On Tuesday, the Moscow City Court satisfied the complaint of Vecheberdi Nurmatov (the name of the author of the “New”, which writes under the pseudonym Ali Feruz) to the decision of the Basmanny Court on its forced expulsion from Russia.
The reason for this decision was the position of the ECHR. On Friday, the European court applied interim measures and forbade the sending of Feruz to Uzbekistan before considering his complaint, guided by the rule of 39 of his regulations. Rule 39 is used in cases where the failure of preliminary measures creates a real danger to the applicant. In the case of Ali, forced expulsion to Uzbekistan could cost him life.
The complete complaint of Ali Feruz in connection with the decision on expulsion from Russia will be filed in the ECHR until September 1. It will indicate that Ali from Russia to Uzbekistan will violate Article 3 of the Human Rights Convention (this article prohibits torture, inhuman and humiliating dignity), since in Uzbekistan it will be sent to prison with a high probability and subjected to torture.
“Article 8 of the Convention will also be violated, which guarantees the right to respect private and family life - after all, his mother is a citizen of the Russian Federation and lives in the Russian Federation, she is disabled, and he helps her,” Tatyana Glushkova, lawyer of the Memorial human rights center, representing the interests of Ali in the ECHR.
The European Court will consider Ali's complaint in priority. All this time by the decision of the Feruz court will be at the time of temporary content for migrants.
“The case of Ali in the ECHR is given priority, we expect that its consideration will take a relatively short time,” says Tatyana Glushkova. - But, unfortunately, this is unlikely to be less than a year.
The use of interim measures by the European court is a new circumstance, which allows Feruz to ask asylum in Russia again, which he immediately did. On Monday, he wrote another statement with a request to provide him with a temporary shelter.

Suvsig is not a prison, the department is subordinate to the Ministry of Internal Affairs, but the rules are not strict there, you can move around the territory, play football. There is a large library in Suvsig. The NEW Culture Department has already prepared a replenishment for her: he collected several dozen books that we will transfer to the center in the near future.
Ali does not complain about the conditions of detention in Suvsig. He reads, writes a report from the inside - he had already handed over a notebook with a draft to his colleagues. He asked to work on his incomplete text, which he passed on the eve of the detention. This is a text about Tajik, who was beaten by the police.
