружении группы находились автоматы АК-47 и АК-74, заводские пистолеты ТТ, Браунинг, ИЖ и МТР, а также семь пистолетов, переделанных из пневматического и газового оружия, гранаты и боеприпасы. При этом участники, несмотря на постоянные осечки, пользовались исключительно «самоделами». В целях «эффективности» использовали семь машин, часть из которых похитили.

Всем подсудимым грозило наказание вплоть до пожизненного. И все они (некоторые частично) признавали вину.

Ход процесса

К рассмотрению дела «банды ГТА» Мособлсуд приступил ровно год назад — в начале августа 2016 года. Этот процесс — самый громкий из проходивших в Мособлсуде со времен дела Боевой организации русских националистов (БОРН). Как и тогда, гособвинение в деле «банды ГТА» представляет прокурор Светлана Артемьева и двое ее коллег. Ведет процесс судья Наталья Валикова, известная тем, что в свое время вынесла на основании вердикта присяжных оправдательный приговор полковнику Владимиру Квачкову по делу о покушении на Чубайса. Члены «банды ГТА» от суда присяжных отказались, решив, что из-за тяжести обвинения присяжные не смогут отнестись к нему с должной объективностью.

Часть подсудимых имеет двойное гражданство: РФ и Узбекистана, у части — только российское. Представляют их исключительно адвокаты по назначению, нет ни одного, работающего по соглашению. В деле более 200 томов.

Сам суд над бандой шел очень медленно. Как рассказали «Новой» посещавшие процесс журналисты порталов «Медиазона» и «Каспаров.ру», заседания то и дело откладывались из-за того, что в деле постоянно сменялись адвокаты по назначению (новеньким нужно было время на ознакомление с материалами). Итог: прошел год, обвиняемые не успели дать показания по каждому из вменяемых им эпизодов, не допрошены и все свидетели обвинения.

— Я думаю, мы надолго застряли, даже без учета произошедших событий, — говорит адвокат Абубакар Манаев. По его словам, назначенного на 8 августа заседания скорее всего не будет, и на какое число его перенесут, пока непонятно — все зависит от выздоровления двух раненых фигурантов.
